Culpeper County, VA - Land Record Deeks Book II JAMES DUNCAN Land Record Deeds p12 Book II B and S 5/17/ 1807 James Duncan Heirs This indenture made the 17th day of May 1817 between Dorcas Duncan administratix of James Duncan deceased the county of Culpeper the state of Virginia of the one part and Marshall Duncan William Duncan John Duncan Lewis Duncan Hiram Duncan Lucy Duncan and James Duncan children and distributees of the said James Duncan deceased of the county and state aforesaid of the other part witnessed that the said Dorcas Duncan acting as administratix of the said James Duncan deceased considering that it would be to the interest and advantage of the said children once distributees to vest the money of said estate in lands has purchased three several parcels land with the monies of the said estate and has paid the whole of the purchase money at the tmie except about the sum of five hundred and ninety dollars which is yet due and which she intends to pay also out of the aforesaid funds there is to pay she has purchased one piece of eighty-four acres of the estate of John Browning deceased by deed bearing the date the 22nd of March 1816. One other parcel containing about thirty-one acres of Abraham Little, Isaac Little, William Miller and Peggy his wife by deed bearing date the 7th of April 1817 and one other parcel containing about sixteen and one-forth acres of James Embrey and Elizabeth his wife by deed bearing date the 7th of April 1817 which said several deeds are of record in the office of County of Culpeper aforesaid and the indenture further witnessed that it is the intention of the said Dorcas Duncan to vest the said land in the same children once distribution they on their parts a pending when they shall arrive at lawful age to the course which she has pursued as above set forth with respect to the vestiture of their said monies in land and if they do not thus agree then those who disagree to the same are to take no benefit by their deed but their shares of the said lands as to be sold to revise their proportions of the monies and interests of the said estate which was appraised for the purchase of land now this indenture further witnessed also that in consideration of the premises that said Dorcas Duncan hath bargained and sold and by these present doth bargain and sell unto the said Marshall Duncan, William Duncan, John Duncan, Lewis Duncan, Hiram Duncan Lucy Duncan and James Duncan the said parcels of land above mentioned that is to say one parcel purchased from the estate of John Browning deceased and Conveyer by George Yates and Polly his wife, Nimrod Duncan and Lucy his wife Fredrick Whicecarver and Frances his wife and Cornelius Whicecarver and Elizabeth his wife John Duncan and Nancy his wife Elijah Bruce and Melinda his wife and George Browning and Gillian his wife and Robert Whicecarver and Sarah his wife to the said Dorcas Duncan by deed bearing date 22nd of March 1816 as above set forth containing by estimation eighty four acres as aforesaid and bounded as follows Viz Beginning at a Spanish oak corner to Elijah Little thence N22degrees 30 min. E 126 to a gum white oak and Spanish oak saplings Corner to John D. Browning thence with his line N 37 degrees 30 min. W 82 poles to a stake corner to Elijah Bruce thence with his line S 51 degrees 30 min. W 108 poles to a stake in Elijah Settles line and corner to said Bruce thence with the several courses of the old church road and with the lines of Settle to the beginning also one other parcel purchased as afore said of Abraham Little Isaac Little William Miller and Peggy his wife by deed bearing the date the 7th of April 1817 as above set forth containing by estimation thirty one acres as aforesaid and bounded as follows Niz beginning at a stake in Duncans field thence s 47 degrees 15 min. West Poles to a red oak stump in said field thence N 50 W 76 to the west edge of a mill pon on Connors run thence down the same S 26 W15 poles to a hickory and forked gum on the same side of the pon thence N 75 W 10 poles to a red oak thence N 12 E 37 to three dogwoods by a rock on Conners Run Corner to George Yates thence down the various meanders of said run to a bunch of Dead Mo??? by the mouth pf a branch on the eastside of run Corner to Elijah Settle thence S 27 E 72 poles to the beginning and also one other and last mentioned tract purchased as aforesaid of James Embrey and Elizabeth his wife by deed bearing the date 7th of April 1817 as above set forth containing by estimation sixteen and one forth acres as aforesaid and bounded as follows Viz. Beginning at a hickory red oak and pine corner to the lands of the aforesaid James Duncan deceased on the north side of Thornton's gap road and runs thence S 47 degrees 15 min. W 45 poles to a box Oak in said Duncan's line thence N 31 W 62 poles to some small bushes on a Stony point in Little's line thence N 57 degrees 30 degrees E 50 poles to a black gum two Spanish Oaks and one white oak corner to Settle and Duncan aforesaid thence S 25 W 53 poles to the beginning to have and to hold the said several tracts or parcels of land together with all and single of the appertenances to them the said Marshall Duncan William Duncan John Duncan Lewis Duncan Hiram Duncan Lucy Duncan and James Duncan their heirs and ??? forever free from claim or claims of all and every person or persons whatever In testimony where of the said Dorcas Duncan here unto sets her hand and seal the day and year within written .
