Will of Jane Bayne of Culpeper County, April 11, 1802, Page 370-371, Culpeper County Will Book D. In The Name Of God Amen, I Jane Bayne of the County of Culpeper do make this my last Will and Testament. First, I recommend my Soul to God... I desire that my just Debts and funeral expences be first paid. Whereas Marshall Petty stands justly indebted to me by bond in the sum of fifty five pounds with Interest as therein specified for money by me to him lent and advanced no part of which has been paid it is therefore my will and desire that my Executors hereafter named use diligence in collecting the same and when collected pay it to the persons hereafter mentioned in the following proportions to wit. To George Collins the son of Frankey Tye (late Frankey Collins) the sum of fifteen pounds; to George Hawkins Son of my Daughter Jane Hawkins ten pounds; to William Butler who hath intermarried with my Daughter Betsey fifteen pounds and to the said William Butler for the purpose of paying my just debts the balance of the said Bond being fifteen pounds with Interest due of the said several sums first deducting the Interest any extra expence for the recovery of the same. It is my will and desire and I do give and bequeath to my Grand Daughter Catey Hawkins the Daughter of my Daughter Jenny who hath intermarried with Wm Hawkins my Six Silver Table Spoons & six Silver Tea Spoons to her heirs and assigns. It is my will and desire that all my household & kitchen furnature and all my wearing aparel be equally divided among all my Daughters Susanna Bayne Betsey Butler & Jinny Hawkins. I constitute and appoint my friend John Butler and my Son In Law William Butler Executors of this my last Will and Testament. In Witness whereof I hereunto set my hand & affix my seal this 11th day of April 1802. Presence Elizabeth Petty R. Y. Wiginton (Sig) Jane [X] Bayne At a Court continued and held for Culpeper County the 20th day of April 1802. This Last Will and Testament of Jane Bayne decd was exhibited to the Court and it being suggested that the said Jane at the time of making and Executing the same was a married woman. Whereupon George Bayne her husband appeared in Court and declared that he was willing that the legacies that the will contained should be distributed as is therein directed and for that purpose consented that the Will should be proved and established but with this exception that this act should not be drawn into a preceden against him in any other transaction of the said Jane his Wife whereupon Richard Y. Wigginton one of the Subscribing Witnesses proved the same and it is ordered to be recorded and on the motion of William Butler one of the Executors therein mentioned Certificate is granted him for obtaining a probate thereof due form he having made oath thereto and given bond and security according to Law.
