The submitter has given permission to the USGenWeb Archives to store the file permanently for free access. http://www.usgwarchives.net ******************************************************************************** Will: Thomas Brown, St.Mark Parish, Culpeper Co, VA (1758) IN THE NAME OF GOD AMEN, I Thomas Brown of the Parish of St.Mark in the County of Culpeper, being sick and weak in body but in understanding & memory as sound & perfect as usual, do make and ordain this my last will & testament in manner & form following (viz): After my funeral charges & just debts shall be paid, the remainder of my estate, real & personall (except only as follows), I give and bequeath to my beloved daughter Eleanor Brown and her heirs forever; but if it should so happen that my said daughter should die before she hath lawful issue, then I give & bequeath my said estate to Thomas Brown, son of my brother Coleman Brown & Ann Brown, daughter of my brother William Brown, to be equally divided between them & their heirs forever, the following legacies excepted, viz: To my niece Elizabeth Farge the sum of forty pounds to be paid her in case said daughter should die without issue & not otherwise. And whereas, by the Will of Edward Stubblefield, dec'd, he, the said deceased, left a negro woman named _______(faded out) to his wife Eleanor, with whom I married after the decease of the said Edward, and did order in his Will that his daughter Ann Stubblefield should h_____(faded) half the issue of the said Kate, I do therefore order that my Executors shall pay the said Ann Stubblefield forty pounds current money when she arrives at lawfull age or marries in case the said Ann Stubblefield will renounce all benefit which she might claim under the said clause of her father's Will & not otherwise, I give to my mother the sum of forty shillings per annum during her natural life. Lastly, I do hereby nominate & appoint my two brothers Daniel Brown & William Brown Executors of this my Last Will & Testament. IN TESTIMONY whereof I have hereunto set my hand & seal this sixteenth day of August Anno.Dom. one thousand seven hundred & fifty eight.                                                     Thomas Brown Sign'd, seal'd, publish'd & declared in presence of: Francis Slaughter John Slaughter Reuben Slaughter                          At a Court held for the County of Culpeper                           Thursday, the 21st day of September 1758 This Last Will & Testament of Thomas Brown, dec'd, was exhibited to the court by Daniel Brown & William Brown, the Executors therein named and was proved by the oaths of Francis Slaughter, John Slaughter & Reuben Slaughter, witnesses thereto and ordered to be recorded, and on the motion of the said Executors, Certificate is granted them for obtaining a Probat thereof in due form, they having sworn to the same and given bond & security as the law directs.
