Persons or organizations desiring to use this material, must obtain the written consent of the contributor, or the legal representative of the submitter, and contact the listed USGenWeb archivist with proof of this consent. ************************************************************************ Will of John Zachary Jr. March 25, 1785 Will Book C Page 116-117 Culpepper County Virginia In the name of God Amen, I John Zachary Jr. Of Brumfield Parish in the County of Culpepper, in the State of Virginia, Planter, being weak of body but Perfect of mind and memory and praised be God for the same, I therefore, calling to mind the mortality of my Body, and knowing that it is appointed for all men once, to die, do make and ordain this to be my last will and testament (that is to say) Principally and first of all, I give and recommend my soul, unto the Hands of Almighty God, that gave it, and my Body ,I recommend to the Earth, to be Buried in a decent Christian like manner, at the discretion of my Executors, here in after mentioned. Nothing doubting, but the General resurrection ,I shall receive the same again, by the Mighty power of God, to Bless me in this life, I give ,Demise, and Dispose of the Same ,in the following manner. Affirm (Viz) My Will and Desire is, that all my Estate of what kind, be immediately after my decease, will be sold at Public sale, to the highest bidders for Money. And the Money arising from such sale, to be Equally Divided Between my Two Brothers And My Five Sisters. Viz.: Benjamin Zachary, William Zachary, Elizabeth Bledsoe, Ester Burbridge, Hannah Burbridge, Sarah Eastham, and Milley Wright. Furthermore, It is my Will and Desire, and I do hereby Constitute, appoint, and ordain, my Loving Brothers , Benjamin Zachary and William Zachary, to be my whole and sole Executors of this my last Will and Testament. And I do hereby, Utterly, Disallow, and Disannul, all and every other former Testaments. William Legrones And Executors by me in any wise before named ,Willed and Bequeathed, Ratifying and Conforming this and this only, to be my last Will and Testament. S Field my Great Spring Tract of Land containing one Thousand acres of Land also four hundred acres of Land lying on Otter Creek in Lincoln County also two Negroes Named Nelson & Nancy to him & his heirs forever Item I give and bequeath unto my six Daughters Dianah Field, Suze Field, Nancy Field, Elizabeth Field, Mary Field & Sarah Field one Thousand acres of Land apeace out of a Tract of 19015 acres of Land Located by Benjamin Field if there is as much saved out of the said Entry if not whatever is got to be Equally Divided amongst them or their Heirs forever Item I give unto my Daughter Elizabeth Field Three hundred pounds special to be paid her by my Executors out of the profits of my Estate so soon as it can be raised but my Estate is not to pay her interest, but she is to be maintained out of my Estate until she is paid the said three hundred pounds Item I give unto my Daughter Nancy Delany three negroes Nelly, Baccus & Flence to her & her Heirs forever Item I give and bequeath unto my Daughter Molley Field Three negroes, James, Squire & Edey to her and her Heirs forever Item I give and Bequeath unto my son George Field one Negro boy named Martin to him & his Heirs forever Item I lend unto my loving wife Mary Field during her Natural life the Bal'c of my tract of Land in Culpeper County containing three hundred acres and after her Decease to my son George Field to him and his Heirs forever Item I give unto my Loving wife Mary Field my Riding mare Item I do impower and direct my Executors hereafter named to sell one Thousand acres of Land out of my Track of Three Thousand four hundred acres in Kentuckey in Hustons Fork and to purchase two young negro woman to go --- I shall afterwards direct and the Ballance to be apply'd towards Paying of my Just Debts & Legacies. Item I give all my Lands not here before mentioned in the County of Kentuckey to my sons Joseph Field, John Field, Thomas Field & George Field to be Equally divided between them as to Quantity and Quallity to them and their Heirs forever Item I give and bequeath unto to my four sons Joseph Fields, John Field, Thomas Field, George Field & my Daughter Sarah Field all my Slaves together with the two Slaves that my Executors is directed to purchase they and their increase to them and their heirs forever Item Imy (?) will is that the Slaves is to be Equally Divided between my said Children, John, Thomas, Joseph, George and Sarah as they shall Marry or come to Age allowing my loving wife one Sixth part at the first division and so on till they all get, and after my wifes Decease her part is to be Equally divided amongst them and all my other Estate both real & personal to them & their Heirs forever Item I do direct and impower my Executors to Rent out all my Kentuckey Lands untill my Children shall arive to age when --- ---- and the rents they are to receive And lastly I do appoint my two sons Daniel Field and Henry Wm S Field my hole [whole] & Sole Executors of this my Last will and Testament hereby revoking all Former wills and declaring this to be my Last Will and Testament.
