All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/va/vafiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Richard Cottrell rjc@web-access.net April 13, 2008, 1:43 am Source: Cumberland County Court Records (1774-1792) Written: October 10, 1791 Letter concerning escape of Benjamin Cottrell from jail Cumberland County Court Records (1774-1792) Call Number: Mss4 C9102 c Publisher: Virginia Historical Society Cumberland County State of Virginia, to wit: Walter Warfield Gentleman one of the Commonwealth Justices of the peace for the said County of Cumberland, to the Marshal of the District of Virginia, under the Federal Government and to all Sheriffs, Mayors, Bailiffs, Constables and Head boroughs within the Commonwealth of Virginia Greeting, Complaint being this day made to me by Mayo Carrington Deputy Marshal of the said District of Virginia that Benjamin Cottrell of the said County, who was charged in Custody of him the said Mayo Carrington as Deputy Marshall aforesaid, and for want of bail, at the suit of Robert Donald, Andrew Donald, Thomas Donald, Alexander Donald, Robert Donald junr and Alexander Donald junr of the city of Glasgow in the Kingdom of Great Brittain, surviving partners and obligees of James and Robert Donald and others late Merchants and partners of the said City and Kingdom, acting under the firm of James and Robert Donald and Company, in an action of Debt for two hundred and forty three pounds five shillings and two pence Currency of Virginia damage fifty pounds, did on or about the eighth day of the present month October, by force and without the consent of him the said Deputy Marshall, make his escape out of the Custody of him the said Deputy Marshall, as he was conveying the body of him the said Benjamin Cottrell to the Jail of the said Cumberland and is now going at large: These are therefore in the name of the United States, To require you and every of you in your respective District, Counties, Towns and precincts, to seize and retake the said Benjamin Cottrell, and him so retaken, to commit to the prison, where debtors are usually kept in the county where he is so retaken, and deliver him to the keeper thereof together with this warrant hereby commanding and requiring you the said keeper to receive the said Benjamin Cottrell and him Safely keep in the said Jail untill a certificate under the hand of the Clerk of the Court of the United States for the Middle Circuit within the said District of Virginia, that this Benjamin Cottrell hath given bail in the said suit, shall be delivered to you, and return this warrant to the said Court at Richmond in the said District of Virginia, pursuant to the laws in that case made and provided Given under my hand and Seal this tenth day of October one thousand seven hundred and ninety one WWarfield Image of Letter: http://www.cottrellweb.com/documents/benajmincottrell.jpg Transcription and image by Richard Cottrell File at: http://files.usgwarchives.net/va/cumberland/court/cottrell391gwl.txt This file has been created by a form at http://www.genrecords.org/vafiles/ File size: 3.3 Kb
