Morgan Family Abstracts from Court Order Books, 1757-1761 - Cumberland Co. VA John Pleasants, surviving partner of John Pleasants, Jr., filed suit against William Davis. Defendant acknowledged his debt in the amount of 15 pounds, 17 shillings, and 4 pence. (1:83) March Court 1757 John Morgan was issued a license to keep an ordinary at his home in this county. Robert and David Chandler provided the necessary security. (3:460) May Court 1761 On the attachment obtained by John Esdale and John Park against the estate of Thomas Frankland who is said to be so absconded that common process cannot be served upon him for a debt said to be due from the defendant to the plaintiffs. This day came the plaintiffs by their attorney and the sheriff having made return that he had executed the said attachment in the hands of John Frankland and summoned him as a garnishee, and also that he had attached fo the estate of the said defendant one negro girl. The said defendant was solemnly called and came not, but made default. Whereupon, on hearing the testimony of several witnesses it is the opinion of the court that the claim due 26 pounds 4 shillings, 7 pence, 3 farthings to be paid from the sale of said negro after defendant's wife's death. (5:327) Thomas Morgan, a witness for John Esdale and John Park in their suit against Thomas Frankland, received 50 pounds of tobacco from the plaintiffs for his 2 days' attendance at court. Nicholas Spears similarly received 75 pounds of tobacco, and James Moss also received 50 pounds of tobacco. (5:328) Also, Morgan's petition against Edward Arms was dismissed for want of prosecution.
