Trent and Elizabeth his wife of the first part, Alexander Trent of the second and Stephen W. Trent all of the county of Cumberland of the third part whereas the said Stephen W. Trent has endorsed (together with Thomas B. Sanderson) a note payable and negotiable at the bank of Virginia amounting at this time to four thousand dollars, for money borrowed of the said bank, of which sum one fifth was borrowed and received by the said Stephen W. Trent, one fifth part by the said Sanderson, and the residue by the said John A. Trent and whereas it is just that each of the said parties, should pay to the said bank his portion respectively, of the said loan, and it is the wish of the said John A. Trent to indemnify the said Stephen W. Trent from any responsibility on account of his the said John A. Trent’s proportion thereof. Now this indenture witnesseth that the said John A. Trent and Elizabeth his wife for and in consideration of the promises, and for the further consideration of one dollar to them in hand paid by the said Alexander Trent, the right whereof is hereby acknowledged have granted, bargained, and sold, and by these presents do grant bargain and sell unto the said Alexander Trent his heirs and assigns all that piece or parcel of land lying in the west side of the road leading from Thomas’s Bridge ___? The said John A. Trents plantation commonly called Marlins Road except fifty acres to be laid off so as to include the Mill Stone and other buildings contiguous thereto in such manner as the said John A. Trent his heirs or assigns may think proper to direct, which said piece or parcel of land hereby granted contains about four hundred acres be the same more or less and is part of the tract on which the said John A. Trent resides. To have and to hold the said piece or parcel of land with its appurtenances unto him the said Alexander Trent his heirs and assigns forever upon this trust nevertheless that if at any time the said Stephen W. Trent his heirs executors or administrators should be required and compelled to pay on account of the said note, or any future removal thereof any portion of the sum of money borrowed of the said bank which was received and used by the said John A. Trent as aforesaid or any part of the interest curtailment or discount which ought to be paid by the said John A. Trent, it shall and may be lawful for the said Alexander Trent to make sale of the land hereby granted to he highest bidder for ready money, or as much thereof as may be necessary, and out of the proceeds of said sale, after deducting the charges of executing this trust to pay to the said Stephen W. Trent his heirs executors, or administrators whatever sum he or they may have pair as aforesaid for and on account of the said John A. Trent and the balance if any, be pay over to the said John A. Trent his heirs, executors, administrators or assigns provided always that previous to any sale thirty days notice of the time and place shall be given in some newspaper published in the City of Richmond.
