Oakley/Ryals Indenture, 1848 Deed Book 26, pg 567 Cumberland County Va Thomas G. Oakley to deed V C. Ryals This indenture made this 5th day of August 1848 between Thomas G. Oakley late of the State of Tennessee of the one part and V.C. Ryals of the County of Cumberland and State of Virginia of the other part witnesseth that the said Thomas G Oakley in consideration of one hundred and ninety dollars lawful money of this Commonwealth, to him in hand paid by the said V C. Ryals at and before the sealing and delivery of those present the receipts whereof is hereby acknowledged, have bargained and sold and by those presents doth bargain and sell unto the said V C. Ryals his heirs and assign a certain lot or parcel of land containing by recent survey thirty five acres. Lying and being in the County of Cumberland and allotted to the said Thomas G Oakley by commissioners as one of the children and legatees of Shadrack Oakley dec which lot or parcel of land adjoins the lands belonging to the estate of Edward Walton dec and lies between the land allotted to William A. Oakley and Jordon H. Oakley children and legatees of Shadrack Oakley, dec as will fully appear by reference to a survey and platt accompanied by a report of commissioners all of record in the clerks office of the County of Cumberland it being the entire interest of the said Thomas G. Oakley in the landed estate of the late Shadrack Oakley dec. With all and singular the appurtenances. To have and to hold the said lot or parcel of land an appurtenances before mentioned unto the said V C. Ryals, his heirs and assigns forever to and for the only proper use and behoof (sp) of him the said V C. Ryals his heir and assigns forever and the said Thomas G Oakley for himself and his heirs, the said land and appurtenances unto the said C. C. Ryals, his heirs and assigns face from the claim of him the said Thomas G. Oakley or his heirs and of all and every person or persons whatsoever shall will and do warrant and forever defend by these presents. In witness whereof the said Thomas G. Oakley, of the County and State aforesaid have nominated constituted and appointed and by these presents doth nominate constitute and appoint Thomas G. Oakley, my brother, now in Virginia to be my true and lawful attorney for me and in my name to have demand and receive for me and for my use all and singular every kind and parcel of property and all sum or terms of money whatever in the State of Virginia to which I am or may be entitled and particularly my distributive portion of the estate of my father Shadrac Oakley late of Cumberland County Virginia deceased and for me and in my name to give such acquittances receipts or instruments of writing as may be necessary and proper hereby satisfying and confirming all that my said attorney may do in the premises. Witness my hand and seal this 26th day of May AD 1848. Jordon H. Oakley State of Alabama, Maringo County I William M. Brooks a commissioner appointed for the State aforesaid under an act of the State of Virginia, entitled an act authorizing the appointment of Commissions to take depositions and affidavits, the acknowledgments of deeds and instruments in something under seal out of the State of Virginia do hereby certify that Jordon Oakley a party to the certain deed on the other side of this page and bearing date the 26th May AD 1848 personally appeared before me in my state and county aforesaid and acknowledged the same to be his act and deed and desired me to certify the said acknowledgment for the uses and purposes therein mentioned and to the proper court or to the clerk of the proper court that said deed may be recorded. Oakley to Thomas G Oakley with a certificate of acknowledgment annexed and a receipt from Thomas G Oakley to Hez Ford Admor of Shadrack Oakley dec was received in this office and said receipt acknowledged by Thomas G. Oakley to be his act and deed and admitted to record Tests BB Woodson _________________________ Received August 7th 1848 of Hez Ford admor of Shadrack Oakley dec two hundred and forty three dollars and 24 cents with the interest due thereon in full of the amount assigned me in the hands of said admor in the division of the personal estate of Shadrack Oakley dec as settled and divided by commissioners and reported to the County Court of Cumberland. Received also at the same time of said admor thirty six dollars and 48 cents, with the interest due thereon, in full of the amount assigned the heirs of Frank (Francis) Oakley dec in the hands of said admor in the division and settlement aforesaid, which said amount of thirty six dollars and 48c/ is paid to me as attorney for Asa Oakley Gdn (guardian)for said heirs.
