Goodman, deceased, to be filed with the Clerk of the Circuit Court of the County of Cumberland as required by Chap. 384 ,Acts of 1923. The undersigned, who qualified on the 7th day of March 1925 in the Circuit Court Clerk's office of Cumberland as Executor of Caleb B. Goodman late of said County on my oath do say that I have made diligent inquiry as to the names, ages and addresses of the heirs of My decedent Caleb B, Goodman, and I believe the following to be a true and correct list of such heirs with their ages and addresses. TESTE: Virginia, In the office of the clerk of the Circuit Court of Cumberland County, March 7th 1925 and in the 149th year of the Commonwealth. It appearing that Caleb B. Goodman late of the aforesaid County departed this life the 17th day of January 1925. Therefore L. H. Goodman, his son, personally appeared before the clerk in office and made oath that the said Caleb B. Goodman Dec’d had no will to his personal knowledge. Thereupon on motion of the said L. H. Goodman be and is appointed administrator of the estate of the late Caleb B. Goodman and entered into a bond of five hundred dollars with Fidelity and Deposit Co. as his surety (their sufficiency is justified as the law directed) conditional and payable as the law directs. Thereupon certificates are granted the said L. H. Goodman for obtaining letters of administration on the said deceased estate in due form. The clerk deeming it unnecessary no appraisers were appointed. TESTE: Lewis Crawley Clerk Will of Noton Goodman Cumberland County, Virginia Will Book page 397 In the name of God amen. I Noton Goodman of Cumberland County and State of Virginia, being weak of body but of sound mind and memory and knowing that I must die, do make this my Last Will and Testament in manner and form following, that is to say, my will and desire is that after my death my estate be kept all together and remain in the hands of my executors herein after named during the natural life of my wife, Polly Goodman unless She think proper to get married again, in which case my desire is that my Estate be immediately divided giving to my said Wife Polly Goodman one third part of my whole Estate both real and personal to hold and enjoy for and during her natural life and the balance to be equally divided amongst my seven Children to wit: Merewether, Sally, Robert, Thomas, Mary A., Jane F., and Martha J. excepts so much of my Estate as is hereinafter given to my granddaughter, Mary E. Davenport and so much as will be sufficient to __________ those of my younger Children who may not have received an education equal to those of my Children now of ago, and So much as will be sufficient to advocate my Sara Grand daughter in like manner which mounts my desire is should be first denoted from my Estate and held by my Executors for the above named purpose before a final division takes place .~ my will and desire is that should my Estate agreeable to the above clause, be held together during the natural life of my said Wife Polly Goodman, that in that lease my executors pay to my Children before named that is Sally, Robert, Thomas, Mary A., Jane F. and Martha J., one thousand dollars each that is five hundred dollars as each arrive at the age of twenty one and the like sum twelve month thereafter, unless my Executor find it convenient from the income of my Estate to pay the said One thousand dollars as one payment without _____________ my Estate by sale of property in which case they my executors is authorized to do so giving to each child named, one thousand dollars out of their portion of any estate as would fall to him or her in case of a ________ divisions of my estate ~ My desire is that my executor permit my wife, Polly Goodman to purchase any thing which she may need for her domestic comfort or enjoyment or the comfort and enjoyment of those of my younger children whoso they remain under her protection, and paying for the same out of the proceeds of my estate for and during her widowhood. I give to my Grand daughter Mary E. Davenport two Negro girls to wit Serona and Cloe to her and her heirs forever, which her Negros (if desired by my daughter Sally, mother of my said grand daughter) I desire may remain with my other estate, until a division of the same takes place amongst my children. Should it so happen that from the change of time as any other cause, that my estate diminish instead of increase and that the expenses of my estate cannot be paid from the income of the same, and that a division would be in the interest of my wife and children in such an event, I desire that the first clause in this my will be void, and my executors proceed to divide my estate as before directed making one an equal divisions amongst all my children __________ only such as has already been decreased and so much as will complete the before mentioned object of education, and also one hundred dollars to be paid to my said grand daughter as the division my estate, which sum is in addition to any property given to her, as provision made for her, before my will and desire is this my executors sell at any time they may think proper. Such property belonging to my estate as they may think an encumbrance as unprofitable, and use the proceeds of the same as they may think advisable for the interest of my wife and children. My will and desire further is that in regard to my landed estate my executors use their non-discretion as to making sale of the whole in one body or dividing the same according to a previous clause in this my will, that is if my estate remain undivided till after the death of my wife Polly Goodman, that my executors sell any landed estate, as have the same divided as to them appears most to the interest of my children before named and it is also my will and desire that in order to make an equal and fair division, they sell any other property that may belong to my estate in order to effect the object of an equal division. My will and desire further is that in case of a division before the death of my said wife, that the same discretion be used by my executors in selling property as is allowed in case of a full and complete division. My will and desire is that in case of a division of my estate before the death of my said wife that the portion of my estate devised to her during her natural life, should after her death be equally divided amongst my seven children before named, in the same manner as before devised as to the whole of my estate ~ My will and desire is that my land known by the name of Sagores place containing _______ acres on which John M. Green now lives, being a separate situation from my other landed estate be sold by my executors as soon after my death as they can do so as what they may consider a fair price ~ Lastly I nominate and appoint my two sons Merewether and Robert Goodman executors to this my last will and testament. This Last will and testament of Noton Goodman deceased was presented in court & proven by the oaths of William Jenkins, Thomas B. Goodman, and Hugh Ford the three subscribing witnesses thereto, and thereupon the same was ordered to be recorded ~ And in a court held for the said County on the 26th day of October 1829. On the motion of Merewether Goodman, and Robert J.
