D-30. page 393/394/395 Indenture Between Thomas Allen and Thomas Dix 1770 This Indenture made on Monday, the 19th day of November in the year of our Lord one thousand seven hundred and seventy. Between Thomas Allen of the County of Essex in the Colony of Virginia, planter of the one part and Thomas Dix of the same county and colony planter of the other part. Witnesseth that the said Thomas Allen for and in consideration of this sum of sixty six pounds current money to him in hand paid by the said Thomas Dix at or before the sealing and delivery of those presents the receipt whereof he doth hereby acknowledge here that the said Thomas Allen hath granted bargained and sold.aliened and confirmed and by those presents doth grant bargain and sell alien and confirm unto said Thomas Dix his heirs and assigns for ever all that tract of land and plantation which John Allen, Grandfather of the said Thomas purchased of James Gatewood and Penelope his wife by a deed of bargain and sale bearing date the 24th of February in the year of our Lord one thousand seven hundred and forty seven which is only proved and recorded in the secretary's office of this colony and upon oath of the same John Allen Intestate the same recorded to the above named Thomas Allen his heir at law containing by estimation one hundred and ninety two acres situated lying and being in South Farnham Parish in the county aforesaid and is bounded as followeth, viz', Beginning at two white oaks and a sassafras on the side of the Piscattaway Swamp and running North six and a half degrees East. 256 poles on line that divides this and the land purchased by the said Thomas Dix of James Merwell to two corner pines by an old Field there North seventy six and a half degrees West 266 poles to a black gum and maple in the edge of a large branch there South six and a half degrees West 248 poles to the upper side the mouth of the said branch and there down the Main Piscattaway swamp to the beginning together with all homes out houses, edifices buildings yards, gardens, orchards woods, under woods, two ways waters watercourses profits, commodities, hereditaments and appurtances whatsoever to the said land belonging to or appurtaining and also the reversion and reversions remainder and remainders rents issues and profits of all and singular the promises and also all the Estate right title interest claim and demand whatsoever of him the said Thomas Allen of him in to the same and all Deeds and endevours and writing concerning the promises or any part thereof to have and to hold the said message and demand all and singular the said promise above mentioned and every part and parcel thereof with the appurtances unto the said Thomas Dix his heirs and his assigns to the only proper use and behoof of the said Thomas Dix his heirs and assigns forever. And this said Thomas Allen for himself and his heirs and assigns doth covenant and grant to with the said Thomas Dix his heirs and assigns that he is the true and lawfull owner of all and singular the premises abovementioned of the appurtances thereof hath good right to sell and convey the same unto the said Thomas Dix his heirs and assigns to their proper use and behoof for ever according to the true intent meaning of those presents and further that the said Thomas Allen for himself and heirs the lands and premises and every part thereof with the appurtances against him and his heirs and against all and every other person and persons whatsoever to the said Thomas Dix his heirs and assigns shall warrent and for ever defend by those presents. Sealed and delivered Thomas Allen (seal) in the presence of} 1770 November 19th. Received of the within named Thomas Dix the within mentioned sum of sixty six pounds current money being the consideration expressed in the within Indenture I say received by Witness. Thomas Allen At a Court held for Essex County at Tappahannock on Monday the 19th. day of November 1770 Thomas Allen acknowledged this Indenture together with the receipt therein ordered to Thomas Dix to be his Acts and Deeds which are admitted to record.
