Howerton/Howerton Indenture, 1803 - Essex Co. VA "This Indenture made the 31st day of Dec 1803. Between John Howerton executor of William Howerton decd of the one part, and William Howerton of the county of Essex of the other part, Witnesseth that the said # John Howerton for and in consideration of the sum of six shillings to him paid by the said William Howerton the receipt whereof he doeth hearby acknowledge, hath granted, bargained & sold & delivered, and by these presents doth grant, bargain & sell & deliver with the said William Howerton the following Estate property or goods and chattels, that is to say One negro woman named Rose and one negro Girl named Polly being that part of the estate of William Howerton decd in the hands of the said John Howerton to which Jane Edmondson, the wife of Edmund Edmondson, a daughter of the said William Howerton, is entitled to subject to the payment of the debts of the said William Howerton which are still due and unpaid to have and to hold to the said William Howerton and his assignees the said estate, property & goods & chattels in trust to & for the following uses & purposes & to or for no other use, intent or purpose whatever, that is to say, in trust to & for the only proper use thereof of the said John Howerton this assigns until such time as all the debts due from the said William Howerton, decd, shall be fully & completely satisfied and paid and to apply the same or such part thereof as shall or may be necessary to the payment of the said debts and after the said debts are fully & completely satisfied and paid then in trust to and for the only proper use and behoof of the said Jane Edmondson, wife of Edmund Edmondson during the joint lives of the said Edmund Edmondson and Jane Edmondson his wife, so as that the same or any part thereof may not # be subject to any debt or demand which now is due from the said Edmund Edmondson or which may hereafter be contracted by him or in any manner subject to the direction or control of the said Edmund Edmondson, and in case the said Jane Edmondson wife of the said Edmund shall survive her said husband then in trust to & for the only proper use & behoof of the said Jane Edmondson, now the wife of the said Edmund & her assignees forever, but in case the said Edmund shall survive his wife, there & in that case only, to the only proper use of the said Edmund Edmondson this assigns forever.
