Essex Co., VA Will - James Allen, Jr. Court Records. Essex County Court. 9 August, 1826 In the name of God amen. I James Allen Jr. of this County of Essex and state of Virginia being weak of body but sound of mind do make and ordain this my last Will and Testament Imprimis, I desire that my just debts may be paid as soon as may be convienient, next I give to my wife Amelia S. Allen the whole of such money as may be due to me after the payment of my debts aforesaid to dispose of as she may think proper. Also the following negroes Viz, Rose, Isabella and Taylor to her and her heirs forever, I also give to my wife my horse and Gig, and all the other property not hereafter mentioned. I lend to her during her life. Item I give to my sister Susanna Latane one negro boy named Nelson, a negro woman named Jinny and her child Ellen and after the death of my wife, all my residuary property loaned to her I give to my sister and her heirs forever. Lastly I hearby constitute appoint my friend Henry Waring Latane Executor of this my last Will and Testament. Ayers At Court of Quarterly Session continued and held for Essex George Hoskins County at the Courthouse in Tappahannock on the 22 day of James Wright August, 1826 This last Will and Testament of James Allen Jr dec'd was proved by the oaths of George Hoskins and James Wright two of the subscribing witness thereto and ordered to be recorded ----- Henry W. Latane the nominal Executor in open Court renounced his right of executorship ---- Whereupon on the motion of the said Henry W. Latane a certificate was granted him in order to his obtaining letter of administration with the Will annexed of all the goods and chattels and credits of James Allen Jr. dec'd he having first taken the oath required by law and entered into bond penalty, and with security approved by the Court and conditioned as required by law, which bond was ordered to be recorded. signed. William B. Mathews, Clerk Know all men by there presents, that Henry Waring Latane and Austin Brekenbrough are held and firmly bond unto Wm. Garnet, Kemp Gatewood, James Semple, and Walter Bowie Gentlemen Justices of the Court of Essex, now sifting, in the just and full sum of Seventeen thousand dollars to the payment whereof well and truly to be made to the said Justices and their successers we bind ourselves and each of us, and each of our heirs, executors and administrators jointly and severally firmly by there presents. Sealed with our seals and dated this 22nd day of August and in this 615t year of our formation ----- The Condition of this obligation is such that if the said Henry Waring Latane admins, with the Will annexcuted or James Allen Jr. deceased do make a true and perfect entry of all and singular the goods and chattels and credits of the said deceased which have or shall come to the hands possession or knowledge of him or the said Henry W. Latane, or into the hands or possession of any other person or persons for him the said Henry W. Latane and the same so made do exhibit unto said County Court at such time as he shall be thereto required by the said Court and the same goods chattels and credits do well and truly administer according to law and make a just and true account of all his actings and doings therein when there unto required by the said Court. And further do well and truly pay and deliver all the legacies contained and specified in the said Will as far as the said goods, chattels and credits will extend according to the value thereof and as the law shall charge him then this obligation to be void or else remain in full force. [James Allen's widow Ameila marries Erastus T. Montague ------- Dec 10, 1827. Essex County.] Know all men by their presents that we Erastus T. Montague. Lewis Montague and A Enas Montague are hereto and firmly bound unto Henry Waring Latane admistr of James Allen dec'd his heirs Exectr or admistr in the just and full sum of five thousand dollars, to the payment of which we bind ourselves, our heirs Exectrs and Admistr firmly by their presents. The condition of the above obligation is such that whereas the said H.W. Latane having this day settled an account of his administration of the Estate of said James Allen dec'd is willing to deliver over said Estates to said Erastus T. Montague provided he is indemified in doing so. Now if the above bound Erastus T. Montague, Lewis B. Montague and A. Enas Montague shall at all times hereafter refund to said Latane all debts or demands which may herafter appear against him as admstr as aforesaid and the cash attending the recovery of such debts, then the above obligation to be void or else to remain in full force and virtue.
