Essex Co., VA Will of John Moody, 1735 10th Dec. 1 735 Essex Court Records 158. In the name of God Amen I John Moody considering the uncertainty of this life and being of sound and perfect memory at this present, praises be to almighty God do by those present make ordain appoint and constitute this to be my last will and testament revoking and disanuiling all other my wills and testaments whatsoever in manner and form as followeth first I do bequeath my soul unto the almighty God who gave it me and when he shall think fit of his good will and pleasure to take me home do hope to receive profession of my sins through your merrits of my blessed Lord and Saviour Jesus Christ also do bequeath my body to the earth to be decently buried as my Excutors hereafter mentioned shall think most and convienant. Item. I give and bequeath to my son George Moody my plantation as I now live on as fur as the line as I made between Gilpan Moody and him for ever. Item. I give and bequeath to my well beloved wife Mary Moody all the rest of my Estate during her life. Item. I give and bequeath to my son George Moody, William Hollongar a molatter, and negro Tom. Only giving William Hollongar three years of his time to him and his heirs of his own body. Item. I give and bequeath to my son Joseph Moody one feather bed and four head of cattle to him and his heirs lawfully begotten of his body. Item. I give and bequeath to my Grandaughter Mathen Corken two cows and calves to her and her heirs lawfully begotten of her body. Item. I give and bequeath to my son George Moody all the remaining part of my stock after those legacies paid to him and his heirs lawfully begotten of his body. Item. I give and bequeath to my daughter Elizabeth Graves one gold ring of ten shilling price. Item. I give and bequeath Mary Isaget one gold ring of ten shilling price. Item. I give and bequeath to my son Edward Moody one shilling to him and his heirs for ever. Item. I constitute make and ordain my son George Moody Executor of this my last will and testament, and do hereby utterly disallow revoke and disannul all and every other former testaments wills etc. In witness whereof I have hereunto set my hand and seal this tenth day of December 1735. his Signed and Delivered John Moody in the presents of mark Jeremiah Uphshaw John Allen At a Court held for Essex County at Tappahannock on the 20th day of March Anno Domini MDCCXXXVIII This last will and testament of John Moody dated was presented by George Moody the Executor therein named who made oath thereto and being also proved by the oaths of Jeremiah Upshaw and John Allen the witnesses thereto was admitted to record Test. W. Beverley. clerk [20 th. March, 1738] Know all men by these present that George Moody, William Rennolds and Jeremiah Upshaw are hereto and firmly bound unto Thomas Waring, Robert Brooks, James Garnet and Joshia Fry. Gentlemen Justices of ye County in ye sum of one hundred pounds stock to which payment will and truly to be made we bind our selves our heirs Executors, Adminstrators and exory of them joyntly and severally to the said justices their heirs and successors firmly by those present witness our hands and souls this 20th day of March in the year of our Lord one thousand seven hundred and thirty eight. The condition of the above written obligation is such that if the above bound George Moody Executor of the last will and testament of John Moody deceased do make or cause to be made a true and perfect juxentory of all and singular the goods Chattels and credits of the said deceased which have or shall come to the hands possesion or knowledge of the said George Moody or into the hands or possesion of any other person or persons for him and the same so made to exhibit or cause to be exhibited into the County Court of Essex at such time as shall be thereto required by this said Court and the same goods chattels and credits and all other. The goods chattels and credits of the said deceased at the time of his death which at any time after shall come to the hands and possesions of the said George Moody or into hands or possesion of any other person or persons for him so well and truly adminster according to law and further do make and just and true accounting of actings and doings therein when thereto required by the said court and also do well and truly pay and deliver all the legacies contained and specified in the said testaments as for the said goods chattels and credits will thereunto extend according to the value thereof and the law shall charge him . Then this obligation to be void and of none effort otherwise to be and remain in full force power and vertue. George Moody W. In the name of God Amen: I William Allen Junr. of the County of Essex and Parish of South Farnham being sick and weak of body but of sound and perfect mind and memory praise be rendered and given to Almighty God but calling to mind the frailty and uncertainty of this mortal life that all mankind must yield to death when it shall please God to call I do make and ordain this my present Last Will and Testament in manner and form following. That is to say first and Principally I commend my soul into the hands of Almighty God hoping through the merits Death and passion and intercession of my Lord and Saviour Jesus Christ to have full and free pardon and remission of all my sins and wickedness in general and to inherit Ever Lasting Life and Salvation through the same my Saviour Jesus Christ and my body I commit to the Earth to be decently and christianly buried at the discretion of my Executor hereafter named; my soul this first and chiefly I have commended into the hands of God who gave it and my body I have committed to dust in hopes at the Great Day of the General Resurrection it shall rise again to the Life Immortal through Jesus Christ my Lord and also as foretaking the disposition of all such temporal goods and Estate that it pleases almighty God to bestow upon me I give and dispose thereof as followeth; viz; First I will that my debts and funeral charges shall be paid and discharged. Item; I give to my beloved sister MARY ALLEN a gold ring. Item; I lend to my Rever'd and beloved Father and our Mother the land that I bought of William Hutson during their natural life and after their decease I give the said land unto my younger and beloved brother Zachariah Allen to him and his heirs forever and if he should die without heirs the said land to return unto my next younger and beloved brother Andrew Allen to him and his heirs forever and if he should die without heirs then the land is to return unto the next surviving heir at law of my nearest relations and all the rest and residue of my personal Estate, goods and chattles what soever I do give and bequeath unto my Rever'd and beloved father and mother to them and their heirs forever. And I do make my Rever'd and beloved Father my Executor fully and solely of this my present last Will and Testament and my will and desire that my Estate may not be brought to appraisal and I do hereby revoke and disclaim and make void all former wills and Testaments by me heretofore made.
