In as much as possible, the = spelling, punctuation and capitalization was kept the same as that used = by the court clerk who copied the will into the record. April 1st 1844 I Sally Spindle of Essex County, do hereby make and declare, this to be = my last will and testament, hereby revoking all other wills here before = made by me. 1st I give to my daughter Mary B. Wright the sum of two hundred dollars = to be paid twelve months after my death, but to bear interest, from the = time of my death. 2nd I give to my daughter Sally J. Bird the sum of two hundred dollars = to be paid twelve months after my death, but to bear interest, from the = time of my death. 3rd I lend to my daughter Fanny N. Tod for and during the term of her = natural life a negro girl called Margaret together with her increase = from the date hereof, and at her death, I give the said girl Margaret = and her increase to my grand daughter should she survive her mother, but = if not, then to such of the children of the said Ella as may be living = at the time of her death, but should she died without leaving children, = then and in that case I give the said girl Margaret and her increase to = be equally divided among such of her brothers and sisters as may then = believing, and the descendants of such as may be dead who are to take = such part or portion only as his, her or their parent or ancestor, would = have taken, had he or she been alive. I also give to my said daughter = Fanny N. Tod one hundred dollars to be paid twelve months after my = death, but to bear interest, from the time of my death. 4 I give to my son Paul Spindle five hundred dollars, and to my six = grand children viz. Silas W., John E., Archibald R., and Rebecca S. = Spindle, children of my dec'd son Silas B. Spindle and Philip S. and = Marcella Spindle, children of y son Leonard S. Spindle, each the sum of = one hundred dollars to be paid twelve months after my death, but to bear = interest, from the time of my death, and I give to my son Mordecai L. = Spindle, the like sum of one hundred and fifty dollars to be paid = immediately after my death. 5 I give to my son Paul Spindle in addition to the previous legacy = herein before bequeathed to him, two colts called Button and Diamond, = two mules and a waggon and harness; and to my grand daughter Rebecca S. = Spindle, a bed and furniture.=20 6 The legacies herein bequeathed to my six grand children before named, = I wish to remain in the possession of my son and Executor Mordecai L. = Spindle, whom I do hereby constitute and appoint Trustee to manage the = same, for their use and benefit until they respectively attain to lawful = age, when I desire that they may receive their respective portions. 7 The rest and residue of my Estate of whatever it may consist I give to = be equally divided between my two sons Paul and James Spindle after the = payments of any just debt that I may own at the time of my death. Lastly, I constitute and appoint my son Mordecai L. Spindle the whole = and sole Executor to this my last will and testament and desire that he = may be permitted to qualify as such without being required to give = security. This Last Will and Testament of Sally Spindle dec'd being brought into = Court and offered for proof, was proved by the oath of John G. Bentley, = one of the subscribing Witnesses to the same, ordered to be certified = and continued for further proof. And thereupon the action of Mordecai = L. Spindle, the only nominal Executor in the said Will, a certificate = was granted him in order to his obtaining probate thereof in the form of = law, he having first taken the oath in such case required by law, and = entered into a bond payable, to the Commonwealth of Virginia in the = penalty of Seven thousand dollars, without security (the testatrix = having directed by her Will that none should be demanded,) which said = bond being conditioned as the law directs, was acknowledged by the = obliger, and ordered to be recorded.
