Essex Co., VA - Miscellaneous Wills Essex County, Virginia Will Book 24, pages 508-510. Court Record of Caty B. Allen last will dated 11 Oct, 1823 In the name of God amen. I Caty B. Allen being in good health and of sound and disposing mind do make an ordain this my last will and testament in manner and form following. Viz; after all my just debts being first paid I lend to Thomas Allen Banks, one Negro boy named John for and during his natural life but if he dies without leaving a lawful child or children its then my will and desire, that the said boy John should be sold, and the money arriving from the sale should be equally divided between the surviving children of William Banks, which he had by my sister Lucy. Item I lend to Elizabeth Allen Banks, one negro girl named Easter, and her future increase, for and during her natural life, but if she dies without Leaving a lawful child or children then it is my will and desire, that the said girl Easter, and her increase should be equally divided between the surviving children of William Banks which he had by my sister Lucy. Item; I lend to James Wiliam Banks one negro boy named Lewis for and during his natural life, but if he dies without leaving a lawful child or children then it is my will and desire that the said boy Lewis should be sold and the money arriving from the sale to be equally dividedbetween the children of William Banks which he had by my sister Lucy. Item; I lend to Lucy Catherine Banks, all the remainder arts of my estate of every kind, that I now have in my possession and the increase therein, and all my interests in and to my father Thomas Allens Estate, which is now in possession of my mother Elizabeth B. Allen and there increase for and during her natural life, but if she dies without leaving a lawful child or children, then its my will and desire that all that part of my estate, with the increase be equally divided between the surviving children of the said William Banks, which he had by my sister Lucy. Morgan Caty B. Allen John Coalman At a Court of Quarterly session continued and held for Essex County at the Courthouse in Tappahannock on the 21st day of August 1839. This writing purporting to be the last will and testament of Caty B. Allen dec'd, who died without children is brought into court and offered as proof by Thomas A.Banks, Elizabeth Banks, James William Banks and Lucy Banks who appear by George W. Pinkins their attorney, and proof and recordation of this said writing being contested by James Allen, Elizabeth B. Allen, James Owen and Mary his wife, who appear by William A. Wright and George Wright their attorneys, the said Banks being neices and nephews of the said testatrix, and the said James Allen and Mary Owen being a brother and sister of the tesatrix, and the said Elizabeth B. being the mother of the said testatrix, and by agreement of the parties the proof of the said writing is continued until the next court, and thereupon Washington A. Pinkins is appointed a curator to take care of and preserve the goods and chattles and effects of the testatrix during the pondering of the said contest, and the said Pinkins qualifies as such by entering into a bond payable to the sitting justices in the formality of eight thousand dollars with William A. Wright and James Roy Micou Jr his securities approved of as such by the court and by taking the oath in such case required by law, which being conditioned as the law directs is acknowledged by the obligns and ordered to be recorded. Teste. James Roy Micou Jr, Clk. At an Intervening Court begun and held for Essex County at the Courthouse in Tappahannock for the 21st day of Oct 1839. This writing purporting to be the last Will and Testament of Caty B. Allen dec'd, the proof and recordation of which writing is contested is again being brought into Court and it being suggested that Mary Owen the wife of James Owen one of the parties contesting the same is dead, thereupon the proof of the said writing is continued till the next court and in the motion of Thomas A. Banks, Elizabeth Banks, James William Banks and Lucy Banks. It is ordered that Richard Losson and John M. Gayle be summoned to appear here on the first day of the next court, to show cause if any thing they can why they should not be fined for their contempt in failing to attend here on this day as witness's in their behalf touching the controversey about the said will, the said Losson and Gayle having been duly summoned so to appear. This writing purported to be the last will and testament of Caty B. Allen dec'd, the said proof and recordation of which said writing is being contested being again brought into court by consent of said parties the contest of the said will is continued till the next court. This writing purporting to be the last will and testament of Caty B. Allen dec'd, the proof and recordation of which said writing is contested, being again brought into court, by consent of said parties the contest of the said will is continued till the next court. This writing purporting to be the last will and testament of Caty B. Allen dec'd. The proof and recordation of which said writing is contested being again brought into court. On the motion of the parties contesting the proof of the said writing it is suggested that Elizabeth B. Allen one of the parties opposing the proof of the said writing is dead. Teste. Allen dec'd the proof and recordation of which said writing is contested being again brought into court. On the motion of the parties offering the said writing it is ordered that this contest be revived against Thomas Pitts late Sheriff of this county and and committee of the estate of Mary Owen dec'd and against James Owen admistr. of Elizabeth B. Allen dec'd, the S ---------against them being returned executed. And on the futher motion of the said parties, leave now given them to take the disposition of Richard B. K. Lawson and John M. Hammond two of the witnesss before any Justice of the peace to be read upon the trial of the said contested will, and by agreement of all the parties the said contest was continued till the next court. Will Book 5, pages 128-130. 17 April 1733. In the name of God Amen, I LOUIS LATANE, of the Parish of South Farnham in the County of Essex, Virginia. Clerk do make this my last will and testament hereby revoking all other wills and testaments heretofore by me made, my will is that whatsoever I am justly indebted to any person be duly paid by my ex'ors hereafter named. Item. Whereas Mrs. Phebe Slater in her last will and testament disposed of things to my daughters, CHARLOTTE, PHEBE, AND SUSANNA that was not in her power to give, my will is that none of my said three daughters shall have any of the said legacies given them by Mrs. Phebe Slater.paid them but if they my said daughters or either of them shall be so refectory as to insist to have any of the said legacies paid them, then I give to each of my said daughters twelve pence in full of all the legacies hereafter in this my will to them given and bequeathed. Item. My will and pleasure is that my Ex'ors and trustee hereafter named shall lay out one hundred pounds sterling in land to be equally divided between my daughters CHARLOTTE, PHEBE, SUSANNA AND HENRIETTA which said land so divided I give to my said daughters and their heirs of their bodies lawfully begotten forever. Item. I give and bequeath to my said daughters, CHARLOTTE, PHEBE,SUSANNA and HENRIETTA. the following slaves. Viz. Sarah, Hannah and Winny, which three slaves are now in the possession of Abraham Montague; also Dick, Caesar, mulatto Billy, mulatto Tony, mulatto Amos, Moll, Doll,Bess, Amor, Sue, Beck, Diana and Nelly, to be equally divided between my said daughters. Which said slaves being so divided I give and bequeath to my said daughters CHARLOTTE, PHEBE, SUSANNA and HENRIETTA and their heirs of their bodies lawfully begotton of their bodies forever to descend and go with and in the same manner as the land before in this my will given and bequeathed to them. Item. My will is that my dearly beloved wife shall give to my daughters CHARLOTTE, PHEBE, SUSANNA AND HENRIETTA each of them a feather bed as she shall think fit. Item. I give to my daughter SUSANNA besides her equal share of negroes already mentioned, one negro girl named Lucy, of eight years old to her and her heirs forever. Item. I give and bequeath to my daughter MARIANN a negro woman called Varina. Item. I give to my said daughter MARIANN one hundred pounds sterling when she shall come to the age of Twenty one years and not before and in the meantime to be maintained out of her brothers estate. Item. I lend unto my dearly beloved wife all the rest of my estate both real and personal till she remarries again or dies which shall first happen and if she marry again it is my will and pleasure that she shall be turned out of possession of all the said estate. and this to be in full consideration of her dower, thirds or childs part of my said estate both real and personal I give and bequeath / when my said dear wife shall marry again or depart this life / to my son JOHN and the heirs of his body lawfully begotten forever and for want of such heirs then all of the said estate to be equally divided between his surviving sisters, the lands joyning to buttons range excepted. Item. It is my will and pleasure that my estate may not be appraised but only inventored. Item. I give all the cattle which are belonging to me at the Glebe, and my Quarter at the River side except three heifers big with calf of the glebe breed, and one steer to my daughters, CHARLOTTE, PHEBE, SUSANNA, HENRIETTA and their heirs for ever to be equally divided between them. Item. I do hereby nominate, constitute and appoint my dearly beloved wife MARY and our son JOHN, executors of this my last will and testament and my friend Col. William Beverley my trustee to see my will performed.
