FAIRFAX COUNTY, VA - WILLS - Benjamine Berkley, 23 May 1817 ----¤¤¤---- Will Book L Pages 278-279 To all to whom these presents may come or in anywise concern: Know ye that I Benjamine Berkley of the County of Fairfax and Commonwealth of Virginia, being in good health and enjoying the full exercise of my intellectual facilities do make and ordain this my last will and testament in the following form and manner, that is to say in the first place. It is my will and desire that all my just debts be first paid by my executors herein after mentioned. Secondly. The law having made provisions for my wife, it is my will that she be governed accordingly. Thirdly. I give and bequeath to my Daughter Elizabeth Marshall one Dollar. Fourthly. I give and bequeath unto my son George N. Berkley one Dollar Fifthly. I give and bequeath unto my son Thomas Berkley one Dollar. Sixthly. I give and bequeath unto my daughter Anna Newman one Dollar. Seventhly. I give and bequeath unto my daughter Francis Berkley one Dollar. Eighthly. I give and bequeath unto my son John Berkley one Dollar. Ninthly. I give and bequeath unto my son William Berkley one Dollar. Tenthly. I give and bequeath unto my son James Berkley one Dollar. Lastly I give and bequeath unto my daughters Barbara Berkley, Amanda Berkley and Catherine Berkley when they severally arrive at age of twenty one years or get married to them and their heirs forever the Balance of my estate both real and personal to be equally divided among them. I appoint my much esteemed friends, John Millan and John Reid executors of this my last will and testament, hereby revoking all other or former wills by me heretofore made. In witness whereof I have hereunto set my hand and affixed my seal this 23rd day of May 1817. Peake At a Court held for Fairfax County the 15th day of June 1818. This last will and testament of Benjamin Berkley deceased was presented in Court by John Reid one of the executors therein named and the same being proved by the oath of George W. Lane one of the subscribing witnesses thereto and certified and at a Court held for the said County the 19th of October in the year aforesaid the same was further proved by the oath of John H. Peake another subscribing witness thereto and ordered to be recorded and John Reid one of the executors therein named having together with John Millan and John H. Halley his securities entered into and acknowledged a Bond conditioned as the law directs. A certificate is granted him for obtaining a probate in due form. Examined (O.S) Teste. Wm.
