FAIRFAX COUNTY, VA - WILL AND ESTATE - James Heriford, 1744 ----¤¤¤---- Jane Heryford, Jeremiah Bronaugh and Charles Tyler acknowledged this Bond in Fairfax County Court the 17th Day of May 1744 to be their Act and Deed whixh is admitted to Record In the Name of God Amen I James Heriford of Truro Parish in the County of Fairfax being sick and weak of Body but in perfect health of mind and memory Do make Constitute and appoint this my Last Will and Testament in manner and form following First and principally I Give my sole unto the hand of Allmighty God my body I give to the Earth to be Decently Buried at the Discretion of my Executors hereafter named and for what Worldly Goods it hath pleased God to bless me with my Will is that they be disposed of in the following manner IMPRIMIS I Give all my Land to be equally Divided between my Two Brothers George Heriford and Henery Heriford ITEM I give to my sister Margaret Coffer three hogs ITEM I Give to Francis Coffer the Plantation where I was live for four years insuing the date here of ITEM I Give my Deat loving Mother Jeane Heriford a young Read & white Heffer ITEM I Give to my Sister Jeane Heriford my Gold Ring ITEM it is my will and Desire that all the rest of my estate be sold to pay my Debts and I do appoint Francis Coffer and Joshua Ferguson my Executors of this my Last Will and Testament here Confirming this to be my only Last Will and Testament In witness whereof I have hereunto Set my hand and Seal Signed Sealed & Delivered in the James Heryford presants of us John Withers James Moore At a Court held for Fairfax County May 17th 1744 This Last Will & Testament of James Hereford Deceased was presented in Court by Jane Heryford and was proved by the Oath of John Withers a Witness thereto who declared he did see the other witness to the same and Joshua Ferguson having relingquished his Executorship On Motion of the said Jane and her performing what is usual in such Cases Certificate is Granted her for obtaining Letters of Administration of the said Deceased's Estate with his will annexed in due form Test. Tyler are held and firmly Bound unto John Colvill Gent. first Justice in Commission of the peace for Fairfax County for and on behalf and to the sole use and behoof of the Justice of the said County and their Successors in the sum of Three hundred Pounds Sterling To be paid to the said John Colvill [ ] his Ex. Adm. and Assigns to the which payment well and truely to be made we bind our selves and every of us our and every of our Heirs Exs. and Adms. Jointly and severally firmly by theses Presents Sealed with our seals dated this Xoy (sic) Day of May 1744 The Condition of this Obligation is such that if the above bound Jane Hereford Adm. Ex. with the Last Will and Testament annexed of James Hereford Deceased do make or Cause to be made a True and perfect Inventory of all singular the Goods Chattels & Credits of the said Deceased which have or shall come to the hands or possession of the said Jane or into the hands or possession of amy other person or persons for her [ ] the same so made do Exhibit or Cause to be exhibited into the County Court of Fairfax at such time as shall be thereto required by the said Court and the same Goods Chattels & Credits and all other the Goods Chattels and Credits of the said Deceased at the time of his Death or which at any time after shall come to the hands or possession of the said Jane or into the hand or possession of any other Person or persons for her Do well & truely Administor according to Law And further do make a Just & true Account of their Activities & Doings Therein when their unto required by the said Court And also Do well and truely pay and Deliver all the Legacies contained and Specified in the said Testament as far as the said Goods Chattels and Credits will thereunto Extend and the Law shall Charge her then this Obligation to be void and none Effect or else to remain in full force and virtue Sealed & Delivered in presence of Jane Hereford Jera.
