FAIRFAX COUNTY, VA - WILL AND ESTATE - John Herriford, 1744 ----¤¤¤---- John Herriford Estate - 1744 - Fairfax Co., VA In the name of God Amen I John Herriford of the parish of Truro & County of Fairfax being at this time tho infirm and weak of body yet of Sound mind blessed be God therefore do commit my body to the earth to be disposed of according to the discretion of my friends & my Soul to God in full & perfect hopes of a blessed resurrection thro Jesus Christ hoping pardon of my offences I make the following Disposition of my worldly effects ffist I do give and bequeath unto my eldest son James two hundred and fifty acres of Land where he now lives to him & his heirs forever secondly I give and bequeath unto my Son John the remaining part of my Land being the plantation I now live on upon the mouth of the Crooked Potomack river the quantity being about two hundred & twenty acres to him & to his heirs for Ever. As for my oldest daughter Ann having upon her marriage given her what I think an equal Share with the rest of my Children & what I alway intended to prevent any further Claim on my estate I do will and bequeath her one Shilling I do give and bequeath unto my beloved wife Jame my two negro women for and During the term of her natural life also the plantation I now live on for & during the Term of her natural life I do give and bequeath unto my Sone George after the Death of his mother my negro woman & her increase the womans name is Bess I do give and bequeath unto my Son Henry after the Death of his mother my negro woman & her increase the womans name is Phillis I do give and bequeath unto my Daughter Margaret two Cows & Calves a good feather bed a rug pair of blankets a pair of sheets also a Steer 3 years old & a heifer 3 years old at this time & four hundred and fifty pounds of Tobacco to buy her an horse I do give and bequeath unto my Daughter Janet a negro Child Called Toby Son of my negro woamn Phillis also a good feather bed a rug pair of Blankets & a pair of Sheets also a Cow & Calfe. I do give and bequeath unto my Daughter Frances one Cow & Calf a feather bed a pair of Blankets a pair of Sheets a rug also an horse when she Comes to be able to make use of one I give and bequeath the remaining part of my Estate to be equally divided between my beloved wife Jane & my Sons George & Henry & my Daughters Margaret Jannet & Frances & this I do publish to be my Last will & Testament revoking and disanulling all former wills & Testaments Witness my hand this 30th day of June 1743 I do request Mr. Wm. Green At a Court held for Fairfax County April 19 1744 this last will & Testament of John Heryford Deced was presented in court by Jane Heryford the Exr. therein named who made oath according to Law of the Land was proved by the oaths of Jeremiah Bronaugh & Charles Green witnesses & admitted for record & William Peck the executor therein named having relinguished his Executorship On motion of the said Ex. [ ] performing what is usual in Such Cases Certificate is granted here for obtaining a probate in due form. Test. Jointly and Severally firmly by these presents Sealed with our Seals dated this nineteeth day of April 1744 The Condtiton of this obligation is such that if the above named Jane Heryford Executrix of the last will & Testament of John Heryford deced. do make or cause to be made a true and perfect inventory of all and Singular the good and Chattels and Credits of the said Deced. which have or shall Come to the hand or possession or knowledge of the said Jane or into the hand or possession of any other person or persons for [ ] and the same so made do Exhibit or Cause to be exhibited into the County Court of Fairfax at Such time as Shall be hereto required by the said Court the said goods Chattels Credits & all other the goods Chattels & Credits of the said Deced. at the time of his Death or which at any time after shall Come to the hands or possession of the said Jane or into the hands or possession of any other person or persons for her do well and truly adm. according to Law & further do make a Just and true account of her acting and doings therein when thereunto required by the said Court & also De well and truly pay and Deliver all the Legacies Contained & Specified in the said Testaments as far as the said Goods Chattels and Credits will thereunto Extend & the Law shall Charge her then this obligation to be void & of [ ] Effect or else to Remain in full force & vertue.
