FAIRFAX COUNTY, VA - WILL AND ESTATE - John Heryford, 27 Feb 1783 ----¤¤¤---- I John Heryford of the County of Fairfax and Commonwealth of Virginia being of sound mind and memory and in good health but mindful of the uncertainty of human life do make and declare this my last will and testament. I resign my soul into the hands of my Allmighty Creator in whose mercy I confide for a remission of my sins. My body I desire may be decently burried (sic) at the discretion of my executors hereinafter named and all my estate I dispose of in manner and form following. Imprimis: I give and devise my lot of land and houses in the town of Leesburg in the county of Loudon where I formerly lived fronting the courthouse and adjoining to the lot which I purchased from the executors of George Johnston deceased unto my three youngest son, Thomas Heryford, Francis Heryford and Robert Heryford and their heirs forever. I give my said lot and houses unto my three sons and their heirs in joint tenancy and not as tenents in common to the end that in case of the death of any and other of them before they shall have made any division or disposition of the same the survivor or survivors may take the part of the son or sons so dieing. Item. I give and bequeath one Negro woman slave named Chloe together with her future increase from this time forward unto my son John Heryford and his heirs forever. Item. I give and bequeath one Negro woman slave named Winny unto my son William Heryford and his heirs forever. Item. My eldest son James Heryford being heir to all his mother's lands it is not my intention to give him any part of my estate except one feather bed and furniture which I herby bequeath to him. Item. Having given unto my daughter Ann the wife of William Ansley upon her marriage one negro woman slave named Judy it is not my intention to give her any other part of my estate. Item. I give and bequeath unto my dear wife Peggy Hereford for and during her widowhood the use of all the rest and remainder of my estate of what nature soever and upon her marriage or death it is my will and desire and I hereby direct and order that the same shall be equally divided share and share alike among and between my three youngest sons Thomas Heryford, Francis Heryford, and Robert Heryford and my three youngest daughters Peggy Heryford, Elizabeth Hereford, Kitty Heryford or in case of the death of any of them during their mother's widowhood among and between such of them as shall be living at the time of her marriage or death unless any of my said six children so dieing shall have left a child or children which case it is my will and desire and I hereby direct and order that such child or children shall take the share or part which the parent would have been entitled to if living. Lastly revoking all other will heretofore by me made I constitute and appoint my dear wife Peggy Heryford executrix and my sons John Heryford and William Heryford executors of this my last will and testament. In witness thereof I have hereunto set my hand and affixed my seal this twenty-seventh day of February in the year of our Lord one thousand seven hundred and eighty three.
