Sweeney/Lancaster Indenture, 1839 This Indenture made and entered into this10th day if Dec in the year of our Lord one thousand eight hundred and thirty nine between Joel Sweeney and Nancy his wife of Franklin County and state of Virginia of the one part, and Lewis Lancaster of the County of Floyd and the State afforesaid of the other part. Witnesseth that the said Joel Sweeney and Nancy his wife in consideration of thirty five dollars of lawful money of this Commonwealth to them in hand paid by the said Lewis Lancaster at or before the insealing and delivery of these presents the receipt whereof is hereby acknowledged bargained and sold and by these presents do and each of these doth bargain and sell unto the Lewis Lancaster his heirs and assigns a certain tract of land containing 75 acres more or less lying and being in Franklin County of the head water of Willis Creek and bounded by the land of Jacob Leyman Jonathan Swinany and Dawson Haynes. To have and to hold the said Tract of Land with the tenements here itaments and all and singular other the premises herein mentioned or intended to be bargained and sold and every part and parcel thereof with every of their members and appurtenances unto the said Lewis Lancaster his heirs and assigns forever and the said Joel Swinny and Nancy his wife for themselves and their heirs for the said tract of land with all and singular the premises and appurtenances before mentioned unto the said Lewis Lancaster his heirs and assigns free from the claims or claims of these the said Joel Sweeney and Nancy his wife or either of them or either of their heirs and of all and every person or persons whomsoever shall will and do warrant and forever defend by these presents. In witness sohereof the said Joel Sweeney and Nancy his wife have hereunto set their hand and seals the day and year above written.
