LAST WILL & TESTAMENT OF ARCHEALAUS HYLTON SR.

I Archalaus Hylton of the County of Floyd and the state of Virginia being weak 
in body but of sound mind and disposing memory and calling to mind the 
uncertainty of human life and being desirous to make such disposition of the 
worldly estate with which is has pleased God to bless me as will do justice to 
all my children, do hereby make and ordain this as my last will and testament, 
hereby revoking all former wills by me made.
        First, I desire that as soon as convenient after my death, that my 
Executors, hereafter named, proceed to collect such debts as may be due me and 
pay my just debts funeral expenses and should the cash I leave in hand and 
debts due me not be sufficient to pay said debts and expenses, I wish enough 
of my property be sold to raise the sum necessary to do so.
        Secondly.  After the payments of just debts and expenses I give to my 
son Elijah W. Hylton my Hancock Tract of land containing one hundred and 
ninety four acres more or less to be valued at five hundred dollars.
        Thirdly.  I give to my son Elijah W. Hylton my home tract of land 
consisting of several tracts number of acres not known which he is to have at 
I and my wife's death provided he takes care of I and my wife during our lives 
in a decent and respectful manner.
        Fourthly.  I give to my son John B. Hylton my tract of land adjoining 
the land I deeded him known as the Sam Hylton land containing one hundred and 
fifteen acres more or less To be valued at two hundred and fifty dollars.
        Fifthly.  I wish the tract of land that I have deed to my daughter 
Charlotte Harris to be valued to her at four hundred and twenty dollars.
        Sixthly.  I wish the tract of land that I deed to my daughter Martha 
Harman dec'd valued to her heirs at three hundred and fifty dollars.    
        Seventhly.  I wish the tract of land that I have deed to my daughter 
Ann Harmon, Celia Harmon and Eliza Cannaday valued at five hundred dollars to 
each one of them.
        Eighthly.  I wish the tracts of land that I have deed to my sons Henry 
Hylton and George Hylton, John B. Hylton valued at five hundred dollars to 
each one of them.
        Ninthly.  I wish all my sons and daughters made equal after my death 
namely Charlotte Harris, Susan Dickerson, Martha Harmon Dec/d, Henry Hylton, 
George Hylton, Anna Harmon, Celia Harmon, John B. Hylton, Eliza Cannaday, 
Elijah W. Hylton after giving my son Elijah W. Hylton my home tract of land as 
already named in my will.
        Tenthly.  I give to the body heirs of my daughter Martha Harmon dec'd 
his equal portion of my estate real and personal.
        Eleventhly.  I wish my executors to have all Negroes valued and 
divided equally and proportionately among all my children if the want them and 
can agree upon the valuation of them.  If not I wish them sold privately and 
let them choose their masters and if that cannot be done I wish them sold at 
public auction and the proceeds thereof divided equally among all my children.
        Twelvethy.  I wish the remaining portion of my lands not named in my 
will to be valued and divided equally among all my sons and daughters if they 
want it.  If not, my executors to sell it privately if they can at a face 
price if not to sell it at public auction and the proceeds thereof divided 
among all my sons and daughters so as to make them equal with each other.
        Thirteenthly.  In a short time after my death as soon as convenient I 
wish all my personal property, horses, cattle, sheep, hogs, farming utensils, 
household and kitchen furniture to be sold and the proceeds thereof divided 
equally among all my sons and daughters.
        Lastly.  I appoint my beloved sons Henry Hylton, John B. Hylton and 
Elijah W. Hylton Executors of this my last will & testament.
        In witness whereof I hereto subscribe my name and affix my seal this 
the fourteenth day of November in the year of our Lord one thousand eight 
hundred and fifty nine.

At the December term of Floyd Co. Court 1865 this the last will & testament of 
Archelaus Hylton's death was proven by the oaths of Philip Rattiff, Joshua 
Weddle and Alexander Weddle subscribing witnesses thereto and ordered to be
