[Old System] I Pleasant Bybee of the County of Fluvanna and state of Virginia being old and infirm but of sound mind and disposing memory do make this my last will and testament in manner and form following (Viz: After all my just debts are paid I lend to my beloved wife Mildred one feather bed and furniture. One trunk, 1 cotton wheel one black heifer one mare and 1 horse cart, to use and enjoy during her natural life I give to my said wife Mildred all the growing crop upon the land whereon I now to live to do as she pleases with - I also give to my said wife fifty dollars in cash which is now in the hands of [Mr?] John Omohundro. After the death of my said wife I give to my daughter Elizabeth Bybee the mare cart which I loaned to my said wife to her and hers forever. All the balance of my Estate of what kind soever after the payments of my just debts as aforesaid it is my will & desire that it be sold and equally divided between my children John Bybee William Bybee Sarah Bybee Elizabeth Bybee and Sherwood Bybee and I give the same to them & theirs forever. And after the death of my said wife all the property which I loaned to my said wife except the mare and cart given to my daughter Elizabeth shall be sold and divided equally between my said children as above named and I give the same to them & theirs foreve. and finally I appoint John Omohundro Albert G Aligree as my Executors In testimony whereof I have hereunto set my hand and Seals this forth day of July in the year of our lord one thousand eight hundred and thirty five. his Pleasant Bybee {Seal} mark Witness Edwin O. Gooch At a court of Monthly sessions held for Fluvanna W. A. Smith County on Monday the 27th day of July 1835 This will was this day presented in Court and proved by the oaths of Edwin O. Gooch and William A. Smith the witnesses thereto and ordered to be recorded. And on the motion of John Omohundro, One of the Executors therein named who made oath thereto as the law directs and entered into and acknowledged bond in the penalty of five hundred dollars with Sherod Bybee his security conditioned as the Law direct, certificate is granted him for obtaining a probate thereof in due form and time is allowed the other Executor therein named to qualify thereto.
