Kitterman/Campbell Indenture, 1833 Deed Book 13, pages 435 and 436--Franklin County, Va. Indenture Between Peter and Elias Kitterman and William Campbell--January 4, 1833 Perry County, Indiana This Indenture made this 4th day of January 1833 between Elias Kitterman and Peter Kitterman of the County of Perry and the State of Indiana, heirs at law and divees of Henry Kitterman Dec. late of the county of Franklin and state of Virginia of the one part and William Campbell Senr. of the County of Franklin and State of Virginia of the other part witnesseth that whereas the said Henry Kitterman Dec. late of the county of Franklin and State of Virginia did posess of certian real estate to Wit one certain tract of land purchased from Thomas Crutcher as per deed recorded in the clerks office of the said county of Franklin containing 414 acres lying on the Gap branch of the Chestnut in the said county, one other tract adjoining the same purchase of a William Huston, as per deed of record in the Clerks office of the county aforesaid, containing 100 acres lying on Chestnut Creek and on other tract adjoining the first mentioned tract as per patent containing 154 acres, references being had to the paid Deeds and purchases, the courses and distrances will more fully appear and whereas, the said Henry Kitterman by his last will and testament which is also of Record in the Clerks office of the said Court of Franklin bequeathed unto Ann Kitterman during her life time the above mentioned lands and at her death to be divided among her children and the said Ann Kitterman having departed this life, leaving ten children, heirs and distributes of the said Henry Kitterman deceased to wit, Mary Kitterman, George Kitterman, John Kitterman, Ann Kitterman the younger who intermarried with a certain George Robertson, Susannah Fortune formerly Susanna Kitterman, "Christopher Kitterman, Zachariah Kitterman, Elias Kitterman, Michael Kitterman, Peter Kitterman and whereas the said Peter Kitterman some time since purchased of the said Michael Kitterman his interest and claim in the land aforesaid and whereas John Kitterman by his act and deed bearing date the 14th day of November 1832, hath constituted and appointed the said Peter Kitterman and Elias Kitterman his true and lawful attorney to act for him in and about the premises aforesaid and whereas George Robertson and Ann his wife formerly Ann Kitterman, Susannah Fortune formerly Susannah Kitterman, Christopher Kitterman and Elizabeth his wife and Zachariah Kitterman and Mary his wife by their act and Deed bearing date 15th day of October 1832 have constituted and appointed this said Elias Kitterman and Peter Kitterman their true and lawful attorney to act for them in and about the premises aforesaid. Now witnesseth that by virtue of the purchase aforesaid by the said Peter Kitterman from Michael Kitterman and the power of attorney from John Kitterman to Peter Kitterman and Elias Kitterman and the power of attorney from George Robertson Susanna Fortune to the said Elias Kitterman and Peter Kitterman in their rights being eight out of the ten children and distributes of the said Henry Kitterman, dec. They the said Elias Kitterman and Peter Kitterman for and in consideration of the sum of $525.00 current money of Virginia to them in hand paid by the said William Campbell Senr. at or before the ensealing and delivery of these present the receipt whereof is hereby acknowledged hath bargined sold allowed enfused and confirmed and do by these presents bargin, sell, allow, enfuse and confirm unto the said William Campbell his heirs and assignes forever the before mentioned eight tenths of the aforesaid three tracts or parcels of land the whole amounting to 600 acres be the same more or less. To have hold and enjoy the said eight tenths of the said land and premises, with its appurtinences thereto belonging either in land or in equity unto the said William Campbell Sr. heirs and assignes forever and the said Elias Kitterman and Peter Kitterman for themselves Indenture them the aforesaid eight tenths of the three tracts of land aforesaid unto him the said William Campbell Sr. his heirs and assignes so and will warrant and forever defend against the Claims of themselves and their heirs and against the Just Claim or demand of all and every other person or persons whatsoever. In Witness whereof the said Elias Kitterman and Peter Kitterman have hereunto set their hands and affixed their seals this day and year first above written. Signed, sealed and acknowledged in Presence Peter Kitterman (seal) Elias Kitterman (seal) Franklin County to Wit: We the Justice of the Peace in the county aforesaid and in the state of Virginia do hereby certify that Elias Kitterman and Peter Kitterman parties to a certain deed bearing date the 4th day of Janyary 1833 and hereto annexed personally appeared before us in our county aforesaid and acknowledgement to the Clerk of the County Court of Franklin in order that the said deed may be recorded.
