PARKER/KEYS INDENTURE, 1838 - Franklin Co. VA This Indenture made this 17th day of December in the year 1838 between William Parker and Sterling Parker of the County of Franklin and State of Virginia on the one part and James Keys, Trustee of the County of Franklin in State aforesaid of the other part. Whereforth that the said William Parker and Sterling Parker in order to secure the payment of debt due Samuel Saunders and Co. of the said County and State aforesaid due by bond, one bond due the 8th day of January 1838 for eighty nine dollars,eighty six cts. Also one bond due the 16th day of December 1838 for one hundred and forty dollars lawful money of Virginia and for the further consideration of the sum of one dollar to them in hand paid by said James Keys Trustee aforesaid, the receipt whereof they doth hereby acknowledge, hath bargained, sold, released and confirmed_?__by those present, grant, bargain, sell and confirm unto the said James Keys-Trustee, the following tracks of land and property to with, first being tracks of land lying and being in the County of Franklin on the waters of Nicholas Creek a branch of Smith River containing one hundred and fifty acres, being the same more or less being the track of land the said William Parker and Sterling Parker does reside on and the same deeded to the said Sterling Parker from Isaac Lemmons. Reference the said deed for the course, also one other track lying in the said County of Franklin on the waters of Pig River containing one hundred acres more or less and being the same track deeded to the said Sterling Parker from John Kasey,, which deed is recorded in the Clerks office in the County Court of Franklin. Reference being head to the same for the course and boundary. Also the following property (to with) One bay mare, one black mare, sixteen head hogs, eight head of sheep, one heifer, all marked with swallow forks in the right ear and also in the left ear. Two feather beds and furniture belonging to the same. Five bed stands, three pair geas ( geese),six stacks oats, one wood work of small wagon, eight chairs and all the crop of corn. To have and to hold the aforesaid tracks of land and property to the use and behold and benefit of him the said James Keys and his heirs forever against the claim of them, the said William Parker and Sterling Parker and each of them and their heirs and all and every other person or persons,whatever other in law and equity claiming in anyway in Trust never the ? ?. If the said William Parker and Sterling Parker shall pay the said sum due and the bonds of eighty nine dollars eight six cents, and one hundred forty dollars with the legal interest on the same and the costs attending this indenture to them the said Samuel Saunders and Co. their heirs or appendages on or before the first day June next, then the said the said James Keys doth oblige himself and his heirs to reconvey the said lands and property to the said William Parker and Sterling Parker and their heirs and appendages, but if the said William Parker and Sterling Parker shall fail to pay the said Samuel Saunders and Co. the said sums aforesaid mentioned then the said James Keys Trustee or his heirs shall forthwith proceed to sell on the said premises the said land and property to the highest bidder for the ready money, previously advertising the same time and place of sale of the aforesaid lands and property at Franklin Courthouse at least ten days before the sale thereof and amount of proceeds thereof--First pay and satisfy the said Samuel Saunders and Co. their debt aforesaid with the legal interest and costs aforesaid and the over lush (?) if any there is after paying the said debt before mentioned, pay to the said William Parker and the said Sterling Parker their heirs or legal representatives. This deed of trust from William Parker and Sterling Parker to James Keys for the purpose herein appendged, was passed in the said office by the oath of Thomas Newberry, Jefferson Kingory two of the subscribing witnesses hereto, and in the said office April 25 1839 this deed of Trust was further passed by oath of John Saunders, one other subscribing witness, hereto and admitted to record.
