First I give and bequeath unto my beloved wife Mary A. W. Perdue all my real and personal estate, consisting of household and Kitchen furniture, Two Horses, Stocks of hogs, (----?) and indeed every article of personal property which I possess all lands and tenaments which I own Viz. One tract One hundred and Nineteen and a half acres its the same more or less adjoining the lands of Marshall, Ayres, Matilda Metts and others, and also all interest and rights in all funds which I possess or may come in my possession, arising from my Fathers estate, lying in the Counties of Mercer and McDowell, West Virginia to have and to hold the same property as above mentioned as her own property during her natural life to act and do with said real and personal estate as heretofore mentioned as she chooses and desires either by sale or any other way she may desire, for the benefit of herself or family during her natural life. And after the death of my beloved wife, I desire the balance of my estate to be equally divided between my children --- Secondly I desire to be buried in a decent and honorable manner. I appoint my beloved wife Mary A. W. Perdue my executor without security. In testamony whereof I the said Eli Perdue, have to this my last Will and Testament signed and subscibed my name this 14th day of February in the year of our Lord One thousand eight hundred and Seventy One. Signed, acknowledged and Eli (his X mark) Perdue subscribed the the said Eli Perdue as unto for his last Will and testament in presence of both of us at the same time who at his request and in his presence subscribed our names as---- Witness hereto; James R. Hamner Wm H. Hamner I Eli Perdue the within named testator do hereby make and publish this Codicil to my last Will and Testament bearing date the 14th of February 1871 in manner following to wit; I desire and demand that should my beloved wife Mary A. W. Perdue marry after my death that the property mentioned in my Will here to written on this sheet of paper shall never come in possession of her future husband in any shape or form whatever but just she (my wife) may own and do with said property as she choses during her natural life for the benefit of herself and my children. I witness whereof I have hereby signified my consent to this Codicil by hereon subscribng my name this the 25th day of February in the year of our Lord One thousand eight hundred and Seventy One. Signed & acknowledged Eli (his X mark) Perdue & subscribed before us James R. Hamner John A. Ashworth At a Court held for Franklin County at the Courthouse on the 5 day of June 1871. A paper writing to be the last Will and Testmanet of Eli Perdue decd together with the Codicial herein annexed was produced in Court and proved to be the same by James R. Hamner and W. H. Hamner the subscring witnesses to the Will and be the same by John H. Ashworth and James R. Hamner subscribing witnesses to the Codicil and was ordered to be recorded. And at a Court held for Franklin County the 7th day of August 1871 - on a motion of Mary A. W. Perdue who made oath and executed bond in the penalty of $400.00 - condition as prescribed by law certificate is granted her to obtain letters of adminstrationer (bonisnon?) with the Will annexed on the estate of Eli Perdue decd in due form. Test James J. Cooper C. V. C. Additional Comments: Eli Perdue was born in Franklin Co., VA ca 1814 to Zachariah Perdue & Elizabeth Coon. He married 15 Feb 1848 in Franklin Co., VA to Mary Ann W. Mitchell born 14 June 1827 in Franklin Co., VA to Wm C. Mitchell & (??). Eli hung himself in his tobacco barn 5 June 1871. Mary Ann Perdue moved to Floyd Co., VA where she died 20 August 1888.
