I Daniel Ward of Franklin County and State of Virginia Being low in body but sound mind and perfect memory, thought proper to make this my last Will and Testament in the manner and form following that is first of all, I recommend my soul to God who gave it and my Body to the Earth from Whence it was Taken to be buried at the discretion of my Executors hereinafter named and as to touching my worldy estate first - I desire that all my just debts shall be paid out of my personal estate secondly my will and desire that all my lands shall be laid in twelve equal parts on lots agreeable to quantity and quality by my executors hereinafter named. First - laying off one lot for my daughter, Elizabeth Marcum and one other for Happy Perdue and one other to be laid off to Jesse Ward and one other lot laid off to Benjamin Ward and one other lot to be laid off to my son Daniel Ward, if the said Daniel should be living when the Division of the said lands is laid off and if he be dead my will and desire is that his four children that he had by his wife Ally namely Elender, Whittenton and Daniel and Ally the lot share be sold and the money it brings to be equally divided amongst them as they come to be of lawful age one other lot to be laid off to my daughter Prudence Perdue and one lot to be laid off to my daughter Sealy Dillion and it is my Will and desire that my son Jonathan shall have one lot laid off to live on and his wife Anny shall live on it and enjoy the same during their natural lives and at their deaths the lot of land shall be sit up and sold by my executors and the money arising therefore to be equally divided amongst the lawful begotten heirs of Jonathan and wife Anny and one other lot to be laid off to my son William and one other lot to be laid off to my son Asa and it is my will and desire that one lot shall be laid off and that my son Samuel and his wife Mary shall live on it and enjoy the same during their natural lives and at their deaths the lot is to be sit up and sold to the highest bidder and the money arising therefrom is to be equally divided amongst the lawfully begotten children by said Samuel and wife Mary also one lot to be laid off to my daughter Martha Lyon and at my death or as soon after as it is expedient it is my will and desire that all my personal estate shall be sit up and sold to the highest bidders by my executors on such credit as they may think proper and the money arising therefore to be equally divided and unto twelve parts after all expenses shall be taken out first my will is that my daughter, Elizabeth Marcum shall receive one twelfth part also my desire that my daughter Happy shall receive one twelfth part and it is my desire that my son Jesse Ward shall receive one twelfth part to go to the benefit and maintainance of his wife & children and it is also my desire that my son Benjamin shall receive one twelfth part it is my will and desire that my son Asa Ward shall receive two hundred dollars that is to come out of my son Daniels part for causes and reasons best known to myself and if any surpluses should be left out of one twelfth my will and desire is that my son Daniel shall receive that surpluses and if he should be dead when the division should take place my will and desire is the four chidren begotten by his wife Ally is to be equally divided amongst them and it is also my desire that my daughter, Prudence Perdue shall receive on twelfth part and it is also my desire that Sealy Dillion shall receive one twelfth part it is also my will and desire whereas I have loaned unto my son Jonathan one negro boy Willis for him the said Jonathan to Deliver up to my executors at my death or as soon after as they shall demand of him. If he should not give him up when called for and have him sold with the rest of the property he the said Jonathan shall receive him as one twelfth part and he the said Willis shall go to his wife and children and for their benefit alone and in case he should give him up and have him sold in that case he shall receive on twelfth part to go to the support of his wife and children and at his death he should see cause to keep the above named boy Willis he shall be sit up and sold to the highest bidder and the money arising therefrom to be equally divided amongst his lawful begotten children as they shall come to lawful age it is also my desire that my son William shall receive one twelfth part it is also my desire whereas I have loaned unto my son Asa Ward one negro boy Reuben that the said Asa shall bring him in and sell him with the rest of my property and if he should refuse to bring him in he shall receive him as one twelfth part and know more but if he should see cause to give him up and have him sold with the rest of my estate in that case he shall receive one twelfth part it is also my desire that my son Asa Ward shall receive one twelfth part for my son Samuel Ward and put it out at interest at six per cent and pay the interest to sd Samuel at the end of every year and if the same Samuel should be in such indigenant circumstances that he is upon sufferances he that said Asa Ward shall let the said Samuel have such sums of the principle as will promote his best interest and at the death of sd Samuel Ward if there should be surplus in the hands of Asa it shall be equally divided amongst the lawful heirs of sd Samuel as they become of lawful age it is also my desire that my daughter Martha Lyon shall receive one twelfth part. I do Constitute and appoint my son Asa Ward and my friend John M. Holland my executors of this my last Will and testament hereby revoking all former Wills and Testaments made by me. This last Will and Testament of Daniel Ward deceased was exhibited into Court and proven by the oaths of Thomas Dudley and Mark Perdue two of the subscribing witnesses and ordered to be recorded and on a motion of Asa Ward one of the executors therein named directed by law and together with Sparrel Hale - executor named. Additional Comments: This is Daniel Ward born 4 May 1739 in Virginia to Benjamin Ward & (unknown?). Daniel Ward married to Betsey (maiden?name)in Pittsylvania Co. He furnished beef to the Revolutionary Army. At his death 29 Jan 1826, he owned 13 slaves and estate valued at $3,622.95 1/2.
