BULGER and Catharine his wife of the county of Shenandoah & State of Virginia of the one part, and Abraham MILLER of the Corporation of Winchester of the other part- Witnesseth: That the said Edward M. BULGER and Catharine-his wife for and in consideration of the sum of five hundred dollars current money of the United States unto them in hand paid by the said Abraham MILLER at or before the sealing and delivery thereof, the receipt where of is hereby acknowledged have granted sold aliened certified release and confirmed and by these presents do grant bargain sell alien convey and confirm unto the said Abraham MILLER his heirs and assigns a certain tract parcel of Land Situate lying and being in the county of Frederick and State aforesaid adjoining the Lands of Rober LEESWRIGHT, Jonathan LAKINS and the Land of the said Abraham MILLER purchased by the said Abraham MILLER from George CLEVENGER and bounded as followeth to wit: Beginning at a hicory corner to Thomas FAWCETT Jun’r (now dec’d) running thence with a line of the latter N44 E192 poles seven and an half links to /B J a stone by a pile of rocks corner to Jon’a LUKENS thence running through the tract S46 E.82 poles 5 links to a pile of stones near a large black oak on the east side of limestone ridge in ZANEs line, thence with Page 243: It S.S43-2’2 west 198 poles 7 ½ links to a black oak in said line and comes to Joel ELLIS’s 67 acre tract (now Robert LEWRIGHT) also in the line of Thomas Fawcett Jun’r thence with his line N47 W84’h poles to the aforesaid Beginning containing fifty acres and it is further expressly understood and agreed by and between the contracting parties, that the said Abraham MILLER or his heirs or his tenants or other persons in his employment is to have free access to both the wells for the use of the water from the public road passing by the house now occupied by Samuel KERCHEVAL and which is on the fifty acre tract also at present owned by the said Edward BULGER, which fifty acre land is conveyed in the deed from Thomas FAWCETT and Martha his wife to Atwell JOHNSTON bearing date the 18th day of October 1819. The aforesaid fifty acres of Land hereby granted and conveyed, is part of one hundred acres sold under a decree of the county court of Frederick in which degree Josiah FAWCETT was appointed a commissioner to carry into effect a trust deed made by said Atwell JOHNSTON to Edward McGUIRE des’d to secure certain sums of money to Thomas FAWCETT des’d and for which the estate of the said dec’d instituted a said chancery against the legal representatives of said Atwell JOHNSTON dec’d in conformity with which decree the said Jonah FAWCETT as commissioner aforesaid sold and conveyed to the said Edward M. BULGER all of which will appear of record together with all and singular the rights improvements, hereditaments and appurtenances whatsoever thereunto belonging, and the reversions and remainders rents issues and profits thereof. To Have and to hold all and singular the premises with the appurtenances hereby granted, unto the said Abraham MILLER and his heirs and assigns, to the only proper use and behoof of the said Abraham MILLER and his heirs and assigns forever. And the said Edward M. BULGER hereby convents for himself and his heirs that he is seized of good Page 244: And indefeasible estate of fee simple in the premises and that he hath good right to convey the same to the said Abraham MILLER in manner aforesaid. And Lastly that the said Edward M. BULGER & Catharine his wife and their heirs all and singular the premises hereby granted with these appurtenances, unto the said Abraham MILLER and his heirs and assigns, against this said Edward M. BULGER & Catherine his wife and all and every other person, Shall Warrant and Forever defend by these presents. In Testimony whereof the said Edward M. BULGER this day personally appeared before us in our said corporation and acknowledged this annexed and written deed of conveyance to Abraham MILLER to be his act and deed and desired us to certify his said acknowledgement to the clerk of the courts of Frederick County in order that the same maybe recorded. Edward M. BULGER did not live on the property in 1815. He lived in Shenandoah County, Virginia at that time.)
