All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/va/vafiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Beth Collins ejcollins@bellsouth.net December 26, 2025, 3:39 am Written: January 31, 1743 Recorded: February 1743 Frederick Co, VA Deed Book 1, pp 32-34 This Indenture made this thirty first day of January in the year of our Lord One Thousand Seven hundred & forty three Between John Littler of Opechon [Opequon] in the County of Frederick & Colony of Virginia of the one part and Thomas Rees of the same place Husbandman of the other part Witnesseth said that the said John Littler for and in consideration of the sum of Twenty two pounds ten shillings current money of Pensilvania to the said John Littler in hand paid by the said Thomas Rees at or before the sealing & delivery of these presents the receipt whereof is hereby acknowledged & thereof doth release acquit &discharge the said Thomas Rees his Exrs Admrs by these presents he the said John Littler Hath granted bargained sold aliened released confirmed & by these presents doth grant bargain sell alien release & confirm unto the said Thomas Rees All that the moiety or undivided half part of a certain tract or parcel of land situate in Opechon aforesd granted by patent bearing date the twelfth day of November One Thousand Seven hundred and thirty five unto the said John Littler his heirs and assigns Containing in the whole four hundred and forty eight acres Beginning at a white oak near the head of the Yorkshiremans Branch, which runs into Opechon and running thence North 65 Degrees East 33 poles to a Locust thence South 55 E 140 poles to an Elm at the head of the Meadow thence N 53 E 216 poles to a white oak thence N 16 W 14 poles to a Spanish oak upon Rocks thence N 30 W 120 poles to a Spanish oak near the foot of a Hill thence S 25 W184 poles to two white oaks saplins thence N 30 E 28 poles to a Hiccory & Spanish Oak thence N 60 W 39 poles to a white oak thence W 60 poles to a red oak thence S 60 W 118 poles to a white oak thence S 38 W to a large white oak thence S 60 E 62 poles to a large Red Oak thence S 30 W 90 poles to Giles Chapman's line thence along his line S 65 E 115 poles to the Beginning And all houses buildings orchard ways waters water-courses profits commodities hereditaments & appurtenances whatsoever to the said premises hereby granted or any part thereof belonging or in any wise appertaining and the reversion & reversions, remainder & remainders rents Issues & profits thereof and also all the estate right title interest use trust property claim & demand whatsoever of him the said John Littler of in & to the said premises and all deeds evidences & writings touching or in anywise concerning the same To Have and to Hold the said granted & bargained land & all and singular other the premises hereby granted & bargained & every part & parcel thereof with their & every of their appurtenances unto the said Thomas Rees his heirs & assigns forever to the only proper use behoof of him the said Thomas Rees & of his heirs & assigns forever And the said John Littler for himself his heirs Exrs & Admrs doth covenant promise & grant to & with the said Thomas Rees his heirs & assigns by these presents that the said John Littler now at the Time of Sealing & Delivery of these presents is scised of a good sure perfect & indeafeasible Estate of Inheritance in fee simple of and in the premises hereby granted & bargained And that he hath good Power Lawful & absolute authority to grant & convey the same to the said Thomas Rees in manner & form afd. And that the said premises now are & so forever hereafter shall remain & be free & clear of & from all former & Gifts Grants Bargains Sales Dower Right & Title of Dower Judgements Executions Titles Troubles Charges & Incumbrances whatsoever made done Committed or Suffered by the said John Littler his heirs or assigns or by any other person or persons by from or under him or by his Means Consent or procurement & the Quit rent hereafter to grow due payable to the Chief Lord or Lords of the fee for & in respect of the said premises only excepted & foreprized; And Lastly that the said John Littler & his heirs all & singular the premises hereby granted & bargained with the appurtenances unto the said Thomas Rees his heirs and assigns agst him the said John Littler his heirs Exrs & admrs & agst all & every other person or persons claiming by from or under him them or any of them shall & will warrant & forever defend by these presents In Witness whereof afsd John Littler hath hereunto set his hand & seal the day & year above written. Sealed and Delivered } John Littler Seal in presence of At a Court held for Frederick County of Feby day the xth day of February 1743 John Littler acknowledged his this his Release of Land Indented to Thomas Rees which on his motion is admitted to record & Mary the wife of the said Littler being first privately examined in open court relinquished her Right of Dower to the Land in the said Deed mentioned & so by her said Husband conveyed to the said Rees which also on his motion is admitted to record.
