He married around 1847 Ann Elizabeth Shryock and had 5 children before he was mustered in the Confederate light artillery as a second lieutenant under Captain Wilfred Cutshaw in Frederick County on March 10 1862. His 6th Child was born August 29 1862 and the last 4 came after the war between 1866 and 1873. He was inducted as an officer probably as he has served in the 51st Virginia Militia before the war. His unit was disbanded in September 1862 and he was reassigned to the Jacksons Brigade. His war record still identifies him as a member of Cutshaws Battery. He was promoted to first lieutenant May 25 1862 and was appointed chief enrolling officer for the Fourth Comp. District of Counties Frederick, Berkely, Morgan Hampshire Clarke Jefferson Shenandoah and Henry by order November 19 1862. He was captured at Woodstock Virginia on October 20 1864 (Battle of Cedar Creek took place October 19 1864 near there and it is the assumption that this was part of the action there) He was on the roll of prisoners of war at Harpers Ferry West Virginia and sent to Fort Delaware Delaware on November 1 1864. He remained there until May 10 1865 when he sighed an Oath of Allegiance to the United States and was released. His physical description was complexion ruddy hair brown eyes hazel with no height listed. The last two children born 1871 and 1873 were born at Browntown Virginia near Front Royal. We believe the family moved to Front Royal later. He and Annie were living in Roanoke with daughters Sarah Marks Nover and family when he died May 4 1892. Laura Booth Kridel daughter of Florence Marks booth was was born February 8 1890 told Jackie Marks Shopland that she remembered being bounced on her grandpas knee and that he was jovial and had a big tummy. Jacob evidently inherited property in Stephens City from his father Alexander who died in 1845 as there are several legal documents recorded involving the sale of property there by Jacob. He was a carpenter and with all those children to support it is highly suspect that he could have accumulated enough money to purchase property that he would later sell. Alexander Marks estate evaluation was rather significant for the times so that would seem to be the circumstances of Jacobs sales of property. Also Jacob evidently rented the homeplace at Browntown as the family has been unable to find any record of his owning property there. The following Deed for Jacob Marks proves his relationship to Alexander Marks as son. DB 77 page 206 April 28 1849 Jacob Marks and Ann Elizabeth his wife to Joseph Long all of Frederick County Virginia, consideration of $500.10, a part of which has been paid to said Jacob Marks by said Joseph Long - the balance to be paid - said - Jacob Marks and wife convey to said Joseph Long a parcel of land in the county of Frederick 3/4 mile west of newtown being one of the outlots in the said town containing 10 acres adjoining Peter Keeding on the north, the other lands of said Longs on the south, "fronting on what is called 2nd Lane" and running back the usual and proper depth to the lots of John Allemong, Thornton McLeod and others being the same lot of which the late Alexander Marks died seized and which in the division of real estate of said Alexander Marks made by the commissioners appointed by the county court of Frederick County and whose report was returned on the 6th of October 1846 was alloted to the said Jacob Marks as will be more fully seen by reference to the said report. Signed Jacob A. Marks Signed Ann E. Marks The following deed is of record for Jacob Marks Deed Book 80 page 310 May 7 1850 Charles E. Shryock and Rachael, his wife to Jacob A. Marks sum of $125.00 consideration, all the right, title and interest of said Charles Shryock in and to a house and lot in New Town Stephensburg on main street, it being the same property of which the late Frederick Shryock died, possessed and adjoining the lot of James A. Redd and others, said interest consisting of one half and one seventh of said house and lot with the appurtenences thereto belonging subject to the life estate of Elizabeth Shryock that is 1/7 thereof being so subject. Shryock Signed Rachael Shryock It seems from the above that Charles Shryock inherited had inherited 1/7 part of Frederick Shryocks Estate and that in addition he was entitled to 1/2 the property by his own right. they may have bought the property together? Also , by reference, to the 1/7 part having been subject to the life estate of Elizabeth Shryock, it appears that Frederick Shryocks widow was still living.
