GILES COUNTY, VA - DEEDS - Garwood G. Frenor to Hill, Butler, Peck and Snidow, 5 Mar 1849 ----¤¤¤---- Giles Co., VA, Deed Book H, p. 331-2 This Indenture made this 5th day March in the year of our Lord 1849 between Garwood G. Frenor of Botetourt County on the first part and Clifton G. Hill of Botetourt and Gustavus A. Butler of Giles County of the second part and William W. Peck and William W. Snidow of Giles County of the third part. Whereas the said Garwood G. Frenor is justly indebted to the said Peck and Snidow in the sum of one thousand dollars due by bond bearing even dates with this Indenture and payable on the 5th of March 1852 with interest thereon from the date thereof and being willing and desirous to secure and pay the same. Now this Indenture witnesseth that for and in consideration of the promises(?) and for the further consideration of the sum of one dollar current money of Virginia to the said Garwood G. Frenor in hand paid by the said Hill and Butler Trustees the receipt whereof is hereby acknowledged he the said Garwood G. Frenor both granted bargained and sold and by these presents doth grant bargain and sell unto the said Clifton G. Hill and Gustavus A. Butler their heirs and assigns all his right title and interest in his landed estate lying in the Counties of Botetourt and Giles on the head Waters of Sinking Creek on both sides of the Turnpike road adjoining the land of Peter Hipes and others also the following personal property to wit: 1 gray horse about 7 years old, 1 brown mare about 7 years old, 1 brown horse about 10 years, 1 bay mare filly about 3 years old, 1 grey filly 3 years, 1 sorrell rone mare about 5 years old, 4 milch cows, 3 heifers, 2 calves, 33 head of sheep, 25 head stock hogs, 1 four horse waggon, 6 pair waggon guy(?), 2 pair stretchers, 6 collars and bridals, 2 pattent plows, 3 shovel plows, 1 iron tooth harrow, 5 corn hoes, 7 beds, bedding and furniture, 1 extra bedstead, 1 secretary, 1 cupboard, 2 pots, 2 ovens, 2 skillets, 1 baker, 1 cooking stove, 1 fine brass clock, 2 kitchen cupboards, 100 doz rye, 100 doz sheep oats, 1 large mow of hay, 100 bush corn, 1 spanish saddle, 1 waggon saddle, 1 main common saddle, 2 doz chairs, 1 large chair, 3 pairs day(?) irons, 80 doz wheat, 1,000 pounds bacon, and 1 fine rifle gun and all his other personal property of every discription together with all and singular the appurtenances thereunto belonging or in any way appertaining to have and to hold the said real and personal property above described unto the said Hill and Butler Trustees their heirs and assigns forever to the only proper use and behalf of the said Hill and Butler Trustees their heirs and assigns forever. And the said Garwood G. Frenor for himself his heirs, executors and administrators with covenant with the said Hill and Butler Trustees their heirs and assigns to warrant and forever defend the said real and personal property above described against the claim or claims of him the said Garwood G. Frenor and all and every person whatever. Upon Trust nevertheless that the said Hill and Butler Trustees shall permit the said Garwood G. Frenor to remain in quiet and peaceable possession of the said real and personal property until the default be made in the payment of the said sum of money or any part thereof, and then upon this further trust, that as soon after the happening of such default as said Peck and Snidow or their legal representatves, shall order or the said Garward G. Frenor his legal representatives shall request the said Hill and Butler Trustees or their representatives or either of them shall proceed to sell the said real and personal property above described or so much thereof as they may think sufficient for the purpose, and shall think proper to sell, to the highest bidder, for ready money at public auction, after having given at least twenty days notice of the time and place of sale by advertisement in some newspaper published in Fincastle or by advertisement set up in the most public place near the said property and out of the monies arising from such sale shall after satisfying the charges thereof and all other expenses attending the premises pay to the said Peck and Snidow their heirs or assigns the said some of $1,000 with the interst which may have accrued thereon and the balance, if any, shall pay to the said Garwood G. Frenor his heirs, executors, administrators or assigns. But if no default be made in the payment of the said sum of money, on the 5th day of March 1852 when the same is payable (or any part thereof) then this Indenture to be void, otherwise to remain in full force and virture.
