WITNESSETH that for and in consideration of the sum of two hundred and twenty five dollars in hand paid to Rowland Fletcher by the same James Burton the receipt of which is hereby acknowledged the said Fletcher having purchased of the said Eleanor and transfered his claim to the said James Burton and desiring a conveyance to be made to him the said Burton. The said Eleanor in consideration of the premises aforesaid and for the further consideration of the sum of one dollar to her in hand paid at and before the insealing and delivery of these presents hath bargarned & sold and by these presents doth give grant bargain & sell unto the said James Burton all her right title and interest in & to a certain tract or parcel of land situated lying and being in the county of Giles on Roberbusiness(?) a branch of Kimberling and containing two hundred and twenty nine acres be the same more or less. The same being the precise land decreed to the said Elenaor Perdue by the Judge of the Circuit Superior Court of Law & Chancery for the county of Giles some years since in a suit in the said court pending in which the said Eleanor Perdue was complaintant and Elias Harmon and James Hector were defendants. To have and to hold the said tract or parcel of land with the appurtances thereto belonging to the said James Burton his heirs and assigns forever. And the said Eleanor Perdue convenants and agrees to and with the said James Burton his heirs and assigns that the title to the said tract or parcel of land to the said James Burton his heirs & assigns forever free from the claim or claims of the said Eleanor Perdue and all claims by through or under her, or the heirs & legal representatives of the said Eleanor, but against the claim or claims of none others by these presents will forever warrant and defend. In testimony where of the said Eleanor Perdue hath hereunto set her hand & seal the year & date just aforesaid. Eleanor (her X mark) Perdue Wyoming County to wit; We Chrispyance Walker and John Howerton two acting Justices of the Peace in and for the county aforesaid certify that Eleanor Perdue to a certain and bearing oath the 14th day of August 1850 and hereton annexed personally appeared before us in the county aforesaid and acknowledged the same to be her act and deed and desired us to the said acknowledgement to the clerk of the County Court of Giles in order that the said deed may be recorded.
