All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/va/vafiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Trena Riffle tmriffle@hughes.net September 10, 2006, 6:47 pm Source: Giles County Courthouse Will Book #4 Written: April 15, 1858 Recorded: May 10, 1858 I, Isaiah Hale of the County of Giles and State of Virginia do make this my last will and testament. 1st After my death, I direct my Executor herein after named to have my boddy buried in a decent christian like manner. 2nd I direct that my Executor shall sell all my personal Estate which I have not specially willed collect all debt due and owing to me and out of the same first pay my funeral Expenses and then all my just debts the remainder to apply as I may hereafter direct. 3rd I will to my wife Sarah during her life time all my lands lying in the old tract or the tract of land upon which I now live above the brink of the hill commensing on my line in or near the watery hollow below my house and opposite a spring or line of fence which divides my bottom from my uplands and running to and with that fence rather a westerdly direction untill said line strikes the river and thence down the same to the line of the Wilsons line and around with the same to the watery hollow to the commensment of the same including all my uplands houses etc. in the tract upon which I live also my wife Sarah is to have during her life time all my Negrows horses cattle Hogs Sheep huse hold and kitchen furniture farming utentials etc. with the exception of such property herein after named. 4th I will and bequeath at the death of my wife Sarah that my Executor sell all my real and personal property and the money arising from the sale of said property to form one general fund to be distributed amongst my children as I may herein after direct. 5th I will to my friend William Moser in trust for my daughter Adaline Morgan two hundred dollars to be managed and given to her by the said William Moser as he may think that she needs it. 6th I will to my friend William H. Hale in trust for my daughter Willmerth Hare all that part of my estate which I will hereafter name to manage and apply it wholly to the use and benefit of my daughter Willmerth I also give in trust to the said William H. Hale eight hundred dollars for my little grand daughter Allene George Spangler to be kept at interest by the said William H. Hale for the benefit of my little grand daughter Allene George and to be applyed when he thinks necessary for her benefit but if the said Allene George should die without any bodily heirs in that case the money left I desire to be returned by the said William H. Hale to my Executor to be placed in my general fund, to be distributed as the rest of my estate placed in the general fund is to be distributed. 7th I will to Margaret Ann Chambers and Carington Lybrook two hundred dollars each to be paid to them out of my general fund. 8th Being desirous of making the balance of my children all equal therefore I will to them all the remaining portion of my estate to be equally divided by my Executor between Charlotta Moser Louisa Snidow Virginia Kinzie Dulana Willmerth Hare Sarah Lear and Luther C. Hale. I reserve sixty five dollars for each of my two daughters Dulaney and Sarah Lear having given to my daughters that left me one horse and one cow each and I desire to make them equal with the balance of my children also I will to my daughter Sarah Lear one bed bedstead and its furniture also being desirous of making my son Luther C. equal with the rest of my children I will and direct that my Executor give to my son Luther one two year old horse colt also one bed bedstead and furniture The sixty five dollars to each of my daughters Dulana and Sarah Lear also the colt and bed bedstead and furniture to Luther C. I desire my Executor to take no account of but to pass it over to them and make them equal with the balance of my children named in this 8th article out of the remainder of my general fund. 9th I Hereby constitute and appoint my friend Chapman I. Johnston as my Executor and impower him to sell and convey all my real and personal estate at the death of my wife Sarah also I will that my Executor keep all my lands annually rented out excepting the lands willed to my wife untill her death or till the sale after her death takes place in confirmation of the forgoing I have hereunto set my hand and affixed my seal this fifteenth day of April one thousand eight hundred and fifty eight. This last Will and Testament of Isaiah Hale deceased, was, this day, presented in Court, and proven by the oaths of Charles Hale and William J. Fizer, two of the subscribing witnesses thereto, and thereupon admitted to record. Teste, H. W. Broderick, Clerk Additional Comments: Allene George Spangler, the only grandchild named in Isaiah's will, died July 8, 1858. Her father and sister had died in February and her mother in April of that same year.
