Haynes Deed, 1899-1903 - Gloucester Co. VA HAYNES AND OTHERS PARTITION FILED IN GLOUCESTER COUNTY COURT HOUSE Received the original Deed March 2nd, 1903. John R. Haynes Whereas William Haynes deceased of the County of Gloucester, Va. did seize and possessed of certain realty situated and lying in the county aforesaid, bounded by the lands of John L. South, John Lamberth deceased, and others and containing two hundred and eighty acres be the same more or less, said land being the same tract where on the said decedent lived during his life time; and whereas the said decedent died intestate as to his said realty leaving the same unencumbered and whereas Emma Dutton, W. S. Haynes, Mary Edwards, W. A. Haynes, Josephine Pierce and Juliza Walton heirs at law of the said decedent being divisions that a voluntary, but fair and equal division and partition of the said realty shall be had among them as further induced by a contract with each other bearing date on the 23rd day of October 1896 and duly signed by the said heirs, have caused the said realty to be surveyed and divided according to quality and quantity as set forth in said contract into as many shares and lots as there are lawful claimants thereto to wit, six shares or lots; and where as by virtue of the said contract, the said heirs at law of the said decedent have determined by lot their respective portion or share of said realty, that is to say. Lot no. 1, containing thirty acres more or less and bounded by the lands of W. Haynes, J. T. Rilee and lot no 5 in this partition was drawn by the said Emma Dutton. Lot no. 2 containing thirty acres, more or less and bounded by the lands of John L. South, W. A. Haynes and Josephine Pierce and William Edwards in this partition was drawn by the said W. S. Haynes. Lot no. 3 containing forty acres more or less and bounded by the lands of J. T. Rilee, James Bristow and John Lamberth's estate and lot no. 4 in this partition was drawn by the said Mary Edwards. Lot no. 4 containing sixty acres more or less and bounded by the lands of James Bristow and W. W. Mason and lot no. 5 in this partition was drawn by the said W. A. Haynes. Lot no. 5 containing sixty acres more or less and bounded by the lands of H. T. Walton and W. W. Mason and lots nos. 4 & 6 in this partition was drawn the said Josephine Pierce. Lot no. 6 containing sixty acres more or less and bounded by the lands of John L. South and H. T. Walton and lot no 5 in this partition was drawn by the said Juliza Walton. Now therefore this indenture made this first day of March 1899 between the said Emma Dutton and Joshua Dutton her husband, the said W. S. Haynes and Louisa T. his wife, the said Mary Edwards, the said W. A. Haynes and Harriet S. his wife, the said Josephine Pierce and Robert Pierce her husband and the said Juliza Walton and James H. Walton her husband, Witness that for and in consideration of the promises and the sum of one dollar in hand paid by one to the others of the said parties or heirs in interest and to the end that the said heirs at law of the said decedent and their heirs or assigns may from henceforth enjoy without disturbance of the other their respective share or interest in the said realty so described and partitioned. They the said parties last mentioned by their own mutual consent and agreement do make and by these presents for themselves and their heirs , have made partition and division of the said realty in manner and form following: The said Emma Dutton shall have for her share and partition Lot no. 1 as above referred to and described together with all appurtenances thereto belonging. The said W. S. Haynes shall have for his share and partition of the said realty Lot no. 2 as referred to and described together with all appurtenances thereto belonging. The said Mary Edwards shall have for her share and interest in said realty Lot no. 3 as above referred to and described together will all appurtenances thereto belonging. The said W. A. Haynes shall have for his share and interest in said realty Lot no. 4 as referred to and described together with all appurtenances thereto belonging. The said Josephine Pierce shall have for her share and interest in said realty Lot no. 5 as referred to and described together with all appurtenances thereto belonging. And the said Juliza Walton shall have for her share and interest in said realty Lot no. 6 as referred to and described together with all appurtenances thereto belonging. And they the said parties to this deed and lawful heirs of the said decedent, do hereby for themselves and their heirs, covenant, promise and agree that the above described parcels or lots of land so partitioned and divided shall constitute their several and separate interest in the said realty and that they and their heirs shall have hold and enjoy the same forever without let or hindrance. Haynes, Josephine F. Pierce, R. B. Pierce, Juliza E. Walton, James H. Walton and Mary Edwards, whose names are signed to the writing above, bearing date on the 1st day of March 1899, have acknowledged the same before me in my said County, given under my hand this 30th day of June 1899. HAYNES FILED IN GLOUCESTER COUNTY COURT HOUSE AS PART OF ABOVE DEED Received the original Deed March 2nd 1903. John R. Haynes This Deed made and entered into this 4th day of March 1899 between Emma Dutton and Joshua S. Dutton her husband of the County of Gloucester and the State of Virginia, parties of the first part and W. S. Haynes of the same place party of the second part. Witnesseth that for and in consideration of the sum of seventy five dollars in hand, paid by the said party of the second part to the said parties of the first part, the receipt whereof is hereby acknowledged, the said parties of the first part do grant, sell and convey and by these presents have granted, sold and conveyed with (word not distinguishable) warranty unto the said party of the second part, all of their right, title and interest in that certain piece or parcel of land laying and being in the County aforesaid, containing thirty acres more or less and bounded by the lands of W. A. Haynes, J. T. Rilee and Lot no. 5 in a partition deed hereinafter mentioned said land being a part of the original tract of land of which William Haynes deceased, seized and possessed and on which the said decedent lived at the time of his death said land being the same as set forth in a partition deed made and executed by the heirs at law of the said William Haynes deceased and bearing date on the 1st day of March 1899 and designated as lot no. 1 in said deed. To have and to hold the said land herein conveyed with all appurtenances thereto belonging unto him the said W. S. Haynes and his heirs forever.
