Noel Lowry
Goochland Co., VA

This Indenture made and entered into this fourth day of December in the year
one thousand eight hundred and thirty nine between William Southworth,
special commissioner appointed by a directed Order of the Circuit Superior
Court of Law and Chancery for the County of Goochland made on the twentieth
day of April in the year eighteen hundred and thirty nine, in the case of
Jackson Mills and John J. Fleming plaintiffs against Elizabeth Lowry, widow
of Noel Lowry, dec'd, and their children Branch Archer Lowry and Cynthia
Lowry, infants and Thomas Curd Sheriff of Goochland county appointed
administrator of Noel Lowry, dec'd, of the one part, and Jackson Mills of
the County of Goochland of the other part.  Witnesseth, that whereas the
said William Southworth, commissioner as aforesaid, by virtue and in
pursuance and execution of the said directed order after having duly
advertised or authorized by the said directed order the time and place of
sale of the tract of land herein after more particularly described, did on
the fourth day of December in the year eighteen hundred and thirty nine
offer the same for sale at public auction upon the premises according to the
terms of the said decree, when the said Jackson Mills became the purchaser
thereof he being the highest bidder at the price of one hundred and fifty
dollars.  Now this Indenture further Witnesseth that the said William
Southworth Commissioner as aforesaid, by virtue and in execution of the
aforesaid directed order, for and in consideration of the premises and more
especially for and in consideration of the sum of one hundred and fifty
dollars to him the said William Southworth Commissioner as aforesaid paid
and secured to be paid according to the terms of the said directed order by
the said Jackson Mills before the unsealing and delivery of three presents
the receipt whereof is hereby acknowledged hath bargained and sold conveyed
and assigned and by these presents as commissioner as aforesaid and under
authority of the aforesaid directed order doth bargain sell, give, grant,
transfer, assign, convey and confirm unto the said Jackson Mills his heirs
and assigns a certain tract or parcel of land mentioned in the Bill in the
above recited case in the circuit superior court of law and chancery for
Goochland County containing one hundred and twenty four acres more or less
lying in the County of Goochland and adjoining the lands formerly owned by
James Lowry and others, it being the same tract of land which was divided to
Noel Lowry by his father, Mathew Lowry and upon which Elizabeth Lowry the
mother of the said Noel Lowry dec'd formerly lived, and died, together with
all and singular the appurtenances thereto belonging to have and to hold,
the said tract of land with all and singular its appurtenances to him the
said Jackson Mills his heirs and assigns to his and their only use and
behoof forever.  In witness whereof the said William Southworth Commissioner
as aforesaid and in execution of the aforesaid directed order hath herunto
let her hand and seal the day and year first above written.

At a court held for Goochland County, 17th February 1840, This Indenture was
presented in court and acknowledged by William Southworth to be his act and
deed and ordered to be recorded.
