Payne Item 1: to my son John the land and plantation where he lives as also the land I purchased of William Pledge as also four hundred acres lying in the county of Fluvanna on the branches of the Byrd Creek which I purchased of William Gooch Item 2: to my son Archer, the land & plantation whereon he now lives call Newmarket also all the land pining on the east side Beaverdam Creek which I purchased of William and Gideon Christian, also the land on Beaverdam Creek purchased James Coleman, also odd acres purchased of Richard Adams, also land on both sides of the Mountain Road purchased of Jesse Witt and Sarah Thomas, also the land whereon William Groom and the said Sarah Thomas now live Item 3: to my wife Jane Payne, all the estate of all kinds whatsoever which I had by her or would have my right or title to by marriage to dispose of how she thinks proper among and for the benefit of all her children by me, I lend her the land and plantation whereon I now live that lies on the north side of main road including one hundred fifty two acres which I purchased of Richard Anderson part of which lies on the south said of said road joining on Josia Payne's back ave; in consideration that she my said wife disclaim any right or dower in any other of my said land; I also lend my said wife during her natural life one mulatto man named Sam and seven negroes namely Jack, Matt, york, Fanny, Amy, Sampson, old Lucy, Ford, Hannah Waggoner, Will, Daire, Dam Barrow, Jacob, Belender, Milley dauther Belendon, house Lucy, old Dener, after my wife decease that the said mulatto man Sam above mention and Amy with her future increase shall go and descend to my son Robert and to him and his Heirs forever, and that jack, Nell and York go and descend to my son George Woodson to him and his heirs forever and that the said Lewis and Hannah & Fanny go and descend to my son Smith to him and his heirs forever Item 4: To my daughter Ann Gordon, eleven negroes named Amboloe, Samy son of Lucy, Sam children, Jany daughter of Vonus, Venus daughter Jony, Patty daughter do, Giles son do, little Jenny daughter Fanny, Hanther child Posie, all being delivered all of which negroes I give to her my said daughter Item 5: To my daughter Janelee seven negroes namely, Adam, Davie, Dick, Tylor, Temp, Mary, Lucy, Stephen, Decoy, Beeffsy, Sally, Winny Item 6: To my son Philip all the land and plantations I hold joining on Stauton River in the county of Cambell; together with all utensil tools thereunto belonging; also twenty of his choice cattle belonging to the said plantation; also all the hogs and half the sheep; also two of his choice plow horse that are usually kept for that business on either said plantation; I also give him my said son eighteen negroes namely Chanoe, Poinzer, Moses, George, Samy son Sarah, Sarah great Bett, short Bett, great Samy, Henry, Billy, Hudson, sons of great Bett, Amy, Sally, & Van daughter & son of Sarah, Unity and Nancy, Daughter of great Jany & Spencer; I also give my said son all that part of a tract of land in the county of Bedford called and known by the name of the Forest Tract that lies on the north side of Branch, running through the said tract beginning where the said Branch crosses Charles Calloways line, thence running into the said Branch to the head thence near the same course continued to John Hooks line, all which said land lying on the north side the said Branch aforesaid; I give him my said son together with the other above mentioned lands untentsals, cattle, hogs, sheep, plow horses, and the eight negroes above mentioned Item 7: To my son Smith: all my tract of land and plantation I hold in Campbell County called Flat Creek Quarter and joining the other river, together with all the utential tools belonging to the said plantation as also twenty of the choice cattle and all the hogs that shall be on the plantation at the time of his arrival to the age of twenty one years; I also give my said son two of his choice of the plow horses on the said business on the aforesaid Flat Creek plantation; I also give my said son all the remaining part of my tract of land & plantation I hold in Bedford County called the Forrest also one hundred and odd acres land more adjoining thereto which I purchased of Drury Howard after first laying of a part of the first mentioned Forest tract agreeable to this my will aforesaid and given to my son Philip, all of which said lands utentials cattle, hoggs 7 horses as here above mentioned; I also give my said son Smith one house and lot in New london in the county of Campbell; I also bequeath to him my said son Smith seventeen negroes namely Bedford, Charles, Lancaster, Deek, Jamy son Diner, Jery son Pegg, Lirus great Hanner, Milley, Muryear, Lucy, Winny, Jack, Pat, Rachel and Mannel sons & daughters of Muryear, Billey, a younger one name unknown son & daughter of Milley, and Fanny, but that the said Sirus, great Hannah & Fanny above mentioned is to be and remain the property of my loving wife during her natural life and at her decease to go and descend with their future increase if any to my said son Smith & his heirs forever. Item 8: My will and desire is that my loving wife taking upon herself the care & charge supporting maintaining and shooling my three children namely George Woodson, Robert, and Mildred Mathews, which I desire my sons in particular may be taught in the best manner and that neither of their estates be chargable with maintenance or schooling that then in that case she my said loving wife shall have for and during the minority of my son George Woodson while he arives to the age of twenty one years, the use and profit of all the remaining part of my Estate in Virginia not before given at the expiration of my said son Woodson ariving to the age of twenty one years that then his part of my Estate hereafter mentioned and given him be delivered to him to to act and do with as he shall think proper and that then the remaining part of not before given be and remain in the possession of my wife for her use and and benefit while such time my daughter Mildred Mathew marrys or arrives to the age of twenty years that in either case that then her part of my estate hereafter mentioned and given her to act and do with as she shall think proper and that then the remaining part of my estate not before given as aforesaid and remain in the possession of my said wife for her use and benefit while such time my son Robert arrives to the age of twenty one years that then his part of my estate hereafter mentioned & given him be delivered Item 9: To my son George Woodson: all that part of the Land Mill and plantation now live on that lies on the south side the main road, all that tract of land and plantation called Poles which I purchased of John Holland containing three hundred acres, Item 10:I also give my son George Woodson all the stocks of cattle, hoggs and sheep that shall properly belong to any and all the lands and plantations given him at the time of his arrival to the age of twenty one years, also two of his choice of plow horses that are usually keep on either of the plantations given him; also give my said son sixteen negroes namely, Shop Dick, Babb son of Pegg, Harry son of Sarah, Lem son of great Jany, Jack, York, Nell, Tamer, Lucy, Winny, Rachel, Jacob and one younger daughters & sons Tamer (Letty, Jugge & Brisher) Daughters and sons of Nell but that the said Jack, York and Nell here above mentioned is to be and remain the property of my loving wife during her natural life and after decease to go and descend to my said son George Woodson agreeable to my wife before mentioned all of which negroes here in manner given together with all the lands cattle, Hoggs, sheep and horses Utentials tools belonging to either and all the plantations I do give him my said son George Woodson Item 11: To my daughter Mildred Mathews: thirteen negroes namely Hanner & her child Judy, long Bett, Robin, Frankey, Isaac, harry son Pegg, Chariott son Muryear, Ursula, Dick, Hanner, Alley, Phil and Charles son Fanny all of which said negroes together with their future increase I give to my said daughter Mildred Mathew to her & her heirs forever Item 12: To my son Robert: three hundred & sixt five acres of land that lies on both sides the mountain Road called Pryors old ordinary tract. Then I give and bequeath to my son Robert at my wifes decease all that Devident or part of land and plantation I now live on that lies on the north side the main road together with two other smaller tracts one of which I purchased of Richard Anderson contains a bout one hundred & fifty two acres the other small tract was Brittish property which I purchased of William Harrison Escheaher for Goochland County containing about one hundred and thirty odd acres both of which small tracts above mentioned is adjoining the first mentioned Dividend of land I now live on and on both sides the main road joining Cahers ferry road, the other side of Carher's ferry road I have disposed of all of which said lands at my wifes decease I do give my said son Robert; I also give my said son Robert sixteen negroes namely mulatto Sam, Abraham, Philson, Sarah, Mamfo, Easher, and her three children namely Sirus, Phil & Palsie, Amy and her six chldren, namely Diana Molley, James, Sarah, Seller and Tom herrod and Sudkey, but that the aforesaid mulatto Sam & Amy is to be and remain the property of my loving wife during her natural life and at her decease to and descend togehter with their future increase to my said son Robert Item 13:To my four sons Philip, Smith, George Woodson & Robert: all my right claim & property to all the lands I have or held on the western waters of the land within the settlement of wheat is called Kentucky; all the future increase from the date of this my that may arise from all the female negroes as deferently given among my children shall be the property of such child & shall go & descend to them and their heirs forever and my will further is that my Executors here after named_ do collect all the debts that is due to my estate as quick as possible and that they also sell the two different small tracts of land here after mentioned on the best terms they can according to heri discression...one hundred acres lying on Lickinghole Creek which I purchased of Rene Napier...one hundred and thirty acres whereon John Ilam formerly lived.....all money arising from the collection of my debts and the sale of the said land above mentioned to be for the purpose of paying my just debts that I may owe and that all the money remaining from the collection of the debts due my estate and from the sale of the land aforesaid after my just debts is paid as aforesaid I desire my be equally divided between my daughter Jane Lee and my wife and my Executors hereafter named for an in consideration of their trouble......and that my will and desire further is at my wifes decease that all the remaining part of my estate ....be sold to the highest bidder....I direct may be equally divided among my three daughters namely Anne Gordon, Jane Lee and Mildred Mathews and my two sons George Woodson & Robert and my will and desire further is that if Smith, George Woodson or Robert either my three sons namely should died before they arrive to the age of twenty one years that then all their estate left and given them by me be equally divided among all my surviving children by my present wife and I do hereby constitute & appoint my three sons Archer, Phillip & Smith Payne & my son in law James Gordon my Executors To all whom it may concern whereas our deceased father John Payne dec by his last will and testament give bequeath & desire unto us Philip Payne, smith Payne, George Woodson Payne and Robert Payne, his four sons by his wife Jane Payne all his rights titles and claims to land in the Kentucky County whether by Surveys location or warrants, to be equally divided between us his said four sons and our heirs forever, Now know ye that we Philip Payne, George Woodson Payne and Robert Payne for and in consideration of the sum of two hundred pounds current money to us in hand paid by our afore mentioned brother Smith Payne the receipt where of we do hereby acknowledge have and by these present do for ourself and our Heirs, for ever quit all claim or petitions of claim that we now have, or hereafter could have in and to the said lands, locations, or warrants, unto the said Smith Payne and his Heirs forever, do covenant and agree to and with the said Smith Payne that we will warrant & defend the lands aforesaid to him and his Heirs forever against the claims challenge or demand of us, or either of us, our or each other Heirs Exors. or Adms forever. But not against the claim or claims challenge or Demand of any other person or persons.
