Viz I will and bequeath unto my wife Lucy all my Lands that I now own during her natural life with the exception of five acres which has been selected for the seat of Justice for this County and of the same should not be made use of for that purpose, then to be hers for and during her natural life. 2d. I reserve for the use of my son Peyton Hail the priviledge to cultivate, clear and fence any lands upon the tract of land whereon I now live, also on three other tracts adjoining the same during the life time of my wife Lucy Hail. 3d. And after the death of my wife Lucy Hail I will and bequeath unto my son Peyton Hail all my lands which I now own except the tracts I purchased from Nathan Thomas and Lewis Brewer. 4th. After the death of my wife Lucy Hail I will that the two last named tracts of Land be sold to the highest bidder for cash. 5th. And out of the money arising from such sale I will that Three hundred Dollars be paid to my daughter Susannah Bryant, Three hundred dollars to Rosamond Dickenson, and Two hundred Dollars to Elizabeth Whitman. 6th. I will and bequeath unto my wife Lucy during her natural life my Waggon and harness and four choice horses, all my farming utensils, household and kitchen furniture & Smith tools together with twenty head of choice cattle, twenty head of choice sheep, and twenty head of choice hogs and all the salves and their increases during her natural life. 7th. My Will and desire is that at the death of my wife Lucy Hail my slaves be sold to the highest bidder among my children that now reside in this County. Viz Stephen Hail, Charles Hail, Samuel M Hail, Peyton G Hail, Morgan Bryant, David Whitman and John Dickenson and the money arrising from such to be equally divided among my children. Viz Stephen Hail, Charles Hail, Samuel M Hail, Peyton G Hail, Susannah Bryant, Elizabeth Whitman, Rosamond Dickenson, William Hail The children of my son Lewis Hail, The children of my daughter Nancy Gose, decd and the children of my son John Hail decd. 8th. I further will that in lieu of selling as before directed at the sale of said slaves my negro boy Andrew, be appointed by three disinterested persons and that my son Stephen Hail take him at the price put upon him by the said appraisers towards his part of the money among from the sale of said slaves if it over pays his proportionable part then for him to account to the others for the same, if not then the amount to be made out of the sales of the other slaves. 9th. My Will and desire is that at my death all the remaining part of my estate except what has been willed to my wife Lucy Hail be sold to the highest bidder, and the money arrising from such sale to be equally divided among my children Viz. Stephen Hail, William Hail, Charles Hail, Samuel M Hail, Peyton M Hail, The children of my son Lewis Hail, The children of my daughter Nancy Gose, The children of my son John Hail, Susannah Bryant, Elizabeth Whitman, and Rosamond Dickenson. 10th. My will and desire is that at the death of my wife Lucy Hail all the personal property which has been willed to her or that she may have shall be sold to the highest bidder, and the money to be equally divided among my children Viz. Stephen Hail, William Hail, Charles Hail, Samuel M Hail, Peyton G Hail, the children of my son John Hail, the children of my son Lewis Hail, the children of my daughter Nancy Gose, Susannah Bryant, Elizabeth Whitman & Rosamond Dickenson. 11th. I will and desire that all the grain _____ that my be on hand at my death before the use of my wife Lucy and the necessary uses of the family and lastly I appoint Stephen Hail and John Dickenson Executors of this my last Will and Testament. In Testimony whereof I have hereunto set my hand and affixed my seal this 4th day of January 1844. signature - W Hail Attest John Funk - his mark John Dickenson - signature John Stone - signature Bledsoe Overton - signature John W Wormick - signature Grayson County Court May term 1847 This Last Will and Testament of William Hail decd was proved by the oath of Bledsoe Overton and John W Womick subscribing witnesses thereto and is ordered to be recorded And on motion of John Dickenson one of the Executors therein named, who made oath thereto and together with Samuel M Carment, Heston Fulton, and William B Dickenson his securities entered into and acknowledged his bond in the penalty of $10,000 conditioned as the law directs 'Certificate' is granted Sum for obtaining a probat of the said Will in due form, liberty being reserved to the other Executor named in the sale Will to join in the probat of the said Will.
