Rains/Chapman Deed, 1852 - Greene Co. VA Greene County Deed Book 3 Page 26 This Indenture made and entered into this 25th day of October 1852 between Fielding Rains and Elizabeth Rains of the County of Greene and state of Virginia of the first part and Wm T Chapman of the county and state aforesaid as the other part. Witnesseth that the said Fielding Rains and Elizabeth his wife hath this day bargained and sold to said Chapman one certain lot of land near Bezeal Parrotts corner in the river for the purpose of building a grist and saw mill, for the sum of ten dollars in hand paid, the receipt of which is acknowledged in consideration of which the said Fielding Rains and Elizabeth his wife hath granted bargained and sold to the said Wm T Chapman and his heirs the priviledge of taking the water out of the river at such place as may be most suitable and the privilidge of cutting a mill road from the river through the aforesaid lot of land to the said Chapman’s land, the said Fielding Rains and Elizabeth his wife will warrant and defend the right and title to the above water right to him and his heirs forever. In testimony whereof they have interchangeably set their hands and seals this day and date above written. Fielding Rains Elizabeth Rains Greene County to Wit: We James Simms and George A Gentry, Justices of the Peace in the county aforesaid in the state of Virginia, do hereby certify that Fielding Rains a party to a certain deed bearing date on the 25th day of October 1852 and has personally appeared before us in our county aforesaid and acknowledged the same to be his act and deed and wished us to certify the said acknowledgement to the Clerk of the County Court of Greene is order that the said deed may be recorded. We do hereby further certify that Elizabeth Rains the wife of Fielding Rains party to a certain deed bearing date on the 25th day of October 1852, and hereto personally appeared before us in our county aforesaid, and being examined by us, privily and apart from her husband and having the deed aforesaid fully explained to her, she the said Elizabeth Rains acknowledged the same to be her act and deed and and that she willingly signed sealed and acknowledged the same and that she wished not to retract it. Given under our hands and seals this 27th day of October 1852.
