GREENSVILLE COUNTY, VA - WILLS AND ESTATES - Thomas Person, 23 May 1805 ----¤¤¤---- IN THE NAME OF GOD AMEN, I Thomas Person of Greensville County and State of Virginia, being of sound mind and disposing memory, do call to recollection the unceretainty of human life and that it's appointed for all men once to die, do make and ordain this my Last Will and Testimony, revoking and making void all other Wills heretofore made by me. Item, after the payment of all my just debts, I lend unto my beloved wife Polly all my land and plantation whereon I now live for and during her natural life, proided she, my said wife, do not commit waste of timber on the said land, nor rent, nor sell her right or title thereof to any person or persons whatsoever (unless by the consent of my Executors hereafter to be nominated). I also lend to my loving wife during her life all the residue of my estate, but provided nevertheless if my said wife should commit waste of timber on the said land, or rent or sell the same, as above mentioned, then that the, my said wife, shall only have for and during life one third part of my land and other property. After the death of my wife Polly, I give to be equally divided betwen my two nephews Henry and William Person, the aforesaid land, and in case either of them should die under age and without lawful issue, my will and desire is that the surviving one of them have and possess the whole of the said land, provided he should arrive to the age of twenty one years, or have lawful issue, but in case of the death of the said Henry and William Person, as above mentioned, without lawful issue or arrival to full age, my will and desire is that my said land may then be equally divided between the then two youngest sons of my brother Henry Person, to them and their heirs and assigns forever. Item, my will and desire is that after the death of my loving wife, that all the residue of my estate may be equally divided between all the then surviving children of my brother Henry to them and their heirs and assigns forever. I do hereby appoint my brother Henry Person and my friend Lewis Dupree whole and sole Executors to this my Last Will and Testament.
