Misc. Court Documents 1759-1761 Dec. Ct. 1759 Daniel OBARR is granted a license to keep an ordinary in the town of Peytonsberg for 1 year. His security was Peter WILSON. Nicholas PERKINS one of the gentleman named in the New Commission, took the oath of a J.P. An Inventory and apprasiment of the estate of Ann POWELL, dec'd. was returned. Minutes on this Dec. Court signed by Hugh MOORE. Feb. Ct. 1760 A report for the Privy examination of Frances, the wife of William HARRIS, was ordered. Winefred, wife of Benjamin DICKSON relenquished her right of dower to 370 acres of land formerly conveyed to Solomon DAVID by Halifax deed. Thomas CARR, Gent. produced a commission to practice as an attorney, and took the usual oath. James DANIEL, who is accused of stealing a Hog, the property of Fulker FULKERSON, after Court hearing the evidence, Court rules said Daniel not guilty. James WILLARD, accused of hogstealing, after hearing evidence, Court rules not guilty. [blank] GWIN, also accused of hog stealing, property of Robert WOODING, after hearing all evidence, Court rules said Gwin is not guilty. Joseph MOORE appointed Constable. Joseph SHAW, Constable was sworn. William ROBERTS [Courthouse] is appointed surveyor of that part of the road leading from Wades Ferry road to the Ford on Stanton River. James ROBERTS [Dan River] is appointer surveyor of the road leading from Double creeks to Burches creek, ordered that he along with John & David MOUNT, Allen CALDWELL, George ROBERTS, Nathaniel AYERS, Thomas WATERS, John MADDIN & Wm. Russell clear and keep said road in repair. Abraham ROGERS, Thos CARSON, John EVANS, James SHEPARD & Edw TINNEY, are ordered part of the gang belonging to clear the road with surveyor John LAWSON, from Tobys Creek to TERRYs Ferry road. Duncan SMITH is appointed surveyor from Brewis' Ford to Parker's crosspath. Ordered that John TALBOT clear and keep the road in repair from John BLEVINS Ford on Smiths' River to the place where CALLOWAY's pen (?) road turns out of Hickey's old road. Reuben PAYNE is appointed constable. On the motion of Jane IMBLACK, a servant of James CALDWELL, it is ordered that the said James be summoned to the next court, to answer the complaint of said servant. March Ct. 1760 Jane IMBlACK's complaint for fredom dues was heard, plaintiff ordered to recover from defendant, James CALDWELL 3 pounds and 10 shillings. James WIMBISH, saying he is the owner of the land on one side of the North Fork of the Catawba Ck. asks permission to build a water grist mill on said creek. The Sheriff is ordered to summon 12 honest, intelligent freeholders of the village, to appear on the land where the mill is to be erected, to assess potential damage. Richard SULLINS appearing in the custody of the Sheriff prusuant to an order of last Court, is charged with passing a counterfit bill of Virginia currency, declared that he received the bill of William FUQUA, whereupon said Fuqua is summoned. Thomas DUNCAN is granted a license to keep an ordinary at this Courthouse for 1 year, his security James ROBERTS Jr. The rates of liquors, diet, lodging, fodder, provender, stablage and pasturage are to be the same as for 1756, except for English and Virginia strong beer, and good Virginia brandy. Ordered by the court. Robert HILL, having sworn two oaths in the presence of this Court, he is fined and placed into the custody of the Sheriff, untill he pays the same and gives security for his good behavior for 1 year. Peter BOWMAN, having sworn an oath in the presence of this Court, he is fined and having also behaved contempuously to the Court, ordered that he be placed into the custody of the Sheriff untill he gives security for good behavior for 1 year. Robert HILL, having again behaved contemptably in the presence of this Court is fined 20 shillings and is to be in custody till he pays the same. Peter WILSON, behaving contemptuosly in the presence of this Court is fined 20 shillings. April Ct. 1760 James IRWIN produced a Commission from the Governor, appointing him Lieut. to Capt. Wm. LAWSON's Company & took the usual oath. Peter WILSON produced [same as above] appointing him Captain in the Halifax Militia. John SMITH produced [same as above] appointing him Lieut. under Capt. Peter WILSON's Company. Ordered that William McDANIEL be summoned to explain why the Courthouse is not yet finished. Robert WADE Jr., James ROBERTS Jr., and Thomas GREEN, Gent. are appointed to employ workmen to build stocks and pillory for the use of Halifax. May Ct. 1760 James ROBERTS [Inoco (?) ck.] is granted a certificate for obtaining letters of adminstration of the estate of John ROBERTS, dec'd. and with Tully CHOICE his security, he entered into bond. On the motion of James ROBERTS, admor of John ROBERTS, dec'd. it is ordered that William HERD, Joseph Keal__(?), Wm. DILLINGHAM & Joseph Keaton (?) do value the personal estate and Negros, (if any) of dec'd. John JUSTICE Jr., being guilty of profanely swearing 2 oaths is fined. William McDANIEL, merchant, plaintiff vs. John ROBERTS, defendant in case. The defendant having departed this life, suit abates. June Ct. 1760 Joshua POWEL, having profanely sworn 2 oaths in the presence of this Court, is fined and having also behaved contempuously, it is ordered he be committed to the prison untill he gives sufficient security for his good behavior for 1 whole year, whereupon, said POWEL gave bond in the sum of 50 pounds, and John LIGHT, Thomas FINNEY, John CHISUM & Ephiram HILL gave 25 pounds each to warrent that said POWEL be of good behavior for 1 whole year. John TALBOT is granted a license to keep an ordinary at his house in Halifax for 1 year, having given bond with Jasper BILLING. July Ct. 1760 James FOULIS, Clerk, appearing to be drunk and having profanely sworn 4 oaths is fined + costs + lawyers fee. Tully CHOICE, William HERD, Joseph KEATON & Jermiah MORROH are appointed to value the improvments on 400 acres made by James ROBERTS on Snow Creek. It appearing to this court that William CHIPMAN, son of John CHIPMAN, age 7 years next Sept. 17, has lately and causally had a piece of the under part of his left ear taken off by the belt of a mare. An Acknowledgment by Martin WEBB to John BLEVINS: Sept. 10, 1759; " I do Ecnoledge myself to be a Lier of What I saide of John BLEVINS about HogStealing, As Witness by my hand, Martin WEBB." Sept. Ct. 1760 On the motion of John GORDON, Gent., Halifax Sheriff, Benjamin LANKFORD and James MacKENDREE took the usual oaths of Deputy Sheriffs. Nov. 1760 James CALDWELL having behaved contempuously in the presence of this court yesterday, ordered that he pay a fine of 15 shillings. And said CALDWELL also appearing to be drunk, is fined 5 shillings for which the Churchwardens of Antrim Parish may have due process of law. Alexander CALDWELL is appointed surveyor od the road in the room of James LEAK, and it is ordered that he and the gang assigned to said road do clear and keep said road in repair. Jan. Ct. 1761 Ordered that the gang belonging to the road whereof [now] James Roberts Jr., Gent., is surveyor, do assist in opening the street in the town of Peytonsberg, according to a former order appointing Chelsey TERRY, dec'd. Feb. Ct. 1761 Certificate is granted Lavinia TERRY, wife of Chelsey TERRY, dec'd. for obtaining letters of adminstration of said Chelsey's estate. Robert WADE Jr. Gent., having sworn two profane oaths in the presence of this Court is fined 10 shillings payable to the Churchwardens. Also said WADE having behaved contempuously towards this Court is fined 5 pounds sterling and it is ordered he be held in the custody of the Sheriff untill he finds surties for his good behavior for 1 year. April Ct. 1761 Leave is given William HERD to build a water grist mill on Snow Creek, he being the owner of the land on both sides. COURT was held on April 27, 1761 for the examination of William PREWET Jr. for felony. The aforesaid William having been committed to the prison at Halifax by a warrent in the hand of Thomas GREEN, dated Apr. 14, 1761, on the suspicion of breaking and entering the Spring house of Ephriam HILL and stealing 2 pewter basins, 1 pewter plate and near 30 pounds of butter. Wm. PREWET was this day led into court by John GORDON, Sheriff and it appearing that the time for his examination is elapsed, and that this Court has no cognizance of the fact at this day, it is ordered that said William PREWET be discharged out of custody.
