Hite Deed, 1863 - Halifax Co. VA ABSTRACT OF TITLE TO A TRACT OF LAND NEAR HITESBURG IN RED BANK DISTRICT, HALIFAX COUNTY, VIRGINIA, ASESSED ON THE LAND BOOKS IN THE NAME OF MARY E. HITE AS 51 ACRES. Item I. By deed dated June 22nd, 1863, recorded in the Clerk’s office of Halifax County, Virginia, in Deed Book 60, page 92, Henry Forlines, Special Commissioner, in the chancery cause of Hite against Hite and others, conveyed to Thomas Hite 122 acres of land, more or less, on Aaron’s Creek and Pool’s mill road, for the consideration of $2141.10. This deed is valid, properly acknowledged, and recorded on June 22nd, 1863. The deed recites that Henry Forlines was appointed a commissioner in the above styled chancery cause and directed to make deed to said Thomas Hite with special warranty or title. Note: No doubt the caption land is a part of item I of this abstract, and I do not deem it necessary to trace this title further as more than sixty years have elapsed since the conveyance. Item II. By partition deed dated August 25th, 1890, and recorded in the Clerk’s office of Halifax County, Virginia, in Deed Book 81, page 362, the following partition was made: Nannie T. Forelines Lot #4 containing 21 acres Mary E. Moore Lot #5 containing 20 acres Elizabeth J. Cliborne Lot #6 containing 21 acres Other lots were assigned to other heirs, but as they are no part of this abstract they will not be given herein. This deed recites that Thomas Hite died seised and possessed of 124 acres of land on Aaron’s Creek above and Mrs. Sallie Pool’s mill and adjoining the lands of John Hite, Bedford Hite and the Red Bank to Pool’s mill road, and that the land conveyed to the various parties entitled thereto is a part of the land therein described and owned by the said Thomas Hite at the time of his death. It further recites that the parties to the said deed are all of the heirs at law of the said Thomas Hite. The parties united in this deed are as follows: J.O.V. Hite and A.E. his wife, L.T. Hite and E.L. his wife, W.B.T. Hite and Mary E. his wife, J.F. Moore and Mary F. his wife, W.S. Cliborne and Elizabeth J. his wife, J.C. Forlines and Nannie T. his wife. Note: In the year 1890 on the land books of Halifax County, 122 acres on Red Bank District was assessed in the name of Thomas Hite. I have no information as to the time of the death of Thomas Hite or who his heirs were except the above. Item III. J.C. Forlines and N.T. his wife, J.F. Moore and Mary F. his wife, W.S. Cliborne and Elizabeth J. his wife by deed dated August 18th, 1890, and recorded in said Clerk’s office in Deed Book 81, page 364, conveyed to Mary E. Hite with special warranty of title the following described property: “Their several lots of the same land conveyed to us by the general deed made by the heirs of Thomas Hite, deceased, in the division of the three said lots lying and being in the County of Halifax on the road leading from Red Bank to Pool’s mill bounded by the said Pool’s mill road on the North, Bedford Hite’s line on the West, by the line of John Hite’s on the South and by the late purchase of L.T. Hite on the East And others, containing 51 ½ acres, more of less” Note: It seems from the above that this tract of land should contain 62 acres instead of 51 ½, as the lots assigned to the grantors herein were as follows: Lot #4 to Nannie T. Forlines 21 acres, Lot #5 to Mary F. Moore 20 acres, and Lot #6 to Elizabeth J. Cliborne 21 acres but by deed of the same date Elizabeth J. Cliborne who owned Lot #6 conveyed one-half of said land, the western section thereof, to L.T. Hite, leaving 10 ½ acres. Item IV. Be deed dated April 14th, 1920, and recorded in the Clerk’s office of Halifax County, Virginia, in Deed Book 126, Page 241, William B.F. Hite and Mary J. Hite his wife, conveyed to Goodman C. Hite with general warranty of title for the consideration of $300.00 all of the interest of the said William B.F. Hite in the estate of Mary E. Hite. Note: I am informed that Mary E. Hite died intestate on November 11, 1899, survived by a husband, W.B.T. Hite and the following children: Goodman C. Hite, William B.F. Hite, Birdie K. Hite and Cora Hite. Item V. The deed dated June 28th, 1924, and recorded in the Clerk’s office of Halifax County, Virginia, in Deed Book 134, Page 153, Goodman C. Hite conveyed to W.B.T. Hite with general warranty of title and the consideration of $700.00, all his interest in the land of Mary E. Hite including the interest of W.B.F. Hite which had been heretofore conveyed to him by the said W.B.F. Hite. This deed was recorded July 3rd, 1924. This deed does not recite whether or not Goodman C. Hite was married at the time of this conveyance and I have no information as to this. Item VI. There is now pending in the Circuit Court of Halifax County, Virginia, on the chancery side thereof a suit styled W.B.T. vs. Birdie D. Daniel, Rommie A. Hite, William Roy Hite, Raleigh Hite and Sampson Hite, the object of which is to have partition of the lands of Mary E. Hite. The bill in this suit recites that Mary E. Hite died November 11th, 1899, leaving the following children: Goodman C. Hite, William B.F. Hite, Birdie K. Hite who later married John Daniel and Cora Hite who married Sawney The and died survived by her husband and the following children: Rommie A. Hite, William Roy Hite, Raleigh Hite and Sampson Hite, the last two of whom are infants. I find that all of these parties are properly before the Court, but there is no evidence to show whether or not they are all of the heirs of Mary E. Hite. By decree entered in said suit Samuel L. Adams was appointed a Special Commissioner for the purpose and directed to sell the said land. I, Wm. M. Tuck, an attorney-at-law practicing at South Boston, Virginia, do certify that the foregoing is a true and correct abstract of the caption land as shown by the general indexes of the records in the Clerk’s office of Halifax County, Virginia, and I am of the opinion that a deed from Samuel L. Adams, Special Commissioner, will vest in the purchaser of said land a good and valid title if the parties names in the said suit are all of the heirs of Mary E. Hite.
