Will of Joseph G. E. Baynham, 1848 - Halifax Co., VA Will Book 22, p. 81,82 Halifax County Virginia I Joseph G. E. Baynham being in good health and sound mind to hereby make my last will and testament in the words following to wit: Item 1st It is my desire that after my death that all my lands in Virginia and Missouri states should be rented out until Joanna J. Grady marrys or arrives to the age of twenty one years old and for her to be furnished out of the rents of said lands a sum not exceeding one hundred dollars a year for board schooling &c until the period of her marriage or arrived to the age of twenty one years old at which time she shall receive all the balance of rents and all moneys that may be due me. Item 2nd I give and bequeath to Joanne J. Grady when she marrys and have lawful issue all my lands in the state of Virginia & Missouri also all other property and moneys that may be due me with the exception of some tracts of land hereafter mentioned. Item 3rd I give unto Joseph G. Grady a tract of land lying on the steep Gully branch bounded as follows to wit. Begining at Burtons line on the steep gully branch thence up said branch as it meanders to a white oak below the old high hill spring thence south to Pointers Mill road thence down said road to Pointers near said road in Lockets line thence to Rogers & Jones line from thence along Burtons line to the begining and also all my land in the state of Arkansas. Item 4th If Joanna J. Grady should not marry and have lawful issue after her death it is my wish and desire that all my lands and other property shall be equally divided between my nephews and nieces John Baynham, Musco Atkinson, Tabitha Drinkard, Judith Hester & Mary Fourgurean and Hariett Overton. Item 5th If Joanna J. Grady should not marry or have no heirs it is my wish she should be allowed sixty dollars a years for her support during her natural life out of my estate. Item 6th & last I constitute & appoint John E. P.Pool and Stephen P.Pool Jr. Exors to this my last will & testament. Thompson Thos Moss At a court held for Halifax County the 26th day of June 1848. The within writing purporting to be the last will and testament of Joseph G. E. Baynham decd was exhibited in court by Stephen P.Pool one of the executors proved by the oath of Harmon M. Thompson a subscribing witness thereto who also made oath that Thos Moss another subscribing witness thereto subscribed the same in his presence & in the presence of the testator and that the said Thomas Moss is now dec'd and the case continued for further proof. And at another Court held for said County the 24th of July in the year aforesaid the same was again presented in Court and further proved by the oath of one other witness thereto subscribed and ordered to be recorded. And on the motion of Stephen P.Pool Jr. one of the executors therein named who made oath thereto according to law and with Samuel B Waldin and Reubin Wilkins his securities entered into and acknowledged a bond in the penalty of $2000 conditioned according to law certificate is granted him for obtaining probat of said will in due form. Baynham of the county of St. Clair in the state of Missouri do make and publish this my last will and testament not revoking that part of my will in Virginia which refers to the disposition of my estate in said state. 1st I give and bequeath to my cousins Charles Baynham, Wm Baynham, Joseph Baynham, Elizabeth Blane, Tabitha Drinkard, May Hall and Harriet Overton, all my land lying and being on or near Warbloo creek to be equally divided between them to them their heirs and assigns forever. 2nd I give and bequeath to my sister Mary E Hester all my stock of horses except four name Bulgerball, William a dark mare with a blaze face and a black 3 year olf colt all my stock of cattle except one heifer which I given to Wm Lord [Senr?] also all my stock of hogs my crop of every description and all other articles of my property not otherwise disposed of to her her heirs & after her death equally divided between her children. 3rd I give and bequeath to Benjamin H. Moore a dark bay mare with a blaze face to him his heirs &c forever. 4th I give and bequeath to Robert Hester one sorrel horse called bulgerball to him his heirs &c forever. 5th I give and bequeath to Thomas Hester one sorrel horse called William to him his heirs &c forever. 6th I give and bequeath to A N[or W] Hester one black colt 5 years old to his heirs &c forever. 7th I give and bequeath to Wm Baynham living in the spring river county fifty dollars in money to him his heirs &c forever. 8th I give and bequeath to Mary Sutliff seventy dollars in money to her and heirs and &c forever. 9th It is my desire that all my just debts be paid out of the on hand and the money collected on the bonds due me also my funeral expences and expences of administration and the balance if any I give and bequeath to Mary Fourgurean to her and heirs &c forever, and lastly I hereby constitute and appoint Edmund Nance to be Executor to this my last will Testament. Bullock Clerk of the St Clair County Court and in open court and being by me duly sworn depose and say that they said the within testator Joseph G. E. Baynham sign the within instrument of writing which he published as his last will that he the said testator was at the time of sound mind and over the age of twenty one years and that these deponents attested said will as two of the witnesses thereto by subscribing their names to the same in the presence of the said testator which said proof is deemed by the court sufficient to establish said will.
