Amen. I, Peter T. Comer of the County of Halifax and State or Virginia, knowing the uncertainty of all things earthly and the certainty of death and being Of sound and disposing mind do hereby make and ordain this my last Will and Testament hereby revoking all Other Wills made by me, viz: 1st. I desire that as soon after my death as can be conveniently done that my personal property shall be Sold and out of the proceeds all of my just debts be paid, including all funeral and probate expenses, the residue Of my personal estate i desire to equally divided among my four children, or their heirs, namely: Talmon C. Comer, Charlie L. Comer and the heirs of Susan A. Comer, and the heirs of Rebecca Nunn. 2nd. I give and desire unto my son Charlie L. Comer my tract of land on which I now reside, known as the Old Homestead, and containing 132 acres, (provided that he shall pay unto my grand-children Johnny Nunn and Geneva Lewis the sum of seventy five dollars each). 3d. I give and desire unto my old family servant Crecy Majors (wife of John Majors) the house and lot in which she now resides with the following boundary: commencing at small red oak snag west of her house on the public road, thence due south unto the branch, thence down the branch (making the branch the line) until the large pines are reached on the east side of the house, thence north to the public road, thence along the public road to small red oak at the beginning, to have and hold in full possession so long as she lives and then to revert back to the Old Homestead tract bequethed to my son Charlie L. Comer. 4th. I give and desire unto my grand-children, namely: Andrew Comer,, James Comer, Mollie Comer and Patty Comer (they being the heirs of my daughter Susan A. Comer, deceased) ,the following tract of land that I bought of R. H. Dowdy and wife and adjoining the lands of W. C. Hailey and others and containing twenty five acres, I also give and desire unto the above named grand children one other small tract of land lying South of Hyco River and commonly known as the Robert Wall Tract and containing 25 acres. 5th. I give and desire unto my son Talmon C. Comer the following tracts of land lying south Of Hyco River, first, small tract of land on which the said Talmon C. Comer now resides and known as the Braxton Wall Tract and continuing eight acres, second a certain other tract known as the Benjamin Anderson and Mary Wall Tract and containing fifty seven acres, also one other small tract known as the Jane Comer tract and containing thirty acres. Lastly I nominate and appoint E.C. Pulliam my lawful executor of this my last Will and Testament and request that the court do not require any security. I having unbounded Confidence in his integrity in witness whereof I, P. T. Comer have hereunto set my hand and seal this the 3rd day of December, 1895. A writing purporting to be the last Will and Testament of Peter Comer, deceased, was this day produced in Court and proved by the oaths of A. M. Puryear one of !the subscribing witnesses thereto, who on oath testified that he With A. R. Owen and S. R. Hailey, two other subscribing witnesses thereto, witnessed the signature of the testator to said writing, and that they all signed ;he same together in the presence of the testator at his request as witnesses and that at that time said testator was of sound and disposing mind and memory.
