The submitter has given permission to the USGenWeb Archives to store the file permanently for free access. http://www.usgwarchives.net ************************************************************************ WILL OF ANDERSON SEAMSTER In the name of God Amen, I, Anderson Seamster of the County of Halifax, State of Virginia being of sound mind and considering the uncertainity of this frail and transitory life do therefore make ordain publish and declare this to be my last will and testament. 1st I order and direct that my executors hereinafter issued pay off my just debts and funeral expenses whereas as soon after my death as it is can conceivably be done. 2nd After the payment of such funeral expenses and debts I give devise and bequeath to my beloved wife, Mildred Seamster, all of my property real and personal of whatever description to have and hold in her lifetime. 3rd If my beloved wife should find is necessary to dispose of any of the property to give her a comfortable support in her old age I give her the privilege to dispose of the aforesaid property and such real estate as may be necessary 4th After the death of my beloved wife Mildred Seamster I devise and bequeath to my daughter Sallie Bet Duffey to have her life and at her death to her children all of the highland I inherited and bought from my brothers- in-law Albert and Ben Lacks Known as the Clarke River Farm together with one third of the River law grounds. 5th To my grandchildren Addie and Fannie Duffy children of my daughter Mollie 1/2 one half of the tract of land on which I now live together with one third of the River law grounds. 6th To my son Robert Thomas Seamster 1/2 one half of the tract on which I now live. 1/3 one third of River law grounds all farming implements and -- of whatever description also all of the household and kitchen furniture and should he die without heirs all of the property to revert to the children of my daughters Sally Bet and Mollie. 7th I request that in dividing the tract of land between Robert and my grandchildren Addie and Flossie Duffy the line be so new as to give Robert the house in which I live to Addie and Flossie the house in which there mother lived. In consideration of my daughter Sallie Bet not having as much highland as the others I request that my son Robert and my grandchildren Flossie and Addie pay my debts to amount of Sixty Dollars 60$ Should I owe more than Sixty dollars the balance to be paid equally by all. Lastly, I seek constitute and appoint my wife Mildred Seamster to be executrix of this my last will and testamnet and ask that the Court to such require her to give bond and security thereby make all former wills by me -- In witness whereof I have hereunto subscribed my name and affix my seal the 24th day of February 1897. In the year of our Lord one thousand eight hundred and ninety seven. This instrument was on the day of the date therof signed published and declared by the said testator Anderson Seamster to be his last will and testament in the presence of us who at his request have subscribed our names as Witnesses in his presence and in the presence of each other. Timberlake - Ashton, Va At a court held for the County of Halifax on the 26th day of November 1900 A writing purporting to be the last will and testament of Anderson Seamster was this day provided in Court and favored by the oath of W.S. Adkisson one of the subscribing witnesses thereto who testified that said writing was executed and acknowledged by the Testator as read for his last will and testament in the presence of himself and J. W. Timberlake another subscribing witness and that the said witnesses at the Testators request in his presence and in the presence of each other subscribed the same as such witnesses and that the said Testator was of sound and disphusing mind and memory. Therefore it is ordered that said writing be admitted to probate and recorded as the true last will and testament of the said Anderson Seamster Teste: C.C. Barksdale, clerk
