The submitter has given permission to the USGenWeb Archives to store the file permanently for free access. http://www.usgwarchives.net ************************************************************************ Cabell Seamster's Last Will and Testament: I, Cabell Seamster, of Halifax Co., Va being of sound mind and memory do make and declare this to be my last will and testament. 1st I direct that my executor hereinafter named pay my burial expenses all just debts I may owe as soon after my death as practicable. 2nd I direct that my executor have my land surveyed and divide it as near equal as possible for in to give wood and water to each piece. The half in which the house I live in is situated I give to Anderson Hazelwood, my son, when he becomes twenty-one years old. Until Anderson Hazelwood becomes twenty-one years of age , I give it to his mother, Miss Fannie Hazelwood, as long as she does not Marry or Cohabit with another man, should she do so, I direct my executor take possession of the place, rent it and hold the proceeds for Anderson Hazelwood until he thinks he is capable of managing the place himself. 3rd Should Anderson Hazelwood die before he becomes twenty- one years old I want the place sold and given to Rufus Seamster, my brother, or his heirs. But I give Miss Fannie Hazelwood a house on the place as long as she lives and does not marry or cohabit with another man. Should she marry or cohabit with another man then the place is to sold at once and given to Rufus Seamster or his heirs. 4th I request that my executor sell the other half of the land as he may think best either privately or by public auction or cut it up so as to sell to best advantage and make a deed to same and the deed or deeds my executor makes shall be as good and binding as if I had made deed myself. 5th Out of the proceeds of the land sold by my executor I direct that all my just debts be paid and the balance be paid among my heirs as per article 6th of my will. 6th I direct that my executor pay to my heirs of my sister, Susie Blackstock one dollar, to the heirs of my brother Anderson Seamster one dollar, to the heirs of my brother Henry Seamster one dollar and to the heirs of my brother John Seamster one dollar and the balance whatever it may be I give to my brother Rufus Seamster 7th I give Miss Fannie Hazelwood the cow and calf, I give to Anderson Hazelwood all of my other personal property including crops on land, debts etc and ask my executor to advise with Anderson Hazelwood as to the manage- ment of same. 8th I appoint my friend Giles D. Palmer executor of this my last will and ask that the Court do not require of him any security. This will was signed and acknowledged before the subscribing witnesses all three being in room at same time. Salmon Virginia Halifax Court July Term, 1911 A paper writing purporting to be the last will and testament of Cabell Seamster, deceased, was this day produced in Court and proved by the oaths of W.S. Adkisson one of the subscribing witnesses thereto, who testified on oath that he together with E.T. Salmon the other subscribing witness thereto witnessed the signature of the testator in his presence and at his request and in the presence of each other, they all three being together and signing at the same time. And he further testified that at the time of the signing said paper writing, he believed the testator to be of sound mind and memory.
