Will of David Wall, 1788 - Halifax Co. VA SIGNED OCT 23, 1788 Halifax County, VA 0031862 Pg 322 David Wall In the name of God, Amen. I David Wall of County of Halifax, being sick and weak of body, but of Perfect sense and memory Thanks to God for the same, do make & ordain this my last will & Testament (hereby revoking other will or wills heretofore made) as followeth (To with) Item I give & bequeth to my son John Wall, one negro boy named Harry, &one Nego girl named Warner, to him , his heirs, and assigns forever, also one feather Bed & furniture, two mares, one called Toby, the other a dark bay with a scar in her forehead to him the said John Wall, his heirs and assigns forever. Item I give & bequeath to my son Robert Wall, one negro man named Poinee (being the eldest of that name) also one Negro girl named Esther, also one Bay Gelding which he commonly rides and one feather bed & furniture to him, his heirs & assigns forever. Item I give & bequeath to my son Byrd Wall, one negro man named Sew, also one Negro woman anmed Sarah to him, his heirs & assigns forever, also one feather Bed & furniture. Item I give & bequeath, to my Daughter Catherine Faulkner one young Negro woman named Tamer &one Negro Negro girl named Suck to her& her heirs forever also a small Negro girl now in -- profession named Silvia, to her & her heirs forever. Item. I give & bequeath to my daughter Patty Clay one Negro woman named Fann, also one Negro girl named Lucky to her & her heirs forever. Item. I give & bequeath to my son Parham Walls one young Negro named Tom, also one Negro girl named Fansey (sp?), Pg 323 also one feather bed & furniture, to him, his heirs & assigns forever. Item. I give & bequeath to my son Charles Wall one negro man (or lad) named Prince also one negro girl named Susey (sp?), to him, his heirs & assigns forever. Item. I give & bequeath to my son David Wall (otherwise David Scoggan) one Negro man named Adam, also a negro child if it should be born alive, of which my negro woman named Amy is now pregnant to him , & his heirs forever. Item. I give & bequeath to my son Parham Wall before mentioned, one Negro woman named Amy in addition to what I have herein before given him, to him, his heirs & assigns forever. Item. It is my will & desire that the tract of land wheron I now live, be equally divided between my two sons Parham Wall and Charles Wall, which said land I give to them, their heirs and assigns forever.- Item. It is also my Will and desire that my tract of land on both sides of Grafery Creek, at the mouth of the said, be equally divided between the rest of my sons (Viz.) David, Byrd, John, & Robert Walls which Land I give to them, their heirs, & assigns forever. Item. It is also my Will & desire that the land which I entered for a Cavate aainst Wade & Stokes which land my fishing place is on the south side of Dan River, I give to my son Byrd Wall & John Faulkner which land I give to them, their heirs & assigns forever. Item. I give and bequeath to my son Parham Wall one bay horse which he commonly rides in addition to the what I have already given him, to him, his heirs & assigns forever. Item.- I give & bequeath to my sons, John, Robert, Parham, Charles Walls twenty four head of Cattle to be equally divided between my Sons, John, Robert, Parham & Charles Walls in addition to what I have already given them, to them, their heirs & assigns forever.- Item. I give& bequeath to my son John Wall one grey mare which he commonly rides in addition to what I have already given him, to him, his heirs & assigns forever. Item. I give & bequeath to my son, Charles Wall one young stud horse also one young bay mare, commonly called his to him, his heirs & assigns forever. Pg 324 Item. I give & bequeath to my son Parham Wall one Black Mare named Hitter (sp?) in addition to what I havalready given him, to him , his heirs & assigns forever. Item. I give & bequeath to my son John Wall one Grey horse named Lonsaker (sp?) in addition to what I have already given him to him, his heirs & assigns forever- Item. I give & bequeath to my son Robert Wall one bay horse named Shackle, in addition to what I have already given him, to him, his heirs & assigns forever- Item I give & bequeath to John Faulkner one Grey Mare to him, his heirs & assigns forever. Item. I give & bequeath to my son Byrd Wall my R--ding, in addition to what I have already given him, to him, his heirs &assigns forever. Item I give & bequeath to my daughter Martha Clay, one Sorel mare named Poll, to her, her heirs, & assigns forever- Item. I give & bequeath to my son John, Robert, Parham, & Charles Walls all my Plantation tools & Waggon in addition to what I have already given them, to them, their heirs & assigns forever- Item I give to my son John, Robert, Parham & Charles Walls all my stock of Sheep & hoggs to be equally divided between them in addition to which I have already given them, also my Will & desire is that the remaining part of my stock of Cattle that I have not given away shall be equally divided amongst all my children David Scoggins, Byrd Wall, Catherine Faulkner, Martha Clay, John Wall, Robert Wall, Parham Wall and Charles Wall, in addition to what I have already given them, to them, their heirs & assigns forever, also my Will & desire is that all Debts shall be paid out of my Tobacco, & if there should be any remaining after my Debts are paid, it shall be equally divided amongst my Children, John, Robert, Parham & CharlesWalls in addition to what I have already given them, also my will & desire is that all my Crop of Corn shall be equally divided between my sons John, Robert, Parham & Charles Walls in addition to what I have already given them, to them, their heirs and assigns forever. Pg 325 I do hereby constitute & appoint, John Faulkner and William ___ to be my Executors of this my Last Will & Testament. Witness my name & seal this twenty third day of October one thous. and seven hundred and eighty eight. The last Will & Testament of David Wall Dec’d was exhibited in Court & proved by the oath of Dvid Traynham one of the Witnesses therunto inbeenibed (who also made oath that he saw Charles Traynham witness the said will, who has since deposed this biso). to be the act & will of the said David dec’d and the same was ordered to be artify. And at another Court held for the said County (to wit, on the 24th day of March 1789. The said Will ws further proved by John Hall another of the witnesses therunto. Subscribed to be the act & Will of the said David Wall dec’d & was ordered to be recorded. & on the motion John Faulkner one of the Executors therin named who made oath according to Law cwertificate for attaining probate of the said Will was given to him. he giving surety (sp?). Whereupon he together with Richard Finch, Michael Clardy, & William Sammons- his severettes (sp?) entered into, & acknowledge Bond for that purpose, according to Law.
