Will of Timothy Goodman , 1803 - Hanover Co. VA 6th day of December in the year of our Lord Christ 1803 Parish of Hanover and State of Virginia I, Timothy Goodman of the Parish of Hanover and State of Virginia taking into consideration the certainty of death but being uncertain when that event may happen here determined at this time to make my last will and Testament before weakness of body or the infirmities of age weaken or diminish my understanding or memory which I do inform & manner following viz; I desire my just debts to be paid by my Executors hereafter named, they are but few and so as small amount. I give and devise to Elisha Gilliam Crawford at present living in the State of Georgia the eight following negreos to wit: Sarah, Fanny, Lucy, Lewis, Armstead, Naddy, Jerriah and Dolley to him and his heirs forever. I give and devise to my nephew William Goodman of the State of South Carolina at Vienna the four following negroes to wit: Jenny, John, Darcus, and Peter to him and his heirs forever. I give and devise to my nephew Edmund Goodman the three following negroes to wit; Moses, Cressey, and Sally to him and his heirs forever. I give and devise to my nephew Zachariah Goodman the two negroes following to wit; Minor & Delphy to him and his heirs forever. I give and devise to James Vaughan who lives with Nelson Thompson Esqr in the County of Louisa one negro named Jesse to him and his heirs forever. I lend to my brother William Goodman the tract of land where on I now live, as likewise the land called Hinchies together with the four following negroes to wit: Nat, Charles, Venus & James for and during his natural life upon this condition and under this restriction: that he does not clear any land nor cut down any timber, only such as may be necessary for firewood, fencing, to make ploughs, carts &c. I give to my said brother William Goodman as much corn and meat as will be sufficient in the time of my death, then my Exors to purchase it for him, it is my will and desire that the property hereby lent to my brother William for life should at his death be sold, both land and negroes and the amount of the sales to be equally divided among all his (my said brother William Goodman's) children, the sale to be made on such credit as my Exors may think most to the interest of the children of my said brother William, the amount of which sales I give to them and their heirs forever. I give to my brother Charles Goodman one negro woman, named Milley with all her future increase from this time to him and his heirs forever. It is my will that my Executors purchase as much three per cent stock of the United States as that the interest from the same shall amount to the sum of fifty dollars p annum which sum of fifty dollars it is my will and wish that my Executors lay out annually for the use of Joseph Terrell Goodman in such manner as they may deem most proper for his comfort and convenience the said Joseph Terrell Goodman to have no command or sight to the said fifty dollars annually to be drawn for the interest aforesaid but my said Exors to lay out the same themselves for his use my said Exors to have said stock transferred to them as my Exors and at the death of the said Joseph Terrell Goodman it is my will that the said three per cent stock be sold and the amount divided among all the children of my brother Benjamin Goodman which I give to them and their heris forever. All the rest and residue of my estate of what kind and quality whatsoever I desire may be sold and the amount to be divided as follows; one half to the children of my brother Benjamin Goodman and the other half to the children of my brother William Goodman which I give the them and their heirs forever. In the last place I constitute and appoint my good friends Charles Thompson, William Walton, Charles Terrell and William Mills Executors of this my last will and Testament requesting they would execute the trust this reposed to them. I have chosen them as my Executors knowing them to be honest, attentive men (and no other discussion of men I wish to appoint) and not wishing in my lifetime to have services rendered me for nothing, much less would I wish it after my death. I have thought proper as compensation for the trouble of my Exors or of those of them who will oblige me by asking as such (and hope they will all of them act) to give and hereby do give them ten p cent on the amount of my Estate that they act on or to be more plain, on the value of my Estate. I do hereby revoke all wills or testaments heretofore by me made and declare this to be my last will and Testament . In witness whereof I have hereunto set my hand and affixed my seal this 6th day of December in the year of our Lord Christ 1803. Witness David Bullock John Waddy Timothy Goodman {seal} Geo White Feby 15 1805 By way of codicil to the will within written I will and desire that those of my slaves that I may leave at my death who from age or other causes should be in the opinion of my Exors so infirm as would make it improper in them to deliver the Legatees within mentioned or sold should by my Exors be supported during their lives out of my Estate. I think I am in duty bound to make this procession for the unfortunate slaves and expect my Exors will attend to it. Witness my hand and seal the day above. Acknowledged & signed in presence of Timothy Goodman {seal} David Bullock, John Waddy At a court of monthly session held for Hanover County at the Courthouse on Wednesday the 22nd of May 1805 This Last Will and Testament of Timothy Goodman deceased and the codicils thereon written were offered for proof by Charles Thompson and William Walton, Executors on the said will named and the said will was proved by the oaths of George White, William Corley, Sen'r, and John Waddy witnesses thereto and the said first codicil was proved by the oaths of John Waddy and George White witnesses thereto and the aid second codicil was proved by the oath of John Waddy a witness thereto and the said will and codicils were also proved by the oaths of the said Executors and are ordered to be recorded.
