I Benjamin Oliver of the county of Hannover do make an assign this willing as my last will and testament during the lifetime of my son James. I gave him a pan of my estate and since his death I have given some of his children. I therefore lefe them out of this will. During the lifetime of my son I gave him a part of my Estate and f.... him in possession of my slaves Jacob, Charles, Charlotte, Aggy, Robin, Nancy, Rachel, Bessie? and Nelson which slaves I desire may be considered as a part of his Estate and go agreeably as his last will and testament. I desire that the tract of land whereon I now live may be divided into two parts by a line beginning at a red oak near a road in the line of the land of James Sulfrage? deceased. ..... ...along a line of marked trees to the head of a branch, thence down ..... branch, following a line of marked trees to a gum which line of marked trees is known to all my sons. Thence following the meanders of the said branch is my mill pond the lower part of this is land which lies Eastward by ..... line. I give my sons David, Benjamin and Isaac to be equally divided [smudge] to them and their heirs and assigns forever. The upper part which lies westwardly of this line I give and bequeath unto my son Isaac together with my mill, dam, pond, millstone and all other the appurtenances to the said mill belonging in any wise ap......... to him and his heirs and assigns forever. I give and bequeath to my son Benjamin my ........ to my land in the State of Kentucky to him his heirs & assigns forever. I give and bequeath to my son Isaac the following named slaves ..... Hanson, Jack, Beck, Squire, Ursley, Edmund and Jasper being seven in number (some of which are now in his possession) with their future increase, also my Mill and Blacksmith tools to him his heirs and assigns forever. I give and bequeath to my daughters Mary Clarke and Fanny Mause? the sum of two thousand dollars each to them their heirs and assigns forever. I give and bequeath to my granddaughter Sarah Oliver, Daughter of my son Isaac one Negro named Mahala to her her heirs and assigns forever. I give and bequeath to my grandson Benjamin Clarke, son of my Daughter Mary one Negro named Ned now in possession of his Father to him and his heirs forever. I give and bequeath to my granddaughter Sarah Mause, daughter of my Daughter Fanny one Negro named Eliza now in her possession to her her heirs and assigns forever. I give and bequeath to grandson Thomas Mause, son of Daughter Fanny one Negro named Isaac to him his heirs and assigns forever. I desire that all the rest and residue of Estate after the payment of my debts ...... whether real or personal be equally divided by my friends John Crenshaw, Benjamin Brand, Benjamin Pollard and William Pollard or any them among my three sons David, Benjamin, and Isaac which I give to my sons their heirs and assigns forever. I desire that the cash legacies given in this my will be paid within six months from the time of my death. I appoint my sons David and Benjamin Executors of this my will.
