Witnesseth that the said John F. Rickels and William Rickels for and in consideration of the sum of Twenty Pounds current money of Virginia to them in hand paid by the said Samuel Shumate the receipt whereof we the said John F. Rickels and William Rickels doth hereby acknowledge and ourselves fully satisfyed contended and paid hath bargained and by these preasents doth release and forever confirm unto the said Samuel Shewmate his heirs and assigns a certain track or parcel of land situate lying and being on both sides of a Branch of the lower South fork of Sandy River in the County and State aforesaid. Beginning at a White Oak in Henry Joneses line running thence East to a Corner Oak in John Brown's line at a Branch thence down the said branch, to the mouth thence down the Creek to a corner White Oak, thence South to a Red Oak in Clay's order line, thence bounded by Clays West to Mosleys line thence bounded North by the said Mosley's and Joneses crossing the creek to the first Station containing One Hundred and Ninety Acres more or less with the Reversion of Reversions remainder of remainders issues and services thereof also all the Estate Right title claim property and demand whatsoever of them the said John F. Rickels and William Rickels of and is and to the said track of land and premises above mentioned and every part and parcel thereof with the appurtenances thereunto belonging unto the above mentioned Samuel Shewmate his heirs and assigns forever, TO HAVE AND TO HOLD to occupy and possess and peaceably enjoy this track of land and appertenances unto and he the said John F. DEED OF TRUST Samuel and Elizabeth Shewmate to Thomas Jones and John Crews 7 April 1821 THIS INDENTURE made this eleventh day of April in the year of our Lord Eighteen hundred and twenty one. Between Samuel Shewmate and Elizabeth his wife of Henry County of the one part. Thomas Jones and John Crews of the other part. Witnesseth for and in consideration of a debt due Williamson Millner from the said Samuel Shewmate by bond for the sum of ninety pounds eight shillings and three pence bearing date from the twenty-third of August Eighteen Hundred and Twenty with interest until payment and for the further consideration of one dollar by the said Thomas Jones to the said Samuel Shewmate in hand paid the receipt whereof he does hereby acknowledge he the said Samuel Shewmate hath granted, bargained and sold and doth bargain and sell unto the said Thomas Jones and John Crews the following property (to wit): One tract of land containing one hundred and nineteen acres being the tract that the said Shewmate now resides on in Henry County bounded as follows to wit: Beginning at pointers on the South branch of Sandy River thence new lines S 34 W 22 poles to an oak S 44 W 70 poles to white oak S 71 W 22 poles to a chestnut oak S 44 W 18 poles to pointers S 32 W 27 poles to sorrell tree S 42 W 31 poles to a white oak in the patent line and with the same N 87 E 220 poles to a red oak thence Arthur's former line N 15 E 86 poles W on said branch and up the same as it meanders to the Beginning to have and to hold the same to the said Thomas Jones and John Crews and their heirs and __________ in trust nevertheless, that in case the said Shewmate does not pay of the said bond to the said Millner or his attorneys legally authorized to recover the same by the first day of January Eighteen Hundred and Twenty Two, then on the application of the said Millner or his attorney the said Thomas Jones or John Crews shall advertize the said tract of land for twenty days and proceed to sell the same to the highest bidder for ready money or sow much thereof as will be sufficient to pay of the amount of the said bond and interest and cost of this Indenture, the said Shewmate and wife Elizabeth covenant on their part that the above named land belongs to them free from any incumbrance whatever. The within Deed of Trust from Samuel Shewmate to Thomas Jones and John Crews for the benefit of Williamson Millner was acknowledged by the said Shewmate and Jones as their act and deed and ordered to be recorded and the Certificate hereunto annexed touching the relinquishment of Elizabeth Shewmate's dower was in like manner admitted to record. DEED Samuel and Elizabeth Shumate to William Shumate 27 June 1821 THIS INDENTURE made this twenty seventeenth day of June in the year one thousand eight hundred and twentyone between Samuel Shumate and Elizabeth Shumate his wife of the County of Henry and State of Virginia of the one part and William Shumate of the said County and State of the other part WITNESSETH that the said Samuel Shumate and Elizabeth Shumate for and in consideration of the sum of one hundred sixty dollars good and lawful money of Virginia; to them in hand paid by the said William Shumate, receipt whereof they do hereby acknowledge and confess that they have bargained and sold and doth by these presents doth grant, bargain, sell and confirm unto the said William Shumate and his heirs forever one certain tract or parcel of land lying and being in the County of Henry State of Virginia on the waters of the South Fork of Sandy River containing 83 acres be the same more or less and bounded as followeth to wit: Beginning at pointers on a South branch of Sandy river thence a new line S 34 degrees West 22 poles to a red oak thence South 44 degrees West 70 poles white oak thence S 71 degrees West 22 Poles to a Chesnut oak, thence South 44 degrees West 18 poles to pointers thence South 32 degrees W 27 poles to a sorrell tree thence South 42 degrees West 31 poles to a White oak in the patent line and with the same South 27 degrees West 52 poles to a stump where a White oak was formally called for thence North 14 degrees East 82 poles to a Chestnut thence North 45 degrees East 138 poles to pointers on said branch and down the same as it meanders 82 poles to the Beginning - with all the appurtenances thereunto belonging to the only proper use and behalf of him the said William Shumate his heirs and assigns forever and the said Samuel Shumate and Elizabeth Shumate his wife themselves their executors and admiministrators do covenant and agree with the said William Shumate that they the said Samuel Shumate and Elizabeth Shumate that they will at this time as well as at all other times will warrant and forever defend the right to the above mentioned tract of land with all the appurtenances to him the said William Shumate and his heirs forever against themselves their heirs and any other themselves their heirs or any other person of persons laying any just claim to the above eighty three acres of land. INDENTURE Shewmate and Earles to Millner 31 July 1823 THIS INDENTURE made and entered into this 31st day of July Eighteen Hundred and Twenty Three between Samuel Shewmate of Henry County, Thomas Earles, and Sally Earles his wife formerly Sally Arthur of Pittsylvania, Timothy Earles and Naomia, his wife, formerly Naomia Arthur of (blank) County Virginia of the one part and Williamson Millner of said county of Pittsylvania of the other part. WITNESSETH that for and in consideration of the sum of four hundred and twenty four dollars paid by the said Millner to said Shewmate, receipt of which is hereby acknowledged and for and in consideration of value received by the said Thomas and Timothy Earles and by their wifes from the said Samuel Shumate the receipt of which they hereby acknowledge they not however not as yet have made a conveyance of their interest in a title and interest to be conveyed to the said Millner by said Shumate's request they the said Shumate the said Thomas Earles and Sally his wife the said Timothy Earles and Naomia his wife for the above said valuable consideration hath sold and delivered by these presents doth sell enessoss and confirm one certain tract or parcel of land containing one hundred and six acres be the same more or less lying and being in the counties of Henry and Pittsylvania and bounded as follows vis: beginning at Millner corner and thence his lines South 58 degrees East 10 poles to an old Poplar South 80 degrees East 9 poles to White oak thence Curry's line South 75 East 31 poles crossing said branch twice to a beach on said branch then said Curry's and Melton's line North 11 degrees East 105 poles to a Chestnut stump thence said Meltons and Stamps line south 73 degrees West 114 poles crossing a branch to pointers thence Stuarts lines N 50 degrees West 86 poles crossing a branch to pointers North 76 degrees West 74 poles to pointers on the Main Road thence along the said Road South 7 degrees West 54 poles to a rock and said branch South 29 degrees West 20 poles to White oak North 84 degrees East 30 poles to stone - persimmon bushes then said Millners line North 45 degrees East 28 poles to pointers on said Branch and down the same as it meanders to the beginning to have and to hold the said land with all and singular the privileges and appurtenances thereunto belonging or in any wise appurtaining to the same unto him the said Millner his heirs or assigns in fee simple from and the said Shumate for himself and heirs doth covenant and agrees to warrant and defend the right and title to said unto said Millner his heirs and assigns against all just claims whatsoever the said Earles with their wifes defends the said title in like manner against themselves and their heirs and all claiming under then. William and George Goody Koontz, Justices of the peace in the County aforesaid in the State of Virginia do hereby certify that Timothy Earles a party to a certain deed bearing date on the 31st day of July in the year 1823 and hereto annexed personally appeared before us in our county aforesaid and acknowledged the same to be his act and deed and desired us to certify the said acknowledgement to the Clerk of the County Court of Pittsylvania in order that the said deed may be recorded. William, Justices of the Peace in the County aforesaid in the State of Virginia do hereby certify that Naomi Earles the wife of Timothy Earles a party of a certain deed bearing date on the 31st day of July and hereto annexed personally appeared before us in our County aforesaid and being examined privily and apart from her husband and having the deed fully explained to her she the said Naomia Earles acknowledged the same to be her act and deed and declared that she willingly signed, sealed and delivered the same and that she wished not to retract it. William At a Court held for Pittsylvania County on the 15th day of September 1823 this Indenture from Timothy Earles and Naomia his wife and others to William Millner was presented in Court and upon the certficates of acknowledgement of the said Timothy and of the relinquishment of the dower of said Naomia hereon endorsed was ordered to be recorded as to them and at any day to wit at a Court held for said county the 15th day of March 1824 the said deed was acknowledged by Samuel Shumate to be his act and deed and ordered to be recorded as to him. DEED Jones, Millner, Shumate 11 August 1823 THIS INDENTURE made this 11th day of August eighteen hundred twenty three between Thomas Jones of Henry and State of Virginia of the one part and Williamson Millner of the County of Pittsylvania and State aforesaid of the other part Witnesseth that where as the said Thomas Jones in pursuance of a Deed of Trust to him by Samuel Shumate for the benefit of Williamson Millner hath agreeable to the provisions of the Trust deed, exposed to sale to the highest bider for ready money the transaction of land specified in the said Deed and the said William Millner became the highest bider at the sum of thirty five dollars and seventy cents. Now the said Thomas Jones for and in consideration of the aforesaid sum of thirty five dollars and seventy cents hath bargained and sold and do by these presents bargain and sell unto the said Williamson Millner his heirs and assigns forever the said tract of land in the said deed mentioned and described as follows to wit and beginning the County of Henry on the waters of Sandy River and bounded as follows, to wit. Beginning at pointers on the South branch of Sandy River thence new lines South 34 West 22 poles to a red oak 44 West 70 poles to a White oak S 71 West 22 poles to a Chesnut oak South 44 West 18 poles to pointers South 32 West 27 poles to a sorrell tree South 42 West 31 poles to a White to a White oak in the patent line and with the same North 87 East 220 poles to a Red oak thence Arthur's former line line North 15 East 86 poles to said branch and up the same as it meanders to the beginning with all woods ways waters and water courses orchards and hereditaments thereunto belonging or in anywise appertaining to have and to hold to him the said Williamson Millner his heirs and assigns forever to the only proper use and behoof of him the said Williamson Millner his heirs etc, the said Thomas Jones do warrent and forever defend all the right and title vested in him by the said trust deed free from the claim of himself his heirs and every other person or persons claiming under the same. At a Court of quarterly sessions held for Henry County at the courthouse on Monday the 11 day of August 1823. The within deed from Thomas Jones Trustee to Williamson Millner was by the said Thomas Jones acknowledged to be his Act and Deed as Trustee for Samuel Shoemate and the same was ordered by the Court to be Recorded. DEED OF TRUST Samuel Shewmate, George Gravely, Jones and Watkins 28 January 1827 THIS INDENTURE made and entered into this 28th day of January 1827 between Samuel Shewmate of the County of Henry of the first part and George Gravely of the County and State aforesaid of the second part and Jones and Watkins of the third part. WITNESSETH that the said Samuel Shewmate is indebted to said Jones and Watkins in the following sums (lst bond of Seventy payable 27 January 1827, 2nd, bond payable 28 January 1827 of Nineteen Dollars and 3rd bond of Eighteen dollars payable lst day February 1827, 4th payable 2 day of February 1827, and am desirous of securing the same by Trust deed and for the consideration of which have granted bargained and sold unto said George Gravely Trustee for myself and Jones and Watkins the following property: 1 bay mare, 3 head cattle, 2 beds and furniture, 15 head of hogs, my present crop of tobacco lay 1200W now on hand and all my plantation tools and kitchen furniture also the ensuing crop of corn and tobacco all that I make and fodder for the said George to have and to hold free from the claim or claims of myself my heirs executors and administrators for the only proper use of said George Gravely and his heirs and assigns forever for the benefit of Jones and Watkins as aforesaid now if the said Samuel Shoemate should fail to discharge the above named debts when required by said Jones and Watkins or either of them Jones or Watkins or their heirs or assigns it shall be duty of said George Gravely Trustee after 1st day of 1828 by advertising the time and place of such sale 10 days for ready money and first pay to Jones and Watkins or either of them or their legal representative the above sums of money interest and cost and the balance if any pay over to Samuel Shoemate or his heirs and it is understood that the said Samuel Shoemate of selling the present crop of tobacco by applying the proceed thereof to his several debts and all the money he otherwise can raise but if the said Samuel Shoemate should not fully satisfy said debts by 1st day of May 1828 in that case the said George Gravely is required to sell as before mentioned when called on by either party Armistead Jones and Benjamin Watkins or legal representatives it is also understood that the Trust shall not effect the collect of said debt or any part thereof at any time hereafter. But if the said Samuel Shoemate should will and truly pay this before named sums of money interest and costs this trust will become void or otherwise remain in full force and virtue. DEED Arthur and Earles to Tolliver Shumate 4 January 1817 THIS INDENTURE made this fourth day of January one thousand eight hundred and seventeen between Elizabeth Arthur, Jesse Arthur, Thomas Earles and Sally his wife, Ruth Arthur and Rebecca Arthur of the county of Henry and State of Virginia of the one part and Toliver Shoemate of the same county and State of the other part. WITNESSETH that the said Elizabeth Arthur, Jesse Arthur, Thomas Earles and his wife, Ruth Arthur and Rebecca Arthur, for and in consideration of the sum of two hundred and fifty dollars current money of Virginia to them in hand paid by the said Toliver Shumate the receipt whereof they doth acknowledge and confess that they have bargained and sold and by these presents doth grant bargain sell and confirm unto the said Toliver Shumate and his heirs forever one certain tract or parcel of land lying and being in the County of Henry and Pittsylvania on the waters of Sandy River containing fifty nine acres being the same more or less and bounded as followeth to wit: Beginning on Samuel Shumate corner White oak from there South 3 1/2 degrees East 70 chains and 2 links along Samuel Shumate line to an oak thence along this and Shumate line South 58 1/2 degrees East 5 chains to a Poplar, thence along the said Shumate line South 79 degrees East 4 chains and 30 links to a White oak thence along Samuel Shumate line South 14 and 3/4 degrees West 20 chains and 50 links to a Red oak, thence North 80 degrees East 7 chains and 50 links to a White oak, thence along with Thomas Curry and Richard Melton's (deceased) line North 11 1/2 degrees East 44 chains and 5 links to Chesnut thence with Joseph Jones line South 73 degrees West 19 chains and 60 links to the beginning with all appurtanances thereto belonging to the only proper use and behoof of him the said Toliver Shumate his heirs or assigns forever and the said Elizabeth Arthur and Jesse Arthur, Thomas Earles and Ruth Arthur and Rebecca Arthur themselves their heirs their executors administrators covenant and agree in the said Toliver Shumate that they the said Elizabeth Arthur, Jesse Arthur, and Thomas Earles and Sally his wife, Ruth Arthur and Rebecca Arthur that they at this time as well as at all other times will warrant and forever defend the right of the above fifty nine acres of land more or less with all the appurtanaces to him the said Toliver Shumate and his heirs forever against him his heirs or any other person or persons whatsoever laying any just claim to the above fifty nine acres of land. WITNESSETH that the said Toliver Shomate for and in consideration of the sum of two hundred dollars lawful money of Virginia to him the said Toliver Shomate in hand paid the receipt whereof is hereby acknowledged he the said Toliver Shomate hath granted, bargained and sold and by these presents doth grant bargain and sell unto the said Samuel Shomate his heirs or assigns all those mesuages a certain parcel or tract of land lying and being in the County of Henry and State of Virginia on the waters of Sandy River butted bounded and limited as followeth to wit: Beginning on the said Samuel Shomate corner White oak, thence with the said Samuel Shomate line South 3 and 1/2 degrees East 70 chains and 10 links to an ash near a White oak, thence along with said Samuel Shomate line South 58 degrees East 5 chains and 30 links to a White oak, thence with the said Samuel Shomate line South 14 1/4 degrees West 20 chains and 50 links to a Red oak, thence with Stephen Holland's line North 80 degrees East 7 chains and 50 links to Thomas Currey's corner White oak, thence with Thomas Currey's and Judith Melton's line North 11 1/2 degrees East 46 chains and 5 links to a Chestnut, thence with Judith Melton's and Stewart's line South 23 West 19 chains and 60 links to the beginning and also all trees, wood, underwoods, ways, water, water courses, profits, commodities advantages, heridments, and appurtances, whatever to the said mesuage ac above mentioned belonging in anywise appurtaining thereto, and the rents, reversion and reversions, remainder and remainders, issues and profits of the said premises and all and every part and parcel thereof and all the estate, rights, title, interest claims and demands whatever of him the said Toliver Shoemate of in and to the said mesuage ac and premises and every part thereof and to hold the said mesuage ac and all and singular other premises above mentioned and every part and parcel thereof with the appurtances unto the said Samuel Shomate his heirs and assigns to the only proper use and behoof the said Samuel Shomate his heirs and assigns forever, and the said Toliver Shomate for himself, for him his heirs the said mesuage and premises and every part thereof against him his heirs and all and every other person and persons whatever to the said Samuel Shomate his heirs and assigns shall and will warrant and forever defend by these presents. DEED Charles Gilley to Tollison Shewmate 25 January 1842 THIS INDENTURE made this 25 day January 1842 between Charles Gilley and Elizabeth his wife of the County of Henry and State of Virginia of the one part and Tollison Shewmate of said County and State of the other part. WITNESSETH that for and in consideration of the sum of two hundred and twenty five dollars and also the further sum one dollar part to the said Gilley at and before the sealing and delivery of these presents by the said Tollison Shoemate the receipt whereof is hereby acknowledged by the said Gilley and wife have bargained and sold and by these presents doth bargain sell and release unto the said Tollison Shoemate his heirs and assigns forever a certain tract of land lying and being the County and State aforesaid on the North side of Smith's River and containing one hundred acres more or less bounded as follows: Beginning at a Willow on Smith's River in Cobler's line thence with said line North 78 poles to a Red Oak South 85 degrees West 44 poles to a Spanish oak in Pace's line North 30 degrees East 116 poles to Red oak in Fontains line thence with said line North 80 degrees East 34 poles to a White oak South 53 degrees West 20 poles down a branch as it meanders to Burgess's line line to pointers with his line South 200 poles to a Walnut on the river thence up the river with it meandering to the beginning. To have and to hold the said land with all its appurtenances thereunto belonging to the only proper use and behoof of him the said Shoemate his heirs and assigns forever and the said Charles Gilley and wife their heirs and assigns do warrant and forever defend the right and title of the said land against themselves or any person or persons whomsoever claiming. WITNESSETH that for and in consideration of the sum of two hundred fifty dollars to me in hand paid by the said Odle the receipt whereof is hereby acknowledged he the said Shoemate has bargained and sold and by these do bargain sell confirm and release unto the said Odle his heirs and assigns forever a certain tract or parcel of land situated lying and being the County of Henry and State of Virginia on the waters of Smith's River it being the same which said Shoemate purchased of Charles Gilley as per deed to him duly recorded in the Clerk's office of said County containing one hundred acres more or less and bounded as follows to wit: Beginning at a Willow on said river in Cobler's line thence with his line North 78 poles to a Red oak South 85 degrees West 44 poles to a Spanish oak in Pace's line North 30 degrees East 116 poles to a Red oak in Fontaines line thence with his line North 80 degrees East 34 poles to a White oak South 53 degrees West 20 poles down a branch as it meanders to Burgesses line to pointers with his line South 200 poles to a Walnut on the river thence up the river with its meandering to the beginning to have and to hold the said tract or parcel of land with all and singular the appurtenances thereunto belonging to the only proper use and behoof of him the aforesaid George Odle his heirs and assigns forever and the said Tolison Shoemate hereby warrants and defends the right and title to the same said tract or parcel of land to the aforesaid George Odle his heirs and assigns forever free from the claim or claims of all and every person or persons whomsoever. Witnesseth that for and in consideration of the sum of thirty dollars good and lawfull money of Virginia to the said James Shoemate in hand paid by the said John Clarke the receipt whereof is hereby acknowledged hath granted bargained and sold and by these presents doth grant bargain and sell alien ensseoss and confirm unto the said John Clarke and his heirs forever this the one undivided eleventh part of two hundred acres of land which James Clarke deceased possessed, in the County aforesaid on both sides of the road called Hickeys and bounded by the lands of Robert Hairston together with all the apertainces thereunto belonging to have and to hold the said undivided part of said tract of land unto the said John Clarke his heirs and assigns the said doth hereby for himself his heirs and assigns warrent and forever defend the right and title and interest in said land unto the said John Clarke his heirs and assigns forever as well against the claims and lawful demand of him the said Shoemate his heirs and assigns all and every other person or persons whomsoever.
