Book 5 Pp 367-368 This Indenture made this 22nd day of May in the year of our Lord 1789, Between David HARBOUR of Montgomery County in Virginia of the one part and James PATEETE of Henry County of the other part Witnesseth that the said David HARBOUR for & in consideration of the sum of two hundred pounds current lawful money of Virginia to him in hand paid before the Ensealing and delivery of these presents the receipt whereof the said David HARBOUR doth hereby Acknowledge hath given granted bargained sold aliened Infeoffed released and confirmed and by these presents doth give grant bargain sell alien release and forever confirm unto the said James PETEET his Heirs & assigns forever one certain tract piece or parcel of land containing by Estimation three hundred and thirteen acres lying & being in Henry County The South fork of Gobbling Town Creek and bounded as followeth to wit: Begining at a Red oak thence North Twenty Six Degrees East Seventy Three poles Crossing a branch to a red oak North twenty seven degrees West one hundred poles crossing a branch to a red oak North Seventy Degrees east fifty two poles crossing a branch to a Walnut tree by the creek South sixty seven Degrees East forty nine poles crossing a creek to a red oak South twenty three Degrees East sixty nine poles to a black haw south twenty Eight Degrees west sixteen poles to a white oak South twenty nine Degrees East thirty eight poles to a red oak South forty five degrees West twenty six poles to a white oak South twenty seven degrees East Seventy four poles crossing a branch to a white oak South forty three degrees west to sixty nine poles to a white oak south three degrees East thirty four poles crossing a branch to a white oak by a branch south sixty four degrees West seventy six poles to a poplar North sixty two degrees West forty five poles to an oak by the creek and thence a new line North forty one degrees west one hundred and sixty poles crossing a creek two pointers in the old line and thence the same south Eighty five Degrees East one hundred and twenty Eight poles to a red oak North fifty nine degrees East Seventy six poles to a white oak south eighty degrees East fifty two poles to the first station To have & to hold the said tract or parcel of land and every part and parcel thereof unto the said James PATEET Senr. him his heirs and assigns forever of the said David HARBOUR his heirs and assigns forever and the said David HARBOUR doth covenant and agree for himself his heirs Exr Admr & assigns that with said James PATEET his Heirs Exers Admrs & assigns that will Warrant & forever defend the sd tract piece or parcel of land unto the sd James PATEET his heirs & assigns forever together with all woods ways waters & water courses profits commodities advantages Hereditements & appurtenances Whatsoever or in any wise appertaining from himself his Heirs Exers admrs & assigns from ever laying any right or claim to any part or parcel thereof In Witness whereof the said David HARBOUR hath Hereunto set his hand and seal the day first above written Signed Sealed & Delivered In presence of us David HARBOUR S.S. Attest Jesse SPURLOCK Drury SPURLOCK Memorandum that on the [blank] of May 1789 Just & peaceable possession & Seizen of the Land & premises with mentioned was had & taken by David HARBOUR above named by him delievered to the within named James PATEET to behold according to the effect of this Indenture. The within written Indenture together with the memorandum of livery & Seizen herein endorsed was acknowledged by above named David HARBOR to be his respective Acts & Deed and mary his wife being privately examined as the law Directs relinquished her Right of Dower in & to the within Land and premises Conveyed by her said Husband in the within Indenture All which was ordered by the court to be Recorded.
