HENRY COUNTY, VA - DEEDS - Reubin Wells to John Ivy, 16 Jun 1820 --------------¤¤¤¤¤¤-------------- The following is transcribed from a Deed of Trust transaction between Reuben Wells and John Ivie Henry County, VA, Deed Book 9, pp 105-106, 6/16/1820 Ivy from Wells deed of Trust This Indenture Made the 16th day of June in the year of our Lord one thousand Eight Hundred and twenty Between Reubin Wells of the County of Henry and State of Virginia of the one part and John Dillard of the County and state aforesaid of the other part witnesseth that the said Reubin Wells in order to secure the payment of the following Debt unto John Ivy which said Ivy was Compelled to pay unto Geo Hairston as security for said Wells the sum of one hundred and ninety three Dollars and fourteen cents as will appear for Bond, and in consideration of the sum of one dollar to him in hand paid by the said John Dillard at or before the ___ and delivery of these presents the receipt where of is hereby acknowledged, he the said Reubin Wells hath granted bargained and sold and by these presents doth grant bargain and sell unto the said John Dillard all the following property to wit, three feather Beds, Bed steads and furniture, two Chests, one shot gun, one table, six Chairs, two potts one mans saddle, and all his table and Cupboard furniture. To have and to hold the said property herein before mentioned to be hereby granted with their and every of these appurtainances unto the said John Dillard his heirs Executors administrators and assigns forever, upon Trust nevertheless that the said John Dillard shall at any time when the said John Ivy shall request him of the advertising the said property at least ten days before the day of sale at two of the most Public places in said County procede to sell the aforesaid property at Highest Bidder for the best prise that Can be had in ready money and out of the money arising from such sale in the first place to pay and satisfy all reasonable charges attending such sale, and then the debt above mentioned, and the residue of the money arising from such sale as aforesaid to the use of the said Reubin Wells his Executors and administrators or assigns or to such persons or persons as he by writing under his hand shall appoint, and in default of such appointments to such persons or persons as would be thereunto entitled, now if the said Reubin Wells shall at any time pay unto the said John Dillard the above mentioned debt and Charges then this trust shall cease otherwise remain in full forse power and virtue-as witness our hands and seals the day and year above written- Reubin Wells [his mark X & his seal] John Dillard [his signature & his seal] Signed sealed and delivered in presence of Wm F Mills Wm F Abingdon Jacob Clark Henry August Court 1820 ___ & ___ [2 words in margin I can't make out] The within deed of Trust from Reubin Wells To John Dillard for the Benefit of John Ivy was acknowledged by the said Dillard and Wells as to there act and deed and the same was ordered by the Court to be recorded.
